Jackson's Auction Property Still in Limbo

The auction items Michael Jackson fought to have returned to him before he died are still not in his estate's possession ... and it's all because MJ's former manager won't let the auction house give the stuff back.



The drama began back in May, when Julien's Auction House filed documents saying they couldn't return the property to Michael because someone else was trying to claim it too: Dr. Tohme Tohme.

In new documents filed by Julien's, they say Dr. Tohme² still hasn't signed release papers for the property -- which is the final step in returning Michael's stuff to its rightful owner.

We spoke to Jerry Hawxhurst -- a lawyer for Julien's -- who said Tohme has had the papers for nearly a month. Jerry said if Tohme doesn't sign the papers within the next few weeks, he'll have to take MJ's estate and Tohme to court.

Jerry said this would be "completely unnecessary" and a waste of time and money.

Jackson Homicide--Focus Only on Dr. Murray

Law enforcement sources tell TMZ the only person the LAPD is focusing on in Michael Jackson's homicide investigation is Dr. Conrad Murray.

TMZ has been reporting for weeks that other Jackson docs have been scrutinized by law enforcement and the L.A. County Coroner's office. Sources say, however, Dr. Murray is the only person in their crosshairs in the homicide investigation.

As for the other docs who prescribed to Michael Jackson, they are by no means in the clear. There is an active investigation on several fronts for fraudulent prescription practices as well as prescribing to an addict.

Michael Jackson -- Rolls Out

Three of Michael Jackson's priciest possessions were removed from his Las Vegas home yesterday: A trio of Rolls Royces.
We hear the expensive whips were meant to be wedding presents for Michael's three children someday -- but none of the Rolls we spotted looked as if they'd been driven recently.

All the items removed from Jackson's home were moved to an L.A. storage facility -- some will be used for an upcoming memorabilia tour.
 
Gladys Knight to Sing at Michael's Funeral

We've learned there will be a special guest singing at Michael Jackson's burial tomorrow night: Gladys Knight.

Knight's rep confirmed the singer -- who knew Michael when he was little and once shared the same manager with him -- will perform at tomorrow's service.

The service will take place at Glendale Forest Lawn Memorial Park in Glendale, CA.
 
Macaulay Culkin Plans to Attend MJ's Funeral

TMZ has learned Macaulay Culkin has made plans to attend Michael Jackson's funeral tonight in Glendale.

Sources close to the situation tell us Culkin -- who became pretty close with Michael after starring in "Home Alone" in the early 90's -- has made arrangements to be at Glendale Forest Lawn Memorial Park for the burial.

Macaulay Culkin's press agent Michelle Bega tells us, "I can confirm Macaulay Culkin was invited, but I cannot confirm whether or not he is attending the memorial service this evening."

The funeral is set to begin around 7:00 PM PT.
 
MJ Burial After-Party -- Brought to You By A&E

Michael JacksonThere were cameras shooting everything at the after-party for Michael Jackson's burial -- and we're told the whole thing could end up on A&E.

Sources tell TMZ footage from inside the party -- as well as the funeral itself -- will be used for an A&E special, plus a DVD at a later date.

Don't expect to see Joe or Katherine Jackson, Michael's three children or Elizabeth Taylor in the footage though -- we're told none of them went to the restaurant after the burial.

A few other random tidbits about the affair: Rat Pack music played all night, "Casablanca" was projected onto the walls, the brothers talked about a reunion tour -- and Janet seemed the most grief stricken of the group.

Randy Jackson: Don't Air Footage of MJ's Funeral

Randy Jackson is furious footage of Michael's funeral at Forest Lawn is being broadcast all over the world, saying it was a private event and not meant for the public to see.

Jackson just released a scathing statement condemning those who violated the no-fly zone over Forest Lawn last night -- and asking all media organizations to refrain from airing footage of the event.

Here's Randy's full statement:

"As a family, we are all aware of how Michael's life, and his death, touched so many around the world. It is why we held a public memorial in my brother's honor.

