The following presents a timeline and brief summary about court hearings, news stories and developments regarding to State of California v's Dr Conrad Murray. All the related threads for the discussion is also provided. Use this thread for a quick summary and and reference.

February 8 2010

Dr. Conrad Murray is arraigned and pleads not guilty to involuntary manslaughter charges in the death of Michael Jackson. His bail is set at $75,000. The judge rules as a condition to bail, Murray cannot be in possession of (or prescribe) anesthetics and specifically mentioned Propofol. The next court date is determined to be April 5th.

Joe, Katherine, Jermaine, LaToya, Jackie, Tito, Randy, Rebbie and Austin attended the hearing.

California medical board announces the changes to Murray's medical license. They also state that they plan to seek the suspension of Murray's medical license.

March 1, 2010

TMZ reports that the investigators believe that Dr. Murray may have tried to cover up the fatal dose of propofol. They state that the amount that Dr. Murray told the cops that he gave to Michael Jackson versus the amount of propofol in Michael's system does not match up. They also report that there was an empty bottle of propofol with a tear in the stopper in a hidden compartment in a closet.

TMZ reports that Murray's defense says that they aren't receiving documents related to the case from the DA's office. DA's office responds back saying that they are sending the documents as soon as they are processed.

TMZ reports that Michael Jackson's bodyguard Alberto Alvarez told investigators that Conrad Murray interrupted CPR to collect and hid propofol bottles.

Attorney General Jerry Brown on the behalf of Medical Board of California files documents asking Los Angeles Superior Court to prevent Dr. Murray practicing medicine in California until the criminal proceedings against him are completed.

Joe Jackson files for wrongful death lawsuit. In the documents that he has filed it is stated that a weak pulse was able to be triggered by the emergency efforts but it could not be sustained. In the lawsuit Joe argues that Michael Jackson could have been saved if Murray called the paramedics sooner and told them about the propofol.

TMZ reports that Michael Jackson's bodyguard Alberto Alvarez is fired by the Jackson family. Although it has been rumored that his past was the reason for the firing, there hasn't been an official statement.


April 1, 2010

Dr. Murray's defense files documents to respond to Attorney General's motion to suspend Murray's medical licence. They state that Dr. Murray need to be able to work and earn an income to be able to pay for his defense.


April 4, 2010

TMZ reports that a possible defense strategy will be that Michael Jackson gave himself the fatal dose of propofol. Defense denies this story saying that they aren't talking to TMZ.

TMZ reports Michael Jackson consumed a lot of Coca Cola and hyped himself up with caffeine and later used propofol and other medicines to sleep.

Judge Michael Pastor is assigned as the trial judge. The next hearing date is set to June 14th. Judge did not make a decision in regards to Murray's medical license.

Katherine, Joe, Jermaine, Randy and Janet attended the court hearing. Murray enters the courthouse from back entrance to avoid fans and media. Judge Pastor does not allow cameras into the courtroom.

Ed Chernoff (Defense lawyer for Murray) gives a brief interview to Good Morning America saying that Murray is innocent and all the claims that he delayed to call the paramedics and hid propofol bottles are lies. Futhermore Chernoff claims that police rushed to blame Murray due to pressure from public. His statements also include that Dr. Murray did not know what Michael Jackson doing in his own time and although they do not plan to convey Michael Jackson in a bad light, the facts will have to come out. http://www.mjjcommunity.com/forum/showthread.php?t=89985

TMZ reports that Murray will not plead to involuntary manslaughter or any other charge (in other words he will not take a plea bargain) as he's adamant that he's innocent. However TMZ states that Murray is afraid that the medical boards can pull his licence.

TMZ reports that Dr. Murray found Michael Jackson eyes open and pupils dilated. They state this could be a possible defense strategy/evidence that Michael woke up and injected himself (and therefore his eyes were open when he died).

TMZ reports a strong stimulant (a combination of ephedrine, caffeine and aspirin) found in Michael Jackson's house could be the reason why he had trouble sleeping.

Murray enters into an Agreed Order of Restriction with Texas Medical Board that prohibits Murray from "using or administering any anesthetic agent that is normally administered by an anesthesiologist, including Propofol or any other heavy sedatives; or prescribing or administering any form of general sedation to a patient". The order also prohibits Dr. Murray from "supervising or delegating prescriptive authority to physician assistants and other physician extenders."

Dr. Murray is still allowed to prescribe or use pain medication, anti-anxiety medication or local or topical anesthetics, based on the order.As long as Dr. Murray does not personally administer or prescribe general anesthetic, such as Propofol, he is still allowed to be part of a medical team that provides such anesthetics.

TMZ reports that Conrad Murray hired Charles Teckham, who handles medical board cases and wrongful death lawsuits to represent him against the civil wrongful death suit that has been filed by Joe Jackson. Sources close to defense state that they expect Dr. Murray's malpractice insurance to pay for the wrongful death suit claims.

Nevada Medical Board tries to suspend Dr. Murray's medical licence saying that he lied on the renewal application about child support payments. (Renewal form asks if the applicant is paying court ordered child support on time. Murray on the form said he did but in reality he was late in paying child support). Court postponed to make a decision until they get the results of May 27 Child Support hearing. The next hearing about Murray's Neveda Medical Licence will be held at June 25th.

June 9, 2010

California Medical Board renews their motion and once again files documents last week in L.A. County Superior Court, claiming those restrictions on Dr. Murray's licence are "insufficient under the circumstances of this defendant's behavior." The Board is requesting an order that Murray, "cease and desist from the practice of medicine" until his criminal trial regarding MJ's death reaches a conclusion stating states, "It is not just his 'prescribing' practices that are in question, but his fundamental judgment and skill as a physician."

June 10, 2010

Nevada Medical Board places a restriction on Dr. Murray's licence stating that he cannot prescribe or administer any anesthetic agent normally administered by an anesthesiologist ... and that includes Propofol. Dr. Murray can continue to prescribe pain and anti-anxiety meds.

Murray's defense team files legal docs opposing the A.G.'s renewed attempt to suspend the doc's medical privileges while he awaits trial for the death of Michael Jackson.

