Ivy, why couldn't challenging the estate be the same as challenging the will? Some judge needs to tell Katherinto knock it off or she will lose her 40%! I know it's wishful thinking but I thought this settlement was a good thing for KJ

I think the estate has tried to be fair and patient because Katherine is involved but now they need to be tough. This is nonsense and they have no intention of working with the estate.

Actually you got it right. They agree on a bunch of terms they sign it and later they state that they have concerns.

And why did they sign it then is the question we are also looking the answer for.

Basically aren't K and J essentially helping to fight against their own son? Once again showing a remarkable lack of, how can I say this nicely, parental caring? Why does it seem at every turn, Michael is coming in second place with his parental units? I don't understand why they think they have to do this. Why do they continue to demonstrate what seems to be a real lack of understanding of their own son's best interests?
When you start to consider the totality of the way they have behaved and are behaving, in many ways they come across less like parents and more like people who seem to think they are owed something from their son. Or is it simply that they are both old and easily influenced by others?

Not surprise cause Raymone Bain said in a statement soon after the settlement that Katherine was still in business with Mann! The estate needs to stop playing nice with these people, they should have took it to trial from the beginning! Don't they know that fraudulent people will always find loopholes with the law to get away with crap?!

I think the main question now how much of a role Howard Mann played in this new development.

As we all know the whole deal between HTWF and Mann was based on the trademarks that Melissa registered. He hoped Melissa / HTWF win and keep the trademarks so that they can produce goods with those trademarks and make money.

The settlement and the transfer of trademarks from HTWF to the Estate would shut down this deal completely.

With seeing the confidential settlement forwarded to Mann , my gut feeling tells me that Howard Mann is somewhat behind this development and again making a move towards MJ trademarks with the hopes of making money out of MJ related merchandise.

Is this ever going to end? If his family want to honor his memory than they should work with his estate and do something special. I think they forget that Michael created his estate. The way this comes across is like they are fighting their own son. This is what makes it difficult to support his family. Just stop it already.

What I don't get is they all had lawyers there Katherine's lawyer was there Johnson's lawyer was there if there was any issue why was it not bought up then? I hope the judge forces them

I'm not familiar with this blogger and she seems to be the only one reporting this information. Does anyone know her source? The Estate has made no announcement about it and there's nothing in the mainstream or tabloid (TMZ) media about this development.

I have to say, it sounds very strange, since both sides were represented by lawyers and once a deal is reached in a court of law, it's usually binding.

I'm confused...

It's true. You can see my posts as well. I have the copy of the documents filed with the court. and this is actually a status report, the actual motion (requesting the judge to enforce the settlement) will be filed Thursday (May 19th).

Thanks very much! I just wanted to be sure...Are the status report documents posted anywhere?

I have to say it's astounding since legal counsel were involved...the first thing you establish in a settlement is who has the power to negotiate. What is your take on what went wrong here? Just curious...

ETA: Thanks for adding the screenshots to the post above...Are they online somewhere, or do you have the actual docs? Can I make a request to the Court to get them? Would really like to read the entire doc, if possible.

Pro - HTWF Approach

- HTWF claims that Johnson signed the Settlement without authorization or permission from the Board of Directors.

(side note : however you are right who can negotiate what and who can sign what has to be established beforehand)

Middle of the Road approach

- HTWF realized the settlement wasn't to their best interest and is trying to get out of it by trying an excuse (board of directors didn't approve it)

(side note: Do you remember people that claimed this settlement a victory for HTWF and mentioning how happy Melissa was?)

Pro - Estate Approach

- HTWF never wanted this settlement (as they didn't do a single document) and this was a delay tactic.

(side note : remember how HTWF had trouble submitting evidence lists and the judge limited their evidence and this was a bench trial )

Skeptical Approach

- Howard Mann played a role on this as he wanted the trademarks for merchandise and profit.

The whole thing is a shame and pathetic.
I am also feeling that Howard Mann is behind all these since he can't use the trade mark because the settlement.
I really feel so sorry for MJ that Katherine still can't see through this leeches and continue to damage his legacy.
On the other hand, can someone explain to me that is this even possible that you can just throw the settlement out off the window like this.

In some instances you can make an argument to rescind a settlement such as if you were coerced to sign, you were frauded etc. For example very recently Winklevoss twins is taking the Facebook settlement to court saying that they were defrauded about the amount of settlement.

It seems like HTWF will make an argument based on charity's bylaws saying that it would require a majority board of directors approval and as Melissa Johnson didn't have this approval / permission the settlement has to be voided.

And again it seems like Estate will make a counter argument for this (we'll see this on the papers to be filed Thursday) and ask the judge to enforce the settlement.

And in a few months time we'll see what the judge decides and how will this go on.

Thanks for the answer. One more question. Is Johnson the person who register those trademarks and own them or HTWF owns them?
I guess they will continue to fight over this for some times.
Just as we though it ended, it starts again.
It's sad to see people drag MJ's legacy through mud.

Before the Jacksons were all for Melissa, backing her 100% given their approval and authority to do whatever. But, all of a sudden now she has none, funny.

Personally, this whole thing sounds like crap to me. But I can't say that I wasn't expecting it. Something seemed to be not right about the settlement to me anyway. Overall, this was a shamefully hot mess from the start, in my opinion.

Anyhow it is to laugh:

Melissa Johnson and Mrs. Jackson have agreed with their lawyer to the arrangement.
Then they have gone contently home and were proud of her work. Also Howard Mann …

Maybe they started to think only when they read the comments of the fans. (Maybe the fans should have written how badly and disadvantageously the contract is for the Estate!)

About the Trademarks and sides of M. Johnson could have been sold still even more than the Memorabilia by H. Mann!
It would have given there a regular and very lucrative Parallel-Merchandising … and also the goods with the old HIStory logo would have had there their place (there is not only Michael's father integrated).

Besides:
The time is very favorable. Maybe Mr. Branca hasn't now the time to look intensely with the matter of the old and nevertheless very actually MJ Net Entertainment!
Mr. Dieter Wiesner will be glad.