And it is the reason we chose to release a small amount of footage leading up to yesterday's ceremony at Forest Lawn.

I was dismayed last night and again today at the coverage I saw on television of our ceremony for Michael. We had asked the media to respect the privacy and the sanctity of this event; to give us one moment of privacy to mourn as a family out of the public spotlight.

Unfortunately, despite a no-fly zone around Forest Lawn, many media organizations decided to ignore our wishes. They employed helicopters that not only surreptitiously recorded our private family ceremony, but also severely disrupted it.

I therefore ask today that media organizations airing helicopter footage of the ceremony we held for my brother immediately pull that footage from their air and refrain from airing it in the future."

Katherine to Jermaine: The Show Must Not Go On

Katherine Jackson and other members of her family are angry at Jermaine over the Michael Jackson tribute concert in Vienna -- this according to various sources.

Members of the Jackson family along with others connected with the event claim Katherine was badgered into announcing her support of the September 26 event. The sources say Jermaine was complaining to his mom about all the bad press he was receiving and repeatedly asked her to support the Vienna event.

Our sources say other than Jermaine none of the other family members will be going to Vienna for the concert.

The sources say the family thinks it makes no sense to hold the first tribute event in a country that has no special connection to Michael Jackson.

One family member says it's another example of Jermaine doing what's best for Jermaine, regardless of what the rest of the family wants. The family member scoffed at the event, calling it "The Jermaine Jackson show."

Michael Jackson's kids won't be attending a swanky school in Los Angeles after all -- the family has decided to keep them enrolled at the one learning facility they are very familiar with ... home.



A source extremely close to the situation tells us the decision was made not to enroll Michael Jr., Paris, and Prince at the Buckley School -- where Tito's three kids attended -- so they could continue being home schooled by the same tutors they had under Michael's supervision.

The only difference -- their home is now the Jackson's place in Encino, not Michael's place in Holmby Hills.

We're told the Jackson family is pulling out all the stops to recreate a "normal" school environment -- they're even building a school yard, complete with a volleyball court, so the kids can enjoy P.E. time. The kids will also go on field trips and have a designated "lunch hour" in between classes.
 
Jacksons -- Problems With Wrongful Death Suit

Various members of Michael Jackson's family tell TMZ they are already talking about lawyers who might rep them in a wrongful death lawsuit against Dr. Conrad Murray and others ... but Jackson's death may prove to be such an economic bonanza that it could torpedo a lawsuit.

In California, Jackson's immediate family could sue for the economic loss they have suffered by Jackson's death -- e.g., the financial support Jackson could have provided had he lived. Here's the problem -- Jackson's death may actually be an economic gain. It's already becoming clear Michael Jackson is more profitable in death than he was in the last years of his life. Therefore, even if lawyers proved Dr. Murray and others were responsible for Jackson's death ... they could still come up with goose eggs.

The family could also recover for non-economic damages such as loss of companionship and love. The problem -- in California, if the lawsuit is based on malpractice against a medical provider, these damages would be limited to $250,000 total.

The final possibility -- if the family could prove the defendants acted with malice, they could get punitive damages. "Malice" includes proof of "despicable conduct." The family could also win punitive damages if the defendant is convicted of felony homicide. But in California, punitive damages have to bear some relationship to damages for economic or non-economic losses. Typically punitives are limited to nine times those damages.

It ain't as easy as it seems.

Jackson Family Upset Over MJ Charities

Michael Jackson
's family is upset over the charities that are supposed to get 20% of Michael's estate -- that's what family sources tell TMZ.

Here's the deal -- the family's concern is premature. No charities have been picked yet and no money will be donated for somewhere between 1 and 2 years.

Under the terms of the trust, Michael gave charities 20% of the value of his estate. Problem is -- no one knows how much the estate is worth and until it's determined, no money will go to any charity.

