Hate to be the devil's advocate here, but the Estate hasn't had a problem with releasing stuff that's leaked before. Xscape was largely made up of tracks that had already leaked, with Thriller 40 continuing the tradition.
Here's the thing, though. What has leaked is of drastically lower quality than the actual files on Sundberg's computer. If the hacker gets his way, the amount of stuff that could leak will be bigger than the SME server leak that went down years ago.

Unless they say they've been lost or destroyed, 90% of the time when they say they're "non-existent," they either mean "not transferred to digital" or "not in the hands of illegal collectors."
