No Chernoff and Flanagan???

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

Murray's representing himself? Oh okay. This brings that old saying about anyone who represents themselves having a fool for a client to mind.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

LOL murrays repping himself. this should be fun to watch.why aint baldy repping him

And does that mean that he can present a case unchallenged or is there going to be a prosecutor in the courtroom also who can challenge him with the statements he gave to the police, paramedics etc? Also, can the appeals court still reject his appeal? Because personally I think that maybe he wants to represent himself just to make sure the appeal goes through.

The convicted felon said in his "documentary" that he could have done a better job cross-examining dr. Steinberg than "stupid" Flanagan. The guy is so delusional, it's scary. And he is really dangerous. :bugeyed

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

lmao his lawyers have abandoned him. His appeal is likely to get him nowehere, especially out of jail.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

I still think that since Murray admitted to giving Michael propofol without monitoring equipment and supposedly giving in to Michael's alleged "demands" for the propofol to begin with, that should put Murray's appeal on the skids right there. None of Michael's other public "controversies" should come into this either. I really hope the appeals court tells Murray to go and serve his time in jail. He should not be allowed to be able to crucify Michael's memory again and again because he was too money-hungry to say no to Michael or quit. Michael paid with his life for requesting the propofol if that's what he did. But Murray needs to be held responsible for giving propofol under those conditions when he knew better. As far as I am concerned, Murray lost his right to claim he was innocent when he gave Michael the propofol against his claim that he suspected Michael had been having dependence issues with that stuff for weeks. This is all just my opinion.

Can this be denied though? All the evidence has already been dumped on the table how can there be more?

Michael Jackson doctor files appeals notice in LA
The AP

LOS ANGELES—The doctor sentenced to four years behind bars for causing Michael Jackson's death has filed a notice that he intends to appeal the conviction.

Conrad Murray signed a one-page document that was filed in Los Angeles on Friday seeking all records and transcripts from the case. The filing does not indicate the basis on which Murray will argue to overturn his conviction or sentence.

The 58-year-old was sentenced Tuesday to four years in jail for his involuntary manslaughter conviction, but the term will be automatically cut in half.

Murray's challenge will be heard by a state appeals court in Los Angeles, assuming he files an opening brief at a later date.

Superior Court Judge Michael Pastor blasted Murray's conduct on Tuesday, calling him a disgrace to the medical profession.

Conrad Murray
Appeals Manslaughter Conviction

Dr. Conrad Murray has just filed an appeal, challenging his conviction for involuntary manslaughter in the death of Michael Jackson ... TMZ has learned.

Murray filed the document in pro per -- which means he's representing himself instead of using a lawyer.

On the portion of the document where a lawyer will usually state his or her firm's contact information -- Murray lists "Men's Central Jail" ... and includes his booking number.

While he is representing himself, Murray is still communicating with one of the lawyers who repped him in the manslaughter trial, Nareg Gourjian.

Gourjian tells TMZ ... "This case presents a gold mine of issues for any appellate lawyer. Dr. Murray is confident that the Court of Appeal will vindicate him."

Dr. Conrad Murray files appeal notice

Murray is serving a four-year jail term for Michael Jackson's death
Los Angeles (CNN) -- Dr. Conrad Murray filed notice Friday in Los Angeles Superior Court that he will appeal his conviction last month of involuntary manslaughter in the death of Michael Jackson.
Murray was sentenced to four years in the Los Angeles County Jail on Tuesday, three weeks after a jury found him guilty of being responsible for Jackson's 2009 death.
"He disagrees with the jury's findings and the pretrial rulings made by the court," defense lawyer Nareg Gourjian said Friday.
Murray, who signed his own appeal notice, has not hired a lawyer to represent him in the appellate process, Gourjian said.
The appeal notice was filed "In Pro Per," legalese that means he's representing himself. The return address on the document is the jail where Murray has resided since his conviction.
It's not unusual for appeal notices to be filed in that manner before a lawyer who specializes in the appellate process is chosen, Gourjian said.
Murray's trial lawyers have complained that a series of pretrial decisions by Los Angeles Superior Court Judge Michael Pastor limited their ability to defend the doctor.
Judge Michael Pastor blocked their efforts to introduce evidence and testimony about Jackson's past drug use and his finances.
The defense argued that Jackson's fear of financial ruin if his comeback concerts were canceled led him to self-administered the drugs that killed him in a desperate search for sleep.
The judge did not allow them to call to the stand other doctors they believe would testify they used propofol to put Jackson to sleep for years before his death.
Murray's four-year sentence, unless overturned on appeal, is expected to keep the doctor in jail for only two years since state rules give him credit for two days served for every one day behind bars.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