The creditor's claims are still being filed and we're told it will take between 1 and 2 years for the state and the probate judge to settle the creditor's claims and determine the net value of the estate.

As for who decides which charities get the 20% -- we've learned the trust provides for a committee of three people who will make that decision -- Katherine Jackson and co-executors John Branca and John McClain.

The trust doesn't specify how decisions are made if the committee is divided. It could be majority rule, it could be that each committee member gets to pick a certain number of charities or they could set other ground rules.

Go figure -- Michael Jackson didn't account for the possibility that people in his world might disagree.

Neverland Owners Make Trademark Move

The company that owns Neverland Ranch hasn't gotten permission to turn Michael Jackson's old stomping grounds into a tourist attraction -- but they just filed a bunch of trademarks with the U.S. Patent Office just in case they do.

We just got our hands on trademark [COLOR=#29A256 ! important][COLOR=#29A256 ! important]applications[/COLOR][/COLOR] filed by the Sycamore Valley Ranch Company -- a company started by Colony Capital and Michael Jackson -- who is attempting to lock down the following names to use with the property: Neverland Ranch, Neverland Valley, Neverland Valley Ranch, and Neverland.

Sycamore also filed paperwork requesting to use the four Neverland names on several products and services including:

1) "Museum services - namely opening a museum in Michael Jackson's former home and providing tours ... providing theme park services."

2) Printed material (post cards, [COLOR=#29A256 ! important][COLOR=#29A256 ! important]greeting [COLOR=#29A256 ! important]cards[/COLOR][/COLOR][/COLOR], bags, non-fiction books about Michael Jackson, etc.)

3) Games and playthings (toys, dolls, roller skates, toy rockets, board games, playing cards, etc.)

4) For "providing facilities for business meetings and conferences ... retail and online retail store services ... mail order catalog services in the field of novelty, gift, and souvenir items"

5) Clothing, footwear, headgear

But don't get too excited yet -- we spoke with several members of the Jackson family who claim they were never asked permission by SVRC. In fact, Joe Jackson made it very clear, "Colony Capital cannot do this without our permission."

Neverland Trademarks Don't Pan Out

Efforts to turn Neverland Ranch into a tourist attraction just took one giant step backwards.

We've learned Paul Fuhrman -- the senior vice president of Colony Capital -- filed paperworkon Wednesday asking the U.S. Patent Office to forget about the Neverland trademark applications his company filed last month. The request was granted that day.

Colony had filed the trademark applications in case Neverland was turned into a Graceland-esque tourist attraction for Jackson fans.

Doesn't look like that's going to happen any time soon.
 
La Toya Still Thinks Michael Was Murdered

The coroner says the death of Michael Jackson was a homicide, but La Toya Jackson is still calling it murder

La Toya was on "20/20" last night with Barbara Walters, where she once again asserted that Michael was murdered by people who would benefit financially from his death, but she doesn't know exactly who.

Dr. Conrad Murray, who administered the drug that resulted in Jackson's death, is the only person the LAPD is focusing on in their investigation.

MJ's Kids Watch Private Screening of 'Captain EO'

Michael Jackson's kids just got to do something no Regular Joe has done since 1998 -- they saw Michael's 17-minute, 3-D film "Captain EO" at Disneyland.

Sources say Michael Jr., Paris and Prince were taken to the happiest place on Earth (the one in California) last Thursday by Michael's brother Jackie. While they were there, we're told the kids were shown a screening of "Captain EO" -- which the Mouse stopped playing in 1998 -- and "they loved" it.

According to Disney blog MiceAge.com, the kids were able to see the movie because on Tuesday, the "Honey I Shrunk the Audience show was quietly closed, and Imagineers moved in with a truckload of equipment used to install the Captain EO show for a special executive presentation."

The blog says "Honey" was up and running again by Saturday -- so you'll just have to catch "EO" on YouTube like the rest of us.

Jackson Probe Coming in for a Landing

Law enforcement sources tell TMZ the Michael Jackson homicide case will be presented to the L.A. County District Attorney in 3 to 4 weeks.