June 14, 2010

Attorney General Brown asked Judge Pastor to revoke Dr. Murray's medical licence. Murray's defense team brought up the plane incident where Dr. Murray helped a patient, adding that there's no need to suspend his licence. Judge Pastor didn't suspend Dr. Murray's medical license refused to overturn the decision made by the last judge to hear the case Judge Pastor said "I don't have ability to revisit the actions of one of my colleagues. I do not have jurisdiction to revisit this matter. It doesn't have anything to do with how I feel or what I think. It has to do with the law and this court's ability to follow the law".

A short hearing happens on August 23rd. The prosecutor is arguing there have been issues with witness availability. The judge sets preliminary hearing date for January 4, 2011. Also Murray is due back in court on Oct. 26 for another status hearing.

Murray's defense team reportedly asked for access to three fluids collected by the coroner's office, including ones taken from syringes and an IV tube to re-examine test results. Pastor ruled that the coroner's office must preserve the samples, and if defense attorneys and prosecutors cannot agree on the request, he will schedule a hearing on the matter.

January 4 , 2011 Preliminary Hearing Day 1

- Katherine, Latoya and Jackie Jackson attends the hearing.

- After opening statement from the DA, Kenny Ortega, Michael Amir Williams and Faheen Muhammad testifies.

- Below are the summary of their testimonies as reported by the media

Prosecutor David Walgren opening statement

- Walgren on his opening statement mentions that MJ was already dead by time Murray called for help, Murray hid the fact that he have propofol to MJ, Murray didn't do proper CPR (performing CPR on Jackson with one hand on his bed, rather than a hard surface as is generally required.)and that he asked a bodyguard (Alberto Alverez) to hid evidence.

- "The evidence will show through the expert testimony, by all accounts, Michael Jackson was dead in the bedroom at 100 North Carrolwood prior to the paramedics arriving," Walgren said.

- Walgren said evidence will show Murray waited up to21 minutes to call 911 and ordered a bodyguard to help him clean up evidence before summoning help. In the most favorable interpretation, Walgren said, Murray waited at least nine minutes before calling paramedics.

The following is the timeline of events as presented by Walgren

- 1:30am Court learned through evidence that Murray began treatment
- 2:00am valium pill administered
- 3:00am Intravenous diazebeem, IV of benzso
- 5:00am other treatment
- 7:30am other drugs through IV
- 10:40-11am infusing with propofol..at some point he ceases to breathe and dies after that
- MJ dead before paramedics arrived
- Only 2 pepople in room at the time— MJ and Dr. Murray
- 11:51am call- lasted 11 mins..witness heard noises at other end of phone. Likely Conrad Murray who realized MJ was not breathing.
- 12:12pm Call by Murray to Michael Amir Williams, security, saying he needs help..left a message.
- 12:15pm Williams returns call and Murray says MJ had a bad reaction. Williams calls another member of security who is not at house.
- 12:17pm Williams then calls Alberto Alvarez who is in second trailer outside house, checks permission to go in house, goes upstairs to MJ’s bedroom.
- He Sees MJ on bed, Murray doing one handed CPR on the soft bed.
- Murray reports MJ had a bad reaction and asks Alvarez to collect medical evidence.
- Prosecution says Murray has still not called 911 at this point.
- 12:21pm Alvarez told to get a bag and Murray collects medical bottles, and IV bag etc., as told and only then is he told to call 911.
- Possible that Murray waited 20 minutes to call 911...MJ could have been dead before noon.
- 12:26pm Paramedics treating MJ on site. MJ’s Eyes fixed and dilated and he was cool to touch. He flatlined so heart action taking place. MJ dead...no observation of appropriate equipment for treatment with propofol, according to paramedics.
- Asked Murray about underlying medical condition. Asked Murray what drugs he had given...doesn't mention propofol
- Prosecutors says this could have been useful.
- UCLA medical center advised futher care on MJ useless..they in contact with paramedics.
- 1:07pm Paramedics transport to UCLA with MJ
- 1:13pm Arrive in ER room.
- Doctors at hospital only asked Murray what he treating MJ for. Mentioned on drug, valium and flomax..no mention of propofol to UCLA doctors.
- Doctors still tried to bring MJ to life.
- 2:26pm Dr. Cooper at UCLA pronounced MJ dead.
- Murray had conversation with security personnel at hospital.
- Detectives question Murray next day and then learned of propofol.

Murray's attorney, Ed Chernoff, declined to give an opening statement.

Kenny Ortega testimony

- Ortega mentions that on June 19th Micheal didn't seem well.

- "He didn't look well at all," Ortega testified. "Michael was chilled and soft-spoken. ... He wasn't in the kind of condition to be at rehearsal." Ortega also said Jackson appeared lost.

- "It was scary. I couldn't put my finger on it," Ortega said. "I said, 'Michael, is this the best place for you to be or do you want to go home and be with your family?' He said, 'Would you be OK with that?' I said, 'OK,' and he left."

- Ortega say on June 20th he's called to a meeting at MJ's house. He says MJ, Murray, Frank Dileo and Randy Phillips was present at this meeting.

- Ortega says ""It quickly became clear that the meeting was about me, Dr. Murray was upset that I had sent Michael home the night before and didn't allow him to rehearse."

- Ortega says Dr. Murray scolded him and said "Dr. Murray told me that this was not my responsibility and he asked me not to act like a doctor or psychologist ... and leave Michael’s health to him" . Ortega also mentions Murray suggested Jackson should not have been sent home because he was physically and emotionally fine.

- Ortega recalls what MJ told him by saying "I know you love me and care about me. You don't have to worry about me. I'm fine,' and he gave me a big hug,".

- When cross examined by defense lawyers Ortega says he never seen anyone going through drug withdrawals, denies discussing MJ's health with Karen Faye. He also denies "riot act" and yelling to Michael saying "it was an emotional meeting but there was no yelling"

Michael Amir Williams testimony

- Michael Amir tells that he received a frantic call from Murray saying MJ had a "bad reaction" and that immediate help was needed, but that the doctor didn't ask him to call 911. Murray also tells Williams to get the house right away.

- Williams says he then called Alberto Alvarez, MJ's security guard, and asked Alvarez to walk to the front door. Williams says he heard Murray's voice in the background, then Alvarez hung up.

- Williams said he arrived at the house when the ambulance was already there and helped put the children in a car to follow the ambulance.

- Williams said Dr. Murray in the hospital approached him and said ”Brother Michael, Mr. Jackson has some cream in the house that I knew he wouldn’t want the world to know about". He added "It was an odd question, to ask to go to the house to get the cream.”

