Bravado sues Julian Rouas (Joe's partner)for MJ Perfumes / Update: Settlement Reached

Aquarius they are not using better manufactures, because it appears they are now working with Rouas. I hope this is not true and the person who translated it got it wrong.

I used google translator, so probably some words got translated wrong. If there's someone here who speaks french and could translate properly, that would be great. Otherwise, we will have to wait for a better confirmation.

No Bravado is not working with Rouas. They lost the lawsuite when they tried to sue him from marketing the colognes.
They have nothign to do with what Rouas is selling.

Bravado sought to prohibit the marketing of these colognes and demanded $ 150,000 in damages plus $ 750 every time the name of Michael Jackson appeared illegally on a product. The verdict was delivered on 8 November in favor of Rouas which was able to offer a sneak preview Friday's fragrances. 20 bottles are ready.

Actually they didn't lose the lawsuit. There was a settlement and it's confidential. So Rouas is lying when saying there was a "verdict in his favor". Plus we don't know what will be allowed or not. Technically Rouas can release a Joe Jackson perfume as long as he's not using Michael's name or likeliness. There's nothing to suggest that Bravado is working with Rouas.

So if the settlement agreement is under seal . Isnt Rous breaking that sealed agreement by by making such statements like a "verdict" was delivered in his favor.

Also I think if Bravdo holds the copyright to the images Raous is using and they are working with him their copyright name would be on the product. It may be they didnt hold those particular copyrights or that Rouas is just not allowed to use all of them or Michael's name. We wont know untill we see the actual product. but being Joe is no longer working with him it may be hard for him to pass it off as something actually associated with Michael.

Settlements are generally in favor of everyone involved, for example in a regular Bravado settlement Bravado gets the merchandise stopped and drops the financial damages. So it becomes a win-win for both parties. But "verdict" is a wrong choice of words, verdict means a judge or jury came to a decision - which didn't happen here.

As for "is this breaking the settlement confidentiality" question : no, as he's not giving out any specific details/terms of the settlement.

^^Thanks guys, so now we wait and see what Rouas comes up with, but I wish it was not so easy for people to make these false statements which go unchallenged. The statements made in the article above might influence fans to buy his product, if they are not aware of the history behind the Rouas/Joe/Bravado case.

Another article translated using Google.

The court rendered its judgment: Nice (native) Franck Rouas and the Jackson family can officially launch the much awaited fragrance by fans. It will be produced in Grasse.

"We have rights!" Replica mythical film The Dinner Con, launched by Jacques Villeret, fits like a glove to the conclusion of the court case revolved around Michael Jackson perfumes. In the U.S., it would give This is It (It is!). Even better!

The three fragrances that make up the line will be officially launched Perfumes Jackson in February, around the world, by a Nice (native?), Franck Rouas, chosen by the Jackson family to create this perfume tribute to the late singer.

And the bottles come out of the factories of Grasse. 100% made of inCôte d'Azur for a breath of the King of Pop. The class. Already 20,000 bottles are ready and waiting in a hangar to be distributed in Sephora stores in Europe and Macy's in the United States.
The contractor, a native of Nice-Nord, finally sees the end of the tunnel after over a year of turmoil and judicial incredible story.

June 2011: the nightmare of Vegas
Las Vegas, Caesars Palace, June 2011. At the disco one of the most prestigious hotels in the city of sin, the great launch party of "Jackson's Tribute" for men and "Legend" for women fiasco.

Michael's father, Joe Jackson receives a lawsuit the company Bravado, before an audience of celebrities. Bravado, the merchandising giant artist in the United States is indeed commercial rights holder for the name of Michael Jackson. The company had filed a complaint on the grounds that Franck Rouas and the father of the singer were "unlicensed distributors business," thereby illegally using the brand.

50% for Jackson
"The Jackson family did not want to take the risk to follow me. They were waiting to know if I won or not, "says Franck Rouas, who embarks on the battle by throwing his last savings.

The verdict was delivered on 8 November in favor of Nice (native). "Nobody believed in and, frankly, I do not either. This is David against Goliath! "Launched it yesterday afternoon, and very proud to once again supported by the whole family, which will obviously share, or 50% of sales.

Fragrances evoking the Neverland gardens, home of singer died, are in his hands. He can now conquer the world.

Julian Rouas Paris, Makers of the Jackson Family Fragrances, Wins Settlement against Bravado International
Julian Rouas Paris, the makers of Jackson Family Fragrances, wins settlement against Bravado International. This now allows for distribution and marketing of the Jackson Family fragrance lines.
JRP Perfumes - a fragrance for every moment Las Vegas, Nevada (PRWEB) December 04, 2012

Franck Rouas, President of International Perfume Company Julian Rouas Paris(JRP) is pleased to announce that on November 8, 2012, a favorable settlement was awarded to Julian Rouas Paris in collaboration with the Jackson Family Foundation. The case by Bravado International has been dismissed in Federal Court in Los Angeles, California.

This success now allows for sale, and world-wide distribution of the Julian Rouas Paris Jackson Fragrance line which includes the labels:
1. Tribute
2. Legacy
3. Legend

Consumers may now purchase the fragrance online immediately at JRP's website

With the approval of the Jackson Family Foundation, Julian Rouas Paris can now develop and market fragrances nationally, and internationally. Part of the proceeds will go to charities favored by Michael Jackson.