We're told the lion's share of the investigation has been completed and Dr. Conrad Murray remains the singular target. Our sources say LAPD detectives have requested opinions from several medical experts who will analyze the evidence and offer their opinions on Dr. Murray's conduct.

The medical experts are supposed to submit their finding in 2 to 3 weeks and we're told detectives need an additional week to assemble their evidence before they make a formal presentation to the D.A.

Law enforcement sources also say an arrest will not be made before Dr. Murray is charged with a crime -- of course that assumes he will be charged.

The case is complicated by the fact that Jackson had been taking various medications, even though the evidence is compelling that Propofol was the direct cause of Jackson's death.

Jackson's Mom and Kids Get a Bundle

Up to now we didn't know how much Katherine Jackson was getting by way of allowance while Michael Jackson's estate gets probated. In legal docs just unveiled today, we now know the special administrators asked to pay her $26,804 per month.

As for the kids, the family allowance for them is $60,000 per month.

The docs also say "...the Estate assets consist of real and personal property exceeding $500 million and that the Estate is solvent."

Katherine and Michael's 3 kids will continue to get an allowance -- which is subject to change -- until the estate is probated. That could take between 1 and 2 years from now.

UPDATE: The docs also list Katherine and the kids' expenses separately.

Now, the kids' expenses are redacted -- but it doesn't matter, because they are HUGE:

-- Salaries and payroll benefits: $315,580 per year
-- Basic needs: $141,300 per year
-- Entertainment and other: $159,120 per year
TOTAL: $720,000 per year

Katherine's expenses per month:

-- Assistant: $4,722
-- Insurance for Asst: $475
-- Housekeeper: $2,080

Jackson Estate Settles Music Suit

Lawyers for Michael Jackson's estate have asked the probate judge to give them the green light so they can settle a music lawsuit filed against the singer.

The suit was filed in federal court in Northern Illinois by Syl Johnson. Johnson claims Jackson and 11 other defendants unlawfully reproduced one of his recordings.

We've learned Jackson and the other defendants have settled for a total of $150,000 and Jackson will kick in his share -- $12,500 -- upon approval by the probate court.

The other defendants include Dr. Dre, Will Smith and the estate of Tupac Shakur.

Jackson Estate Sues Heal the World

Michael Jackson's estate has filed a lawsuit against the Heal the World Foundation.

The Special Administrators, John Branca and John McClain, have alleged in the suit the Foundation is using Jackson's name and likeness without permission.

According to the lawsuit the Foundation and other related entities have registered 6 trademarks and have applied with 41 additional ones, all suggesting a connection to Jackson.

The legal papers acknowledge Jackson founded his own Heal the World Foundation in 1992 but it has no connection to the defendants.

The suit alleges the defendants cybersquatted various domain names, including "mjaid.net," "healthworldfoundation.net," and "mjquotes.net."

Lawyers from MJ Molestation Case Want Money

MIchael jacksonAnother day, another creditor's claim filed against Michael Jackson's estate.

The law firm Mesereau & Yu -- who defended Michael during his molestation trial in 2005 -- filed a claim on Friday against the estate.

In the claim, it says Michael owes the firm $341,452.05 for work done between July of 2005 and February of 2006.

And well worth it ... Michael was acquitted on all 14 charges.

Michael Jackson -- Healthy Drug Addict

Michael Jackson was reportedly in good health at the time of his death ... other than the fact that his body was riddled with injection sites and had arthritis and lung damage.

It sounds preposterous, but a new report claims the autopsy findings conclude Jackson was a fairly healthy 50-year-old and none of his health issues were life-threatening.

What doesn't make sense: Jackson was taking multiple powerful medicines -- sometimes in dangerous combination -- and the needle marks on his body underscore his addiction to anesthetics and other drugs. So how does that make him "fairly healthy?"

According to the report, Jackson -- who was 5'9" -- weighed 136 pounds at the time of his death.