- Williams testified that he told Murray he didn’t have a key to the house when in fact he did. He says he called the house and ordered that it be put on lock down and not to let anyone in.

- Williams said that Frank Dileo, Murray and him went to tell MJ's kids that their father was dead. He said that Frank Dileo said "Your daddy had a heart attack and died" to MJ's kids.

- His voice faltered as he recalled how the children, still thinking their father was alive, began listing his allergies for the doctors. “It was horrible,” he said.

- Williams said Murray said he was going to get something to eat and left the hospital.

- In cross examination by Murray's lawyers Williams connection to the Nation of Islam,other phone calls he made in the minutes after Murray’s call is questioned. He also asked the personal assistant how frequently he went upstairs to Jackson’s bedroom, and whether his fingerprints may be found on vials, intravenous bags or syringes. Williams denied this saying "I never touched any of that".


Faheem Muhammad testimony

- Faheem testifies to be in the room when Murray was administrating CPR.

- Jackson was lying with his eyes and mouth open, appearing not to be alive, testified Faheem Muhammad. “I recall him being in a sort of panic state, and I recall him shortly after asking if anyone in the room knew CPR,” Muhammad testified.

- Muhammad said " I knew Dr. Murray was a heart surgeon, so I looked at Alberto [Alvarez] kind of shocked,” he said. Alvarez eventually began helping Murray administer CPR, Muhammad testified.

- Muhammad also testified MJ's kids Prince and Paris being just outside the door and Paris crying on her hands and knees. He says the left the room to whisk two of Jackson’s children, Paris and Prince, away from the foyer at the front of the room to keep them from the commotion.

- Muhammad also testified that less than an hour after the singer had been declared dead, the doctor approached him, saying he was hungry and wanted to get something to eat, and abruptly left the hospital soon afterward.

- In cross examination Muhammad said Murray spoke with MJ's family and police before leaving.

TMZ reported that Murray's baby mama Nicole Alvarez was present in court and was asked to come back later on Friday.
 
January 5 , 2011 Preliminary Hearing Day 2

- Janet, Latoya, Randy, Rebbie, Katherine and Joe Jackson attend the hearing.

- Alberto Alvarez, Kai Chase and first responder EMT Richard Senneff testifies.

Alberto Alvarez Testimony

- Alvarez says that he was the first one to walk into MJ's bedroom. He says when he walked in MJ was sprawled out on the bed with his eyes and mouth open, and Murray was administering chest compressions with one hand.

- The below is a part of his testimony
"Did it appear he was breathing," Walgren asked.
"No sir," Alvarez said.
"His eyes and mouth were open?" the prosecutor asked.
"Yes," the witness said.
"Did he seem to be alive or dead?" Walgren asked.
"Dead, sir," Alvarez said.

- Alvarez said that he was frozen by the sight.

- Alvarez asks "‘Dr. Murray, what happened?" and Murray tells him "He had a reaction. He had a bad reaction"

- Alvarez recalls MJ's kids Prince and Paris following him upstairs and Paris screaming "Daddy" and starting to cry.

- Murray says "Get them out. Don't let them see their father like this" to Alvarez.

- Alvarez says "I said, 'children, don't worry, we'll take care of him, please go outside.' And I escorted them out and left the door ajar,".

- After he escorted the children out of the room, Alvarez noticed the MJ’s penis was out of his underwear and tubing (condom catheter) was attached to it.

- "He just grabbed a handful of bottles, or vials, and he instructed me to put them in a bag," Alvarez testified, adding Murray also told him to place an intravenous bag into another sack. Alvarez said he grabbed a plastic bag from a chair and held it out as the doctor dropped the bottles inside, then put them in a brown canvas bag on the floor as Murray asked him to do. He also confirmed that 911 had not been called yet.

- Alvarez says that the I.V. bag had 'very little fluid' in it and that there was a 'white, milky substance' at the bottom of the I.V. bag.“I noticed that inside (the IV bag), there was like a bottle ... and then I noticed that at the bottom of the bag there was a milk-like substance,” Alvarez testified.

- Only after collecting the bottles, Murray tells Alvarez to call 911. He calls 911 in that call he tells the 911 operator that Jackson's private doctor was there, and she responded that he would be "the higher authority."

- Alvarez said he did not see any heart or blood pressure monitors in the room, but Murray clipped a monitoring device to Jackson’s finger after paramedics were called.

- When the operator said to transfer Jackson to the floor, Alvarez grabbed Jackson's legs and Murray grabbed his upper body. He said at that point he noticed the IV in Jackson's leg that had to be removed.

- On the floor Alvarez said, he did chest compressions while Murray gave the singer mouth-to-mouth resuscitation.“After the second time, he gave a breath, he came up and said, 'You know, this is the first time I give mouth to mouth, but I have to do it, he’s my friend,'" Alvarez said.

- Under cross examination Alvarez acknowledged he had not told police in two initial interviews that Murray had ordered him to remove potential evidence. Murray's attorney, Ed Chernoff, suggested to Alvarez on Wednesday that Murray could have intended to bring the medication to the hospital, or set it aside to make room for the paramedics. Below is a part of testimony :

“You didn’t think it was suspicious?” asked defense lawyer Ed Chernoff.
“Apparently not, sir,” Alvarez said.
“You thought he was packing up to go to the hospital, right?” the lawyer asked.
“Yes, sir,” Alvarez replied.

- In cross examination Alvarez was also asked about his relationship with Jackson family and his discussions with other staff members of MJ. Alvarez acknowledged that he had refused to speak to a defense investigator who had sought to interview him, but that in a police interview he had said he might sell his story to the media at a later date.

- Defense also tested Alvarez by asking him to confirm whether it was dark in MJ's room - suggesting his observations may be inaccurate.

- Press accounts describe Alvarez as being tearful during testimony.

Kai Chase Testimony

- Chase testifies that around 12:05 Murray comes down the stairwell and tells her "Get security, get Prince". She says she told Prince "something might be wrong with your dad".

- Chase testifies from Murray's behavior it was evident there was an emergency. She also testified that Murray didn't ask her to call 911.

- She also testified that Murray generally comes down around 10 AM to get the juice she prepared for MJ, she says in that morning Murray didn't come down.

- She mentions that MJ was on an extremely healthy diet, dining on seared ahi tuna salad for lunch the day before he died and that she found it odd that the Tuscan white bean soup she prepared for MJ and Murray the night before and left in the refrigerator for when they returned from rehearsals was untouched when she came to work next day (8:30am).