Murray just filed a notice that he will be appealing. This is not the appeal.
You dont need an attorney to file the notice. So for TMZ to say Murray will
be represnting himself for the appeal is stretching it. Just TMZ spin .. Twist

It's not unusual for appeal notices to be filed in that manner before a lawyer who specializes in the appellate process is chosen, Gourjian said.

No Chernoff and Flanagan???

Apparently not, although it appears he's still in contact with Baldy. =o

Shame. I shall miss Flanazapam and his endearing tirades about Lorazepam and drunken demeanour. I shall miss Cherry Pie's funny faces too.

All I have to say to Murray in regards to this decision (if he really does intend to represent himself) is: remember what happened to this guy...

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

Can't see why an appeal would be granted. Should however be more than interesting if it goes forward to see Murray represent himself. Might even make decent viewing because the guy is so arrogant and still so convinced he did nothing wrong.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

I can't see an appeal being granted-he can't even get a lawyer to represent him!

He's just like sociopath Ted Bundy. He's on the same level as Ted Bundy, Charles Manson. etc I hope he has a slow and cruel death.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

Murray looks absolutely foolish ?hanging his mind all the time. One day he denied to testify, another day he decided to appeal himself. He looked disgusting during interview, shocked and outraged all reasonable people by his words and demeanor. But now, after all that he dares to represent himself on appeal? He's absolutely crazy

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

I'm pretty sure that he won't be representing himself.

an Appeal is different than a trial and he needs a lawyer that's knowledgeable about appeals. Chernoff, flanagan and Gourjian might not be experienced in that area.

I expect he'll get one soon. He probably just wanted to start the process.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

Let's say the appeal is granted. Can there be another guilty verdict? Cause that part would be fun.

It´s not likely Michael would have died from propofol if Murray had used proper equipment, monitored him and called 911 when it went wrong.A juror said that´s the reasons why they found him guilty.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

Can someone explain how the appeals process works please?

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

With apologies for the source.....but this is apparently a comment from Flanagan:

Lawyer J. Michael Flanagan said the Houston cardiologist can no longer afford private legal help.
'There's probably going to be a restitution decision that puts him underwater,' Flanagan explained.
'We're helping him with the appeal paperwork, and eventually there's a possibility we might be appointed to work on his appeal. We know the case and think we're the logical people to be appointed, but you never know.'

Murray's challenge will be heard by a state appeals court in Los Angeles if he files an opening brief at a later date.
The appeal follows a six-week trial that detailed Jackson's final hours.

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

Sorry im confused. Can someone tell me how an appeal works? What is the next step and then.. etc? And if approved will there be another 5 week trial orso?

And i dont think like is said he will be respresenting himself he is a fool but not that stupid. He prob is searching now for a lawyer. i dont get what flanagan said above because i thought both flanagan and chernoff bailed on Cm and left???

Re: Appeal Thread - All Discussion / Update: Murray Filed for Appeal

^They are basically doing just that, like he said Murray can no longer afford private legal help. He's saying there might be a possibility the lot of them are appointed to work in the appeal, but that as of now they are basically just tying up loose ends in their involvement and helping him file the paperwork (from what I have heard this is mostly Baldy doing the work--no surprise there).

I had to LMAO at Flanny's comment re: himself and Chernoff being the "logical" people to appoint lol! If anything aside from Murray's wrongdoing sank this ship, it was his own and Chernoff's involvement in the case (especially true for the former). If Murray has an ounce of intelligence, he will not be inviting Flanny back (or Cherry Pie either).

If I were him, I'd stick with the only lawyer I've seen actually doing some productive work towards my case, and that is most definitely and ironically Narej Gourjian aka Baldy.

Conrad Murray appeals manslaughter conviction in Michael Jackson case

Prosecutors have asked for $100 million in restitution from Murray for Jackson's estate
BY NANCY DILLON
NEW YORK DAILY NEWS

Friday, December 2 2011, 8:50 PM

The disgraced doc convicted of accidentally killing Michael Jackson has filed a notice of appeal, one of his lawyers confirmed Friday.