In December 2010, Joe Jackson and Frank Julian Rouas, owner and founder of Julian Rouas Paris Inc., signed a contract for seven years to release the very first Jackson Family cologne and perfume. JRP is currently in negotiations with several international licensing companies and distributors to bring the JRP-Jackson fragrances to North American, European and Asian markets. "I've launched many 'celebrity' perfumes through the years, but this one holds special significance because it's a personal tribute to Michael from his father Joe," remarks Rouas, who actually broke into the perfume industry after aspiring to create a fragrance in memory of his grandmother. "Conceptually, each ingredient is inspired by Michael's story. Collaborating closely with Joe, we strived to craft an essence that sincerely captured the beauty Michael brought to the world and the beauty Michael saw in the world."

JRP-Jackson's "Legend": floral harmony of California lilac, jasmine and rose of Grasse, with a hint of mandarin and bergamot essential oils from Italy; fruity note stems from raspberry; supported with a musky base note, slightly vanilla yet heavily wooded with tonka bean and sandalwood.

JRP-Jackson's "Tribute": sparkling blend of mandarin, lemon and bergamot essential oils from Italy with drops of baiser rose wrapped in a woody heart of Canadian pine; supported with rose and jasmine of Grasse; strengthened with French lavender and American cedar; base note is heavily musky, vanilla and woody, with patchouli essential oils and labdanum absolute.

Potential distributors may contact Julian Rouas Paris at their website, in order to learn more about qualifications and guidelines.

^^Now I am back to my confused state, which has been happening a lot to me around her lately. What exactly did this guy win? Which fans are waiting for this? We need to clarify this because Rouas is making statements that may mislead fans.

Something is not making sense here. I may have to do with the translation or could it be that the estate thru Bravado gave the ok for the use of Michael's name & image? How I wish they can never be able to touch anything related to Michael.

^^ Yes something is not making sense. I see the bottle has a Michael photo on it, so did Bravado give him permission to use that. He claims he won, but won what? Now he is walking around with 3 bottles of questionable perfume, and if Papa Joe could not sell them in Vegas, how does he think he will be able to do so? More fans know about Papa Joe than about Rouas. Maybe sales will come from people in France.

PS: How about the last part of the article "he can now conquer the world." This is too funny!!!!

He is holding Michael's memorial booklet in his hands, not hard to guess where did he get it.
Most likely from family member that receives 50% of the profits.

Ha so true Bubs, because we all know Rouas was not at the memorial, and although back in 09 you could get those, I doubt Rouas was a fan looking for those booklets. This perfume may be a family & Rouas venture which is even more reason to stay awaaaaay from it. I wonder which family members have a stake in this scented water.

Personally if you are selling perfume that you made, it is best to look less scruffy. It is like someone selling you cakes they made and they look very untidy & dirty. You wonder what is in the cakes.....

Not necessarily....if you are looking for a perfume to cover up a bad smell, that might be quite a good advertisement.... :) ;)

Oh, you have a point there!!!!

I wonder what Joe will say about this. Does he know his former partner is now selling the perfume he could not sell in Vegas?

as you know the parties have said they reached a settlement but they are yet to file the dismissal of the lawsuit. This friday Bravado's lawyers asked for an extension until January 28.

They said "defendants (Rouas) signed the settlement agreement but made a change that was unacceptable to the plaintiff (bravado) and was not consistent with the agreement reached at settlement conference"

so it seems Rouas is still after some monkey business.

They say Rouas will sign the settlement agreement without changes soon. We will see.

^^Do they know Rouas is running to papers saying he won the lawsuit and is selling the perfume. Hopefully it is only Jackson perfume and has nothing to do with Michael.

I don't know if they are aware of what Rouas is doing.

^^Ok. I wonder if Joe knows about it & how he feels after he claims his advisors told him to pull out.

Rouas is a huge liar.

According to the settlement

- Rouas cannot use Michael Jackson name
- Rouas cannot use Michael Jackson likeliness
- Rouas cannot use Michael Jackson trademarks including but not limited to King of Pop as well as the names Jackson Legacy, Jackson Tribute, Jackson Legend.
- Rouas cannot imply that Michael Jackson has any association with the perfumes.

- Above limitations does not prevent Rouas from using Joe Jackson and Jackson family's name and likeliness.
- Above limitations does not prevent Rouas from using Joe Jackson Legend or Jackson Family Legend, Joe Jackson Tribute or Jackson Family Tribute, Joe Jackson Legacy or Jackson Family Legacy names.

- Rouas agreed to pay confidential amount of money to Bravado.
- Each party is paying their own legal expenses.

ps: It turns out the only part of the settlement that's confidential is the money amount.

^^That no good, lying, so & so. There he went running to papers with a bunch of lies. Let him sell the Jackson ones then, but now that Joe is not interested I do not know what will become of this business failure. Rouas should simply give away the perfume to people who want to spray it in their homes.

I wonder what he is going to be selling if he cannot use MJ in anyway in his stinky business, and Joe resigned working with him? He cannot be that stupid that he start marketing perfumes with Joe's face on the bottle?

Thanks ivy.

I figured that fool was only blowing smoke. I mean, I just couldn't see a huge operation like Bravado wanting to do business with that little greasy perfume salesman. In all seriousness, why would they even want to work with him. No reason I could think of.

Anyway he is free to proceed with Joe Jackson's name, or the name of the Jackson Family in it's entirety. So all is not lost. I'm sure there are hundreds of people who would just love to spray a little bit of "Joe Jackson perfume" behind their ears before they start their day. LOL!

Normally given that he can't use anything in regards to Michael Jackson and given that Joe Jackson decided to not work with anymore, you would expect to see that these perfumes line to be over and go away for good.

However given Rouas's questionable past and given that he tried to change the settlement, I wouldn't be surprised if he tries to sell these perfumes or similar ones - even unauthorized by Joe Jackson - in France.

I bet Joe will have a fit if Rouas tries to sell the perfume using Joe's name.

All French & European fans better beware of the Rouas Jackson perfume coming to their area soon.