EMT Richard Senneff Testimony

- EMT Senneff testified that what Murray has told them didn't add up and he had a "gut feeling" Murray wasn't telling the truth.

- For example Senneff said when they asked Murray how long Jackson had been "down," the doctor said, "It just happened" but based on the MJ's dilated pupils, dry eyes and his skin, which was cold to the touch, Senneff believed Jackson may have been dead for more than 20 minutes. “All I can tell you is my gut feeling at the time was this did not just happen, it’s been a period of time,” Senneff testified.

- Senneff also testified that Murray told them Jackson had no underlying condition and was just being treated for dehydration, and that the only medication he had been given was the sedative lorazepam. He said even they repeatedly asked for what medications MJ was given, Murray never mentioned them propofol.

- Senneff testified when they initially came in they thought MJ to be a hospice patient (Senneff said he did not recognize Jackson) and frail as he looked pale, thin and had a IV stand and a personal doctor by his bedside. "I don't often see an IV pole and a doctor on hand," Senneff said. "The patient appeared to be pale and underweight, I was thinking along the lines that he was a hospice patient."

- Senneff testified that paramedics hooked MJ up to an EKG and he was flatline-his hands and feet ‘tinged blue’ and his pupils were fully dilated.

- Senneff testified that despite resuscitation efforts and three rounds of giving MJ epinephrine & atropine, paramedics did not feel a pulse on MJ and their attempts to revive MJ was unsuccessful. Senneff testified Conrad Murray was the only person who claimed to feel a pulse on MJ.

- Senneff testified that Murray refused to pronounce MJ dead on the scene.

- Senneff testified that at UCLA Murray was "spinning ... moving around, nervous, sweating, multitasking."

- In cross examination Murray's lawyers asks if the way MJ looked (thin, frail, black/bluish feet) could be signs of drug addict. Judge stops the question.

Kenny Ortega Testimony

- Kenny says around the time of MJ's death he was attending rehearsals 4 times a week, his schedule was to come late afternoon and he spent 6 hours maximum at rehearsals.

- Kenny says that he met Murray in April or May 09 (soon after Kenny started to work at TII), he was introduced to Murray by Michael at Michael's house.

- In the cross Kenny says he doubts even if TII was bad it would affect his reputation.

- Kenny says he doesn't know who called the June 20 meeting and says heads of AEG wasn't there. (We already know that the people at that meeting were MJ, Murray, Kenny Ortega, Frank Dileo and Randy Phillips)

- Karen Faye : This is the questions that defense asks Kenny : "Do you remember having a conversation with Karen Faye after the meeting? Do you remember telling Karen Faye of reading Michael the riot act? Do you remember telling Karen Faye not to placate Michael? Did you advise Karen Faye in any respect in regard to how to treat Michael after this meeting? Did you discuss with Karen Faye any thing regarding how she should treat Michael?" Kenny responds No or don't remember to this questions.

- Kenny says Michael missed a series of rehearsals (a week) in early June. He says this made him worried because everything needed Micheal's decision and/or approval and without it TII couldn't move forward.

- Kenny says on June 25th Michael was supposed to arrive to rehearsals around 4:00-4:30 PM.

(Kenny also mentions taking TII to international places (India and Japan) and Michael wanting to direct with Kenny after TII)


Michael Amir Williams testimony

- Williams say that at the house there were 2 security 24/7 to open the gate and screen everyone that comes in.

- Williams say that he met Murray in early 2008 in Las Vegas.

- Williams say that it was regular pattern for Murray to be at the house when they came from rehearsals and that he would stay the night.

- Williams say on June 24th Michael went to rehearsal around 6-7 PM , MJ was in great spirits and wanted to be there on time. He says the rehearsal ended past midnight. They drop Michael off as always and Williams went home.

- Williams say he was at his house when Murray called. Faheem had left MJ's house to go to the bank and Alberto Alvarez was at the front door.

- Williams say that no security/no staff was allowed upstairs perhaps with the exception of housekeeping to clean.

- Children's nanny is identified as "Rosalie"

- Williams say that he discussed Murray's request to go back to MJ's house with Faheem and decided to say "police have our car keys". He also says he called the security detail at the house and said "don't let anyone in, don't let anyone out".

- In cross examination member's of security's connection to Nation of Islam and "Security Measures" is questioned. He says the housekeepers and 3-4 of the security wasn't related to NOI.
 
January 6 , 2011 Preliminary Hearing Day 3

- EMT Richard Senneff, EMT Martin Blount, Harry Daliwal (AT&T), Jeff Strohn (Sprint Nextel), Dr. Richelle Cooper (UCLA), Dr. Thao Nguyen (UCLA) and Detective Dan Myers testifies.

EMT Richard Senneff Testimony

- Senneff testifies that Murray wanted to insert a central line and give magnesium to MJ. Senneff says the EMT's are not trained in central lines and do not have magnesium at hand.

- When Murray says he heard a pulse on MJ's femoral artery (on the leg close to groin), Senneff checks the monitor. DA in cross examination ask if this can be a "false" pulse (pulse happens during CPR compressions).

- Senneff said the singer did not respond to two rounds of drugs to revive him and hospital officials told him over the radio to “call” Jackson’s death, but that neither he nor Murray wanted to do so. “I said, 'Be advised, this is a very high-profile VIP,' ” Senneff said.

-Senneff said rescue workers had gone “above and beyond” the call of duty in the field not because Jackson was a celebrity, but “because it was someone’s son.”

- When they left the house a paparazzi puts a camera to the window of the ambulance and runs with the ambulance. “It just seemed wrong,” Senneff said. Murray requests that they cover MJ's face with a towel. Paramedics find this as a reasonable request.

- Senneff said that the ambulance driver had trouble navigating away from the residence because of a throng that included passengers of a tour bus and photographers with “big cameras, little cameras, video cameras, still cameras.”

- Senneff says again they never heard a pulse and in his opinion MJ went down between 20 minutes and a hour prior their arrival.

EMT Martin Blount Testimony

- Blount has 20 years experience, was the driver of the ambulance. He's the last of the paramedics in the room. He brings the gurney and other gear. He was by MJ's head.

- He inserts ET tube and gives air to MJ by pumping a hand pump. He sees an Oxygen tank and nasal canula (tubing that goes around the nose and connected to an Oxygen tank).