Dr. Conrad Murray signed the paperwork from jail this week saying he's representing himself, a step that's required to get court-appointed counsel, lawyer J. Michael Flanagan said.

Flanagan said the Houston cardiologist can no longer afford private legal help.

"There's probably going to be a restitution decision that puts him underwater," Flanagan explained.

"We're helping him with the appeal paperwork, and eventually there's a possibility we might be appointed to work on his appeal. We know the case and think we're the logical people to be appointed, but you never know," he said.

The Friday filing was first reported by TMZ.com.

A court spokeswoman confirmed the court's receipt of the form.

Prosecutors have asked for $100 million in restitution from Murray for Jackson's estate. A hearing on the matter has been set for January.

Murray, 58, sat stone-faced at his Tuesday sentencing as Judge Michael Pastor sentenced him to four years in jail and branded him a reckless liar who caused Jackson's overdose death and then tried to cover his tracks.

"He has absolutely no sense of remorse, absolutely no sense of fault and is and remains dangerous," Pastor said.

Despite his max sentence, Murray is expected to serve less than two years because a new state law means he'll bypass state prison and remain in Los Angeles County's notoriously overcrowded jail.

"He'll probably be released in winter 2013," Los Angeles County Sheriff's spokesman Steve Whitmore told The News. "He'll be a keep-away inmate who's escorted everywhere he goes. He will not mingle with the jail population."

This should answer all the questions. Read starting from the bottom

MMcParland Michael McParland
The Defence complaints in the media also seem to me to be predicated on the belief that CM's version of events is correct. But what version?

MMcParland Michael McParland
So what is missing from such a suggestion is that there was any relevance to such evidence if it existed for the events of 25 June 2009.

MMcParland Michael McParland
This included Drs whom they claimed had given propofol to MJ before. But prosec had spoken to some who said it given in ord medical circs.

MMcParland Michael McParland
But Ct records show by the end of August the Def had 103 witnesses on their list, a large number of whom they hadn't apparently spoken to.

MMcParland Michael McParland
For example, it was said yesterday that CM was stopped from calling doctors who might have testified that MJ had been given propfl b4.

MMcParland Michael McParland
Its impossible to know yet what the true 'merits' if any of the possible grounds of appeal might be, but I'm not impressed so far.

MMcParland Michael McParland
Given its nature, the chances of CM representing himself on appeal are as likely as a sedated man self-administering propofol in a bedroom.

MMcParland Michael McParland
The appeal can be against both the finding of guilt and / or against the length of the sentence.

MMcParland Michael McParland
The oral arguments would focus on points of law. CM, if he was still in custody would normally not be allowed to attend.

MMcParland Michael McParland
After the briefs are filed, the attorneys may request oral argument before the 3 judges of the Court of Appeal. Oral args are very short.

MMcParland Michael McParland
Because CM has the burden of persuasion on appeal, he will be permitted as the appellant to file a second brief called a “Reply Brief”.

MMcParland Michael McParland
The DA may also cross-appeal. DA Cooley might try to do that in light of his concern over the new CA Realignment Act, though prospects are poor.

MMcParland Michael McParland
The DA will also review both the court transcripts and the appellant’s opening brief. DA will then submit their own brief resisting appeal.

MMcParland Michael McParland
The appeal attorney will also ask in their brief for a remedy. Normally, if successful in case they would be asking for a complete re-trial.

MMcParland Michael McParland
That attorney will then submit a written "brief" to the Court of Appeal setting out their arguments about what errors occurred at trial ct.

MMcParland Michael McParland
After transcripts are produced, a criminal appellate attorney reviews them to determine what, if any, legal errors were made by the trial ct

MMcParland Michael McParland
A copy of the clerk’s file (the “Clerks Transcripts) and of the reporter’s notes from hearings (the “Reporters Transcripts' are now ordered.

MMcParland Michael McParland
The appeal notice filed by Conrad Murray is just a pro-forma document requesting an appeal. It doesn't specify any legal grounds of appeal.

MMcParland Michael McParland
'In my absence he must have swallowed 8 law books and self administered a notice of appeal'.

MMcParland Michael McParland
Conrad Murray hasn't yet got lawyers to represent him on his appeal. The present team must have just left him alone for two minutes.