Here's the underlying point -- the conclusion that Jackson was "fairly healthy" gives prosecutors ammo to prove Dr. Murray's dose of Propofol did Jackson in. But here's the problem -- when the jury hears about the injection sites and other drug and health problems, it could cast doubt on the Coroner's findings.

More details on the Michael Jackson autopsy. According to a new report, Jackson had osteoarthritis which was visible on his lower spine and fingers.

He had dark tattoos on his eyebrows and around his eyes and a dark tattoo on the front of his scalp -- possibly to cover [COLOR=#29a256 !important][COLOR=#29a256 !important]bald [COLOR=#29a256 !important]spots[/COLOR][/COLOR][/COLOR].

The report says he was balding and suffered a skin disease. We've previously reported Jackson suffered from vitiligo.

His heart was strong but his lungs were inflamed.

The report says Jackson's stomach had no obvious signs of pills, nor were illegal drugs or alcohol detected.

The manner of death -- already reported to be a homicide -- was based in part on Propofol administered in a non-hospital setting.

Michael Jackson's good friend and doc Arnie Klein was formally shut down in court Friday, when the judge ruled he has no legal right to raise concerns about the welfare of Jackson's 3 kids.

You'll recall Dr. Klein's lawyer, Mark Vincent Kaplan, showed up in probate court early on and said his client had concerns about the kids.

According to court docs obtained by TMZ, the judge ruled Klein had no legal "standing" because there's a "conclusive presumption" Jackson and Debbie Rowe are the parents of the two older kids.

The court also found there is "no legal mother" of Prince Michael Jackson, II -- aka Blanket.

For several weeks, Michael Jackson's tomb at Forest Lawn Memorial Park was under maximum, 'round-the-clock security -- but TMZ has now learned the extra protection has been "scaled back."

Sources tell us the mausoleum that houses Jackson's body was being monitored by a private [COLOR=#29A256 ! important][COLOR=#29A256 ! important]security [COLOR=#29A256 ! important]firm[/COLOR][/COLOR][/COLOR], hired specifically to protect MJ's grave -- but as of last week, the extra protection was nowhere to be seen.

Sources at Forest Lawn confirm the security change, but insist Jackson's resting place will still be under the constant watch of their guards, 24-hour cameras, alarms, etc.

Reps at the cemetery also mentioned there hasn't been a single suspicious incident since Jackson moved into the neighborhood.

Jackson Investigation Wraps Up Next Week

TMZ has learned the LAPD is on schedule to present the case against Dr. Conrad Murray to the L.A. County D.A.'s office next week.

As we first reported LAPD detectives planned to wrap up their case and present it by the second week in October. They were waiting on some written evaluations by medical professionals who reviewed the evidence surrounding Michael Jackson's death.

Our law enforcement sources say the medical reports are in and the LAPD plans to formally present the case to the D.A. next week.

Prosecutors have been working with the LAPD for months now, so it's not as if the evidence will be a surprise.

Sources say Dr. Murray is still the sole target.

One well-placed law enforcement source says there's a "70/30 chance" the D.A. will take the case to the L.A. County Grand Jury rather than charge Murray directly.

As one source said, this could be a complicated case and a lengthy preliminary hearing wouldn't have a whole lot of upside for prosecutors. A grand jury indictment would be easy to get and it would avoid a prelim.

Jackson Kids Take on Canine Crusade

Here's a tug on the heartstrings: Michael Jackson'skids saw a sad, two-legged puppy on the news ... and now they're trying to raise money to buy it new mechanical legs.

According to sources close to the family, Jackson's oldest son Prince and daughter Paris saw the dog -- a puppy named Scooby-Roo -- on the news recently -- and were so moved they decided to help raise the $2,000 necessary to buy it a custom-made cart to help it walk.

We don't know how close they are to their goal -- but seeing as they're the most famous kids on the planet, we're guessing it won't take them too long to reach it.