- Paramedics notice IV on MJ isn't working properly so they are looking for a new place to insert additional IV. They touch MJ's arms looking for a place and think that his body was "cool".

- Paramedics decide to stick the additional IV by the jugular, at that time they realize MJ's eyes were "blown" (fixed and dilated). Blount's opinion is that MJ was already dead. Blount said Murray told paramedics that MJ had passed out about a minute before 911 was called.

- Blount says at one time Murray showed them an hypodermic needle 24 gage which he calls strange as Murray told them he didn't give MJ anything. He also said that paramedics refused to use the needle. Also he sees bottles of lidocaine on the floor. He also calls "condom catheter" presence as odd.

- Blount says he saw Murray scoop up three bottles of lidocaine from the floor and place the vials in a bag during they are trying to revive MJ.

- Blount describes Murray as frantic and sweating profusely.

- Murray makes a phone call in the ambulance.

- In cross examination Murray's lawyers say that Blount actually told detectives that MJ's skin "not warm, not cool".

- Blount says one of the paramedics asked Murray if MJ was taking recreational drugs. Murray says no.

- Murray's defense mentions a paramedic tried 3 times to find a vein on MJ's arms and couldn't and asks if finding veins on drug addicts are hard? Blount gives an example of a known drug addict and being able to find a vein. Defense again asks if it could be difficult. Blount agrees.

Harry Daliwal (AT&T) Testimony

- AT&T employee for 15 years.(AT&T is the carrier for iPhone). 72 pages of cell records, phone, text, email and Internet records.

- Daliwal testifies there were 8 phone calls - 4 incoming, 4 outgoing - between the hours of 9:23 a.m. and 12:15 on June 25th on Murray cell.

- In the approximately five hours before Murray discovered MJ, he had 11 phone conversations on two different phones. Three back-to-back calls lasted 45 minutes just before Murray discovered MJ.

- According to testimony from a phone company representative, Murray sent or received five text messages on his iPhone in this period. His phone conversations on that phone and a Sprint cellphone included calls with his practice in Las Vegas, a clinic he runs in Houston, an employee and another doctor. All told, he spent close to an hour and a half on the phone in the five-hour period.

- The records also show the call from Murray to Michael Amir (MJ's personal assistant) and a two-minute call with his girlfriend, Nicole Alvarez, apparently made while Murray was riding in the back of an ambulance.

- Murray also sent two text messages just within a minute or two of the time when prosecutors believe he saw Jackson was stricken.

Dr. Richelle Cooper (UCLA) Testimony

- UCLA receives call from paramedics. They estimate time of cardiac arrest as 12:18 (this is an "estimated time" based on 911 call and information they receive). As the revival efforts produce no results Dr. Cooper gave the paramedics permission to pronounce MJ dead at 12:57. She was told that MJ personal doc wanted to continue with life saving efforts. Dr. Cooper told for the transport Murray had to take over the control and be with the patient.

- Dr. Cooper testifies MJ, Murray and emergency personnel got to the ER around 1:13 p.m.. When they come to the hospital Murray tells MJ wasn't ill only had trouble sleeping and dehydrated, gave him lorezapeam, witnessed the cardiac arrest. She's later asked what is "witnessing the arrest" means she says "seeing patient stop breathing".

- Dr. Cooper asks if there were any chest pain before cardiac arrest, Murray says no.

- Murray mentions Flomax and Valium.

- Dr. Cooper says MJ was DOA (no sign of life, pupils fixed and dilated, no pulse, no sign of trauma) still tried to revive him, they worked on MJ for 1 hour 26 minutes. She says she never felt or observed pulse on MJ.

- Dr. Cooper also asked Murray about recreational drug use. She says this is a common question as MJ came in with an unexplained cardiac arrest (they didn't know propofol).

- Dr. Cooper gets asked a lot of questions about propofol and it's usage (if she knows the drug, if she used it and such). Cooper says "Protocol requires certain monitoring to administer propofol. There needs to be equipment available to monitor the airway. There must be heart monitoring. There has to be a staff person available as their only job to monitor the euqipment/patient. So that the patient doesn’t die"

- Dr. Cooper is asked how much propofol she would give to someone MJ's weight (136 lb), she says she would start with 60mg. She says a dose of 25mg wouldn't last longer than 5-10 minutes and a dose wears of in 20-30 minutes.

- Cross examination Dr. Cooper is asked if she knew Murray given MJ propofol it would have made any difference in her treatment. She says no, she was treating cardiac arrest. She also adds getting drug history helps them give the relevant treatment and understand what happened.

- Walgren asks if the drugs on top of drugs were given to MJ, that would be an accumulative effect? Dr. Cooper answers yes.

- Murray was in the ER room and hands on.

Dr. Thao Nguyen (UCLA) Testimony

- She is a cardiologist and is called to the ER by Dr. Cooper.

- She says Murray never mentioned Propofol or benzodiazapine medications.

- Murray also tells her that MJ was getting ready for a tour, had trouble sleeping and he gave him 4 miligrams of adavan (mirazapam) via IV. She asks Murray if he tried to reverse the effect of the adavan? Murray says no. She asks if he gave any other medicines , Murray says no.

- Murray tells he doesn't have a watch and he doesn't know how long MJ was down. Murray couldn't give an estimate about when the drug was injected and how long MJ was down. Nguyen says Murray’s exact words were he ‘did not have any concept of time’ which is why he was unable to say when MJ stopped breathing.

- She does the balloon pump although she thinks it wouldn't work based on everything done already. An agreement was made with Dr. Murray that if the balloon pump failed, then they would call the time of death.

- She is asked how much mirazapan she would give to 136 lb patient. She says that she would start with a small dose of 1 mg and need to know the prior use of the drug with the patient.

- She says Murray's voice sounded calm and normal but he looked devastated.

- She says Murray didn't want them to stop the efforts.

Detective Dan Myers testimony

- He talks about the phone calls.

Detective Dan Myers testimony

- Myers is under cross examination. A lot of objections to the questions.

Sade Anding testimony

- Sade is employed Sullivan Steak house (in Houston) and met Murray there in February 2009. She was Murray's girlfriend/mistress in June 2009.

- Sade Anding -- who was in Houston the day MJ died -- testified she received a call from Murray at around 12:30 PM. It's unclear if she was referring to Pacific or Central time. But there is only one call in the phone records from Murray to Sade, and that's at 11:51 AM PT.

