I am sorry I am confused to what is going on. I thought the estate had a big win against these people and now it's all changing? All these things seem to be never ending.

Estate files their modified pretrial brief - basically consists of all of the recent updates (only seeking actual damages, dropping Destiny claims and so on).

Judge approves Mann's new lawyer

Mann's new lawyer files and ex-parte application to vacate the summary judgement and dismiss the lawsuit saying that MJ Estate does not have the legal standing to bring this lawsuit as the owners of the copyrighted items are either Sony Music, Columbia Pictures, Triumph Inc and Bravado Inc.

How dum is Mann Triumph Inc is the estate. All the other companies just have licence agreements but don't own any copyrights.

Mann saga continues

Court rejects motion to vacate the summary judgement and motion to dismiss the case on the eve of the trial.

Mann's lawyer files a response asking the judge reconsider this decision.

Mann's lawyer files another motion asking the court not to allow Estate's expert witness testimony. This motion is like a repeat of the motion to vacate and motion to dismiss. Mann's lawyer argues that Estate's expert had at least two flaws - assuming MJ Estate had standing to file lawsuit and he calculated damages using the use of TII poster picture. As you know Mann's lawyer has been arguing not Estate but Sony , Columbia, Triumph and Bravado are the parties that could have filed the lawsuit.

Documents also show that there's another hearing set on September 4th.

Mann is just wasting time to be honest.

All these copyrighted items belong to the Estate, and were licensed to other parties.

By the way, when is the trial set for?

The trial was set for Sept. 4th. Does this mean there will be a trial-delay when now a hearing is set for this day.

yes there seems to be a slight delay but still the judge calls it "on the eve of trial"

As you know Mann's lawyer has been arguing not Estate but Sony , Columbia, Triumph and Bravado are the parties that could have filed the lawsuit.

Then I wish that Sony, Columbia, Triumph and Bravado would sue if the Estate can't since Mann's lawyer wants to talk about "legal standing". Because Mann should not be allowed to continue trying to make money off of property that he obviously has no right to, in my opinion.

As far as I can see,

sony music has the rights for Destiny song. They gave an authorization to Estate to pursue this lawsuit. I don't know whether it's enough or not, but the Estate dropped that claim.

MJ Estate owns Triumph Inc. So that part seems to be a technicality. Columbia pictures (for TII) and Bravado (for merchandise) has been licensed by MJ Estate. So Estate is still owners for that stuff. So all of these just seems to be a technicality or stalling technique. I hope soon we learn what the judge says.

LOS ANGELES — Michael Jackson’s estate will begin making its case to a jury that a businessman working with the singer’s mother should be forced to pay millions of dollars for infringing on several copyrights.

The amount is the sole issue at stake in a trial set to begin on Tuesday against Howard Mann, who has collaborated with Katherine Jackson on several projects, including a book.


A judge has already ruled that Mann violated Jackson estate copyrights and ordered his website shut down. His attorneys argue the estate doesn’t actually own the proper rights and the ruling should be tossed out, but a judge has refused to reconsider his ruling.

The infringed works include cover art from Jackson’s posthumous film “This Is It,” and a silhouette of the singer dancing to his hit “Smooth Criminal.”

The estate’s case is expected to hinge on one expert witness who has estimated the cost of a license for the works is between $5 million and $12 million.

Mann’s attorneys rejected a settlement offer last week of $2 million. Jackson’s estate, who sued over the works in January 2011, is also asking that Mann be forced to pay its attorneys’ fees.

Mann’s lawyers have sought to introduce evidence that they were given bad legal advice about having to license the works, and have considered calling Katherine Jackson as a witness. The Jackson family matriarch is one of the beneficiaries of the singer’s estate, along with his three children.

U.S. District Judge Dean D. Pregerson has noted that Mann doesn’t appear to have the resources to pay a large judgment.

I somehow missed that part that Mann's lawyers rejected 2 million settlement! So I take it that executors were asking for 2 million, and not the other way around executors offering 2 mil for Mann.

If they believe they were given bad advice, why didn't they stop when executors contacted on them first time and check the license thingys work? Lies lies lies. I believe Katherine is the one reason executors are not hard on Mann as she is business partner with this crook. Without her there in the middle, Mann would have been done and dusted.

The settlement also restricts Howard Mann and his companies from using Jackson's likeness without permission in the future. It ends a year and a half of legal fighting over Mann's use of Jackson's name and likeness on a website used to promote unreleased songs, photographs and a book written by Katherine Jackson filled with recollections of her superstar son.

Mann is the CEO of Vintage Pop Media, which operated the website www.michaeljacksonsecretvault.com until it was ordered shut down last month by a federal judge who ruled the site violated copyrights controlled by the singer's estate.

Under the terms of the settlement, announced in court by estate attorney Zia Modabber, Vintage Pop Media Group is responsible for $2 million of the judgment, while the entity Vintage Associates LLC is responsible for the remainder. Vintage Associates is the custodian of the items that were at issue in the case.

Mann's attorney, Lee Durst, declined comment after the hearing. "The estate is delighted this matter is behind us," estate attorney Howard Weitzman said.

Among the items that had been improperly used were images from Jackson's posthumous film "This Is It" and a silhouette of the singer dancing in "Smooth Criminal." The settlement also blocks the usage of materials from "Thriller" that had appeared on Mann's website.

2.5 Million Dollar Judgement, okay, what next.

Will Mann cry broke and ask Mother to give back some to the book profits she was paid. Or will he sue Mother for half that amount. Or will he "instruct" Mother to conduct ANOTHER interview, featuring herself and Michael's 3-children, which can be sold to multiple markets.

I'm sure Mr. Mann knows exactly how much money Mother get's from the Estate on a monthly basis (even though he says differently in public) and is not going to be very happy to know that he ALONE is on the hook for 2.5 million dollars.

Oh what a tangled web we weave.......

Yep! In my opinion, sooner OR later "somebody" is going to go after Ms. Katherine and/or other members of the family, because they continue to get involved with these shady deals, but when the crap hits the fan, it's the OTHER party who catches the heat, i.e. the perfume guy, the bogus MJ tribute folks, the fake Heal The World lady, and now Howard Mann.

Those Jacksons are sly little something or others (LOL), but sooner or later they TOO will have to pay for their participation in all of these shady deals.