-She said he abruptly stopped responding to her comments. “I just remember saying, ‘Hello, hello, hello! Are you there? Are you there,’” Anding recalled. She said she heard “a commotion, as if the phone was in a pocket or something,” followed by coughing and a “mumbling of voices” that she did not recognize.

- She said she called Murray back and also texted him, but was unable to reach him.

Bridget Morgan Testimony

- Morgan met Murray in 2003 at a club and has a social relationship with him. She called Murray on June 25th but didn't talk with him.

Nicole Alvarez Testimony

- Alvarez met Murray in 2005 at a club she works. Alvarez says that she and Murray developed an ‘intimate relationship’ but she doesn’t recall if he told her that he was still married. Later in her testimony, however, she said that Murray’s permanent residence was “in Las Vegas with his wife.”

- She says Murray stays with her 2-3 nights and doesn't know where he is when he's not staying with her. "Well, I don’t have expectations of Dr. Murray, so that’s fair to say. That’s just a rule that i live by."

- She learns sometime that Murray is MJ's personal doctor (she's quite confused about when she learned it though).

- She says Murray would leave the house at 9-10PM and return between 7-10AM (although there wasn't a pattern).

- Alvarez said that she knew Murray left her apartment each night to treat Jackson, but that the physician told her “absolutely nothing” about those treatments. “Dr. Murray and I were on a need-to-know basis. He’s a professional man and I know my position and my place in his life and it is not my duty to know” the details of his medical practice, she said.

- Alvarez says Murray invited her on a trip to England – Murray already told her that he was accompanying MJ on the same trip.

- She says Murray told her that packages will come to her house and asked her to just bring them inside. She says he didn't tell her the contents or say that they were important. She says she never opened any of the packages. She says she never asked about the packages (what they contained).

- She says as the packages were for Murray she didn't pay attention to the sender. She said Murray told her he was having packages shipped to the apartment, but she never opened the boxes or looked closely at the return address.

Elissa Fleak LA Coroner Investigator

- Fleak arrives at UCLA at 5:20PM for physical examination of the body to see if she can infer anything about the cause of death. She did not see obvious signs of a cause of death.

- Fleak gets 4 bottles of blood from UCLA for toxicology tests.

- After ER she goes to MJ's house to make observation of the bedroom taking photographs, documenting the room, collecting ‘several pill bottles’ from beside his bed.

- Fleak starts with documenting prescription medications found on the stand. She observes flomax clonazapan, diazapam, lorazapam, tomazapam, trazadone tiziaandine, several pill bottles, tubes of lotion. Hydrocodone. tube of lidocane lotion. benequin. She documents who prescribed what.

- Tube of lidocaine lotion on table. There was a syringe on the table and one on the ground as well, next to the bed. IV bag with connected tubing. Blue “ambu” bag. goes to a nasal canua. Syringe on the table, needle on the floor, they may have been together they may not have been. (this is the one she described as broken syringe) ,an IV stand. saline bag. jug of urine. several urine pads. open box of disposable hypodermic needles. Iv catheters. empty vial of propofol and tomazinil.

- She returns June 29 for her investigation. She learned from detectives that there's additional evidence in the house. She goes to the attached room lined with wooden closets lined with wood. She recovers several items.

- List of the items: 1 black square bag with a zipper. 1 dark blue bag with a zipper with costco on the outside.light blue and brown colord bag. With a zipper with baby essentials bag .Misc. medical supplies. bag full of bedoquin lotions.

- Inside one bag : black pressure cuff, three 30 mil bottles of lidocaine. 2 empty and one of them had some liquid in it. All three of them had been opened.

- Large blue costco bag: saline bag that hat had been cut open with 100 mg propofol bottle inside it (open and had liquid in it). 20ml propofol open with liquid in it. 10 ml morazapam bottle open with liquid in it. 2 bottles of midazalom 10 ml both open both had liquid in them. bloody piece of gauze A bag of miscellaneous medical packaging and finger pulse monitor.

- Other bags: 2 100ml bottles of propofol , 2 20 ml bottles of propofol unopened, 3 20 ml bottles of lidocaine opened.1 30 mil bottle of lido unopened 20 ml bottle of diazolam opened 1 4ml of diazopam unopened etc (this is not a complete list)

- Additional items : Red pill bottle with no label that contained 14 caples turend out ot be emphederine. Over the counter night drops. Five business cards of Dr. Murray.IV clamp
blue strip of rubber.

- Overall :
6 bottles of lidocaine.
12 bottles of propofol. Elissa Fleak says two bottles were in the bedroom where MJ died, and the other 10 were in a nearby closet. One of the Propofol bottles found in the room by the nightstand was empty.

- Fleak says she also saw some juice bottles.

- On cross Fleak says a needle on the bedroom floor was about a foot away from Jackson’s bed - while the Propofol was ‘a couple of feet away’.

- Murray's lawyer, J. Michael Flanagan, asked Elissa Fleak two questions that alluded to their theory: 1) Was the IV bag fingerprinted? and 2) Was it possible for Jackson to reach the syringes from the bed? Judge didn't allow these questions as they were speculative and Fleak didn't answer these questions.
 
January 10, 2011 Preliminary Hearing Day 5

- First order of business-Judge Pastor & attorneys discuss evidentiary matters regarding info taken from Dr. Murray's iPhone. A prosecutor said he intended to use some of the information, which was disclosed to attorneys handling the case late last week, when he calls his first witness of the day. Chernoff (Murray's attorney) voices concern about attorney-client privilege. The phone contains a few short voicemails and 12 screenshots. After a 45-min delay, Judge Pastor says 'some info on files are privileged... but a significant number of materials are not.' Judge Pastor allows Murray's iPhone admissible as evidence. A new file was made and given to prosecutors. A 15-minute recess was granted for new items to be reviewed.

Stephen Marx Testimony

- Marx is a computer forensic examiner in the DEA who examined the iPhone.

- He testifies about emails sent on June 25th between Murray and Bob Taylor, of Bob Taylor’s Insurance of London.

- Bob Taylor sends Murray an email at 5:54 am LA time. The email was about specific inquires regarding the health of MJ. Murray responds to it at LA Time 11:27AM. The response content is about autorization of release of medical records, to get insurance.

- The e-mail is confirming Murray was the only doctor Jackson consulted during a 3-year period & asks about press reports re: Jackson’s health. London insurance broker handling a policy for Jackson's TII concerts asked Murray on the morning of June 25th to address press reports that Jackson was in poor health.

- Murray responds: 'as far as the statements of his health published by the press...they’re all felicitous, to the best of my knowledge.'

- There were also forwarded emails attached from the insurance broker , they were sent back and forth regarding company officials representatives MJ and AEG

Tim Lopez Testimony

- Tim Lopez is the owner of Applied Pharmacy Services and a pharmacist for 15 years.

- Lopez says in Nov. '08, Murray called him to get a cream to treat vitiligo. However, the cream wasn't available to Lopez. Lopez lost contact with Murray & heard from him again in March '09.

- Murray calls him in March, 2009 about benoquin 20% (cream for vitiligo) and it’s availability. Pharmacy finds a supplier. Murray ordered 40 of the 30 gram, 20%. Murray tells the pharmacy that his patient was African American and that he would instruct in the dispersal of it’s use.

- Later Murray asks about propofol and saline bags. Pharmacy provides the information Murray requests and Murray placed an order.

- April 6: Murray placed an order for 1 carton of 100 milliliter vials and 1 carton of 20 milliliter vials of Propofol & 9 saline bags.He also duplicated his order of Benoquin, the cream used to treat vitiligo and asked that his order be shipped to his office in Vegas.

- Murray then changed his mind on the shipping location and asked that the shipment be sent to the address of Nicole Alvarez. Lopez said Murray never mentioned MJ was his only patient at the time and instead led him to believe all the vials of propofol he requested were being used for patients at a Los Angeles clinic.

- Lopez testifies between the months of April & June, Murray called his pharmacy at least 7 times to place specific orders on different drugs. Some ordered drugs were lorazepam, midazolam, propofol & flumazenil. Murray requested that each order be sent to the Santa Monica address.

- Lopez said that when he volunteered to personally deliver an order during a trip to Los Angeles, Murray told him not to. “He said just Fed Ex it the way we normally do,” Lopez recalled.

- April 28 -- 4 boxes and each of the boxes had 10 100ml vials. Later that month, Murray ordered 20 vials of midazolan and 20 vials of lorazepam.

- On May 12, Murray ordered 4 boxes of Propofol, along with 2 trays of midazolan.

- On June 10, Murray ordered 4 boxes of Propofol, and 2 20ml Propofol.

- Overall: Murray ordered 255 vials of Propofol in the two months -- including 130 vials of Propofol in 100ml doses and another 125 vials of Propofol in 20ml vials.

- Murray also asks about benoquin cream if there was a formula that was less greasy.

- Under questioning by a prosecutor, the pharmacist said Murray asked several times for advice on what the doctor might take to boost his energy and “wakefulness.” He wants it to be non-narcotic and as natural as possible. He wants something over the counter (not prescription). Pharmacy makes the energy formulation by putting 3 products available over the counter putting them in 1 capsule. They added caffeine, asprin and ephedrine and made 30 capsules with that formulation.

- Murray says his patient were complaining of injection pain and asked if the pharmacy could make a topical analgesic. He indicated he wanted a lidocaine only.

Jaime Lintemoot Testimony

- Lintemoot is a senior criminalist at the LA County Coroner’s Office and the primary toxicologist when it comes to cases involving propofol.

- From the blood taken in UCLA they determined propofol was present and later they did tissue tests. Lintemoot mentions levels of propofol found by the tests.

- Murray's attorney, Flanagan, asked about the 70 grams of fluid found in MJ's stomach (that tested positive for traces of Propofol). Flanagan noted the presence of a juice box on MJ's nightstand ... and asked if it had been tested for Propofol ... raising the possibility that MJ was drinking on the anesthetic shortly before he died. The criminalist testified he had not tested the juice box.

Orlando Martinez Testimony

- Martinez is LA Robbery Homicide detective with 16 years experience. He investigates deaths.

- Martinez testifies that he began trying to contact Murray on 6/25, but was unable to. Martinez was contacted by Murray's attorney on 6/26.Martinez and Murray's attorney, Michael Pena, made arraignments for Murray to meet Martinez on 6/27 at a hotel in Marina Del Rey.

- Murray says he first met MJ in 2006 through a patient's son and later treated MJ and his kids for flu in Las Vegas.

- Murray tells the detectives that he received a call from Michael Amir Williams saying that MJ wanted him as his doctor for the tour.

- Murray tells the detectives for a little over 2 months he has been treating MJ, assisting him to sleep six nights a week.

- Murray said he would inject Jackson with 50 milligrams of Propofol...and then a drip infusion to keep him under . Martinez testifies that Murray told him that 50 milligrams was the most he would give Jackson.

- Martinez says Dr. Murray expressed a concern about Jackson developing a dependency on Propofol. Murray felt MJ developed a dependency on Propofol, so with MJ's permission he decided to wean him off Propofol and use some other agents. Martinez: Murray said he lowered the amount of propofol that he usually gave MJ, and he introduced midazolam & lorazepam, to help MJ sleep.

- What happened after MJ came home from rehearsal : MJ arrived upstairs to the room, they had a brief discussion as to what went on that night and that MJ had a shower and changed. Murray rubbed some skin lotion on MJ back for a dermological condition

- Murray says IV was either on MJ's right or left leg below the knee.

-- Murray's timeline and version of events

2AM : 10 mg valium orally. 2 mil lorazapam with saline pushed slowly 2 to 3 minutes.Done with a syringe using the IV port

3AM : 2 mg of diazopam same method

3:20AM : MJ fells asleep for 10-12 minutes then wakes up.

Murray says he turned down the lights turned on the music, and suggested that MJ to meditate. "Mr. Jackson began to complain to him that he couldn't sleep and that he would have to cancel his rehearsals and cancel his shows," Los Angeles police detective Orlando Martinez testifies.

Murray gives more Mirazapam - no effect

5AM : 2 miligrams of lorazapam - no effect. MJ complains again about cancellations.

7:30AM : MJ still up, complains about the pressure on him for cancelling rehearsals. Murray gives another 2 milligrams of diazopam.- no effect

10AM: MJ asks for his "milk" - propofol

Martinez says Murray described himself as "pressured" into administering propofol despite his concerns that MJ had become addicted as he prepared TII.

10:20-10:40 : Murray gives propofol. 25 mg over some time.

11AM : MJ falls asleep. Murray watches MJ for a while when he feels comfortable with MJ's situation he goes to the bathroom for 2 minutes.

He comes back after 2 minutes and stunned to see that MJ wasn’t breathing, because he always looked at his chest and his diaphramatic motion.

Murray starts chest compressions. - one hand under supporting MJ's back and the other hand on top of his chest. He says he also did mouth to mouth.

Murray says he couldn't get MJ to the floor on his own. Here Murray's explanation why he was giving MJ CPR on a soft bed rather than moving <J to the floor.

---"Dr. Murray said he could not move him to the floor by himself," the witness said.
--- Deputy District Attorney David Walgren pointed out that Murray is 6 feet 5 inches and weighs about 225 pounds and MJ weighed about 136 pounds when he died.

Murray says he was caring for MJ and didn't want to interrupt it and that's why he didn't call 911. Here is Murray's explanation for not calling for an ambulance immediately:

---"He said he was caring for his patient and did not want to neglect him," Martinez said.
---"Did he indicate that calling for a 911 operator would be neglecting him?" asked Deputy Dist. Atty. David Walgren.
--- "Yes," the detective said.

Murray injected MJ with tomazapil. .2 mil

- During this process he called Michael Amir Williams - while holding the cell phone one hand, giving chest compressions with other. Murray also left the room to the landing to call out to Kai Chase.

- Murray doesn't tell the detectives that he was making phone calls and sending text messages when he was supposed to care for MJ. Murray only mentions the call he made to Michael Amir Williams.

-Chernoff on cross: Murray's attorney Ed Chernoff asked Martinez if Murray had spoken of Jackson asking to self-administer propofol. He answered yes.

--- "Mr. Jackson knew all about propofol before Dr. Murray came on the scene?" asked Chernoff.

Dr. Christopher Rogers Testimony


- Rogers is LA coroner. Employed since 1988 as a forensic pathologist and he performed the autopsy on MJ.

- Rogers about MJ's health "The autopsy did show some incidental findings. However, his general health was excellent."

- findings: MJ had prostate issue; vitillago, polop of the colon, inflammation and scaring of his lungs, and also had some arthritis of the spine.

- MJ was 5’ 9” and 136 pounds. His BMI (body mass index) 20.1. It falls to the thin side of normal weight.

- MJ did not have any abnormalities of the heart and he did not have any atherosclerosis. He did not have any cardiac disease.

- There was no trauma or any natural disease that caused his death.

- Rogers' conclusion of homicide was based primarily on the info he had about the medical care MJ received, specifically that the care was substandard. “The information we received indicates that the doctor left Mr. Jackson while he was anesthetized and this is something you would not do,” Roger said.

- Rogers says MJ died of propofol intoxication, with an underlying condition of a benzodiazepine effect.

- Cross-examination : Rogers say that situation doesn’t support self administration of self treatment of propofol and there were no factors inconsistent with his conclusions.

- Cross-examination : Rogers is asked hypothetically if MJ ingested propofol and lydocaine himself would it still be considered homicide. “Based on the quality of the medical care, I would still call this a homicide even if the doctor did not administer the propofol to Mr. Jackson,” said Rogers, chief of forensic medication at the Los Angeles County Coroner’s office. He said Murray had endangered Jackson by using the drug in a home setting without proper monitoring, regardless of who gave the final dose. The testimony was a blow to the defense.

- Dr. Christopher Rogers testified he believes Dr. Murray had no business administering Propofol outside a hospital setting, particularly without the appropriate medical equipment. Rogers said given MiIchael's dependence on Propofol and the fact that Murray left him alone in the room with access to the drug constitutes a homicide.

- Question about self administration : The IV catheter was in the left leg a little bit above the knee. Rogers mentions it's hard to reach and in order of MJ to inject himself it would require the doctor to stop medication, leave the room, MJ wake up and gain the necessary awareness to press /push propofol.

- Cross - examination : Oral digestion. Rogers say it's possible to orally digest propofol but doesn't think that's the case here as the amount in the stomach is so small.

Dr. Richard Ruffalo Testimony

- Ruffalo is an anesthesiologist and clinical pharmacologist. He went over everything about MJ's death and wrote a 47 page independent report.

- He says propofol levels in MJ at the time of his death would be even higher as the blood is drawn from him after he received a lot of IV fluids and propofol degrades over time.

- Dr, Ruffolo also thinks the numbers of the benzodiazapams from the heart blood, he thinks reflect an injection of a higher dose than what Dr. Murray states he gave.

- Dr. Ruffolo mentions monitoring requirements and the equipments and training needed for any emergency situation response.

Prosecution Rests in Murray Case

- The defense filed a motion to dismiss, which is routine.

Closing statements

Murray's lawyers arguments

- We have never heard the time of death, if we knew the time of death we can find out who is involved.

- Murray saw MJ everyday for 3 months, he would know how MJ interacted with these drugs better than the other doctors.

- We heard from an anethesiologist what he would use as a standard of care. We didn’t hear from a cardiologist in a similar situation and training.

- Murray injected around 10:40 so if Dr. Murray was away from MJ, how could he have given another dose of propofol? so what was going on between 11 am and 12 am? That goes to show you right there that Dr. Murry could not have given that dose, he was on the phone.


Prosecutor Walgren's Arguments

- Walgren is very angry and passionately in a loud voice, arguing his case.

- It was not MJ time to go. MJ's children are without a father.The reason MJ is not here today, is because of the careless, negligence careless incompetence of Murray. MJ is dead at the hands of Murray.

- Walgren goes over what is heard in the testimonies.

- Walgren mentions Murray's timeline "According to Murray’s own timeline, that he let MJ lie there for over an hour not breathing. Or he could be lying about his timeline, and Murray is not being truthful about his timeline. Third option, is that Dr. Murray is so utterly so incompetent and reckless, that he has no idea what he gave him or when."

Judge Pastor's rulings

- Judge Pastor denies the defense's motion to dismiss the case.

- Walgren asks for an increase in the bail amount. (wants it to be $300,000). Judge denies this as he doesn't think Murray is a flight risk.

- Ms. Saunders of Medical board goes over the testimony and asks the judge to suspend Murray's medical licence. Judge grants that request.

- Arraignment is set for January 25th, at 8:30 am.
