That's interesting and it seems really unfair to the Catholic Church considering that public schools are exempt of the law. It really seems to be just aimed at them.

Don't think it has any relevance to Wade/James' case though, does it?

He is saying they did not protect thim. But the California law says he would have to prove they knew he was being abused. Hence why I believe he is going to say they knew Michael was abusing him and did nothing

Yes, according to what he's cousin wrote in a comment on Radar Online last July, that's what they claim:

How convenient they are so upset with these people (conveniently the people in charge of Michael's money) - more upset than they are with MJ himself, acc. to Jonathan - but they are not upset with Joy... If you are going to accuse people of turning a blind eye and facilitating your alleged abuse by organizing for Wade to come to America, then Joy Robson should be first in line, but no, they are just angry with the people in charge of Michael's Estate and money. How convenient.

Maybe I'm confusing this... but it was understanding that the above bill that was passed pertains to only places like schools and churches. This quote taken from article:

The legislation allows victims to again sue the employers of the alleged perpetrators, and a range of religious and private colleges and universities

I'm not sure the laws concerning filing against deceased individual have changed. We need an attorney to explain this stuff.

Wade is suing MJ's businesses (MJJ Productions and MJJ Ventures). But the article says:

S.B. 131 would allow victims, who turned 26 before 2003 but failed to file a lawsuit during the revival window authorized by the state Legislature in 2003, a second opportunity to file during 2014 — and potentially longer than that, depending on how the law is interpreted.


Wade did not turn 26 before 2003 (he was 21 in 2003) and I don't think James either (he was born either in 1977 or 78 IIRC). Plus the whole thing seems like it's specially aimed at the Catholic church, eg.:

The bill specifically exempts public schools and other government institutions from lawsuits. It also exempts the actual perpetrators of the abuse from civil action in some cases, while leaving their employers vulnerable.



So I doubt it can be applied to Wade/James but who knows.
 
The catholic church has had a history of sending pedophile priestto other churches trying to hide the priest instead of throwing them out ontheir asses. Wade, and Upchuck IMO willhave to prove that the people who run Michael&#8217;s companies now knew that they were being abused and didnothing. Attorneys for the estate of Michael Jackson want a judge to dismiss the King of Pop, who died five years ago today, as an unnamed defendant in a lawsuit by a choreographer who alleges the late singer sexually abused him as a child.

Wade Robson, who has worked with such luminaries as Britney Spears and Usher, has filed both civil and probate court actions. The civil suit was filed in June 2013 and names as defendants two Jackson companies as well as &#8220;Doe 1.&#8221;

In court papers filed Friday, lawyers for the estate say it is clear that the unspecified person is Jackson himself.

&#8220;No court has jurisdiction to entertain an action against a deceased person,&#8221; the estate&#8217;s attorneys state in their court papers. &#8220;An action initiated against a party after that party has died is void &#8230; for lack of jurisdiction.&#8221;

In an email to Jackson estate attorney Jonathan Steinsapir, a copy of which is attached to the estate&#8217;s court papers, Robson attorney Maryann Marzano states that Jackson is being left as Doe 1 in the civil case for tactical reasons.

&#8220;We are well aware that any claims against Michael Jackson need to be made against the estate,&#8221; Marzano wrote. &#8220;Having said that, we are reluctant to dismiss the Doe 1 defendant given the possible adverse effect a dismissal may have on our pleadings in discovery.&#8221;

A hearing on the estate&#8217;s motion regarding the civil suit is scheduled Oct. 1.

Robson, 31, still needs a judge&#8217;s permission to file the probate court claim because it was brought in May 2013, nearly four years after the entertainer&#8217;s death at age 50 on June 25, 2009.

Robson alleges Jackson molested him between 1990-97, even though he testified in the singer&#8217;s 2005 child molestation trial that the pop star did not sexually molest him. Jackson was acquitted on all charges in his 2005 trial. He settled out of court in 1994 another claim in which he was accused of sexually abusing a 13-year-old boy.

yes that's what Estate says - you cannot sue a dead person and Wade's lawyers want Michael listed so that they can do a lot more personal discovery concerning Michael.

what this also shows that there's no settlement whatsoever. Estate is attacking this from multiple aspects to dismiss all or parts of it and all that "off calendar" is because of extensions or additional stuff brought up.

I'm very happy to see that they're putting in an effort to fight this, maybe the lesson from the 90's settlement has been learned after all.

To me this is something that they should not settle ever. Other things like business deals and such do settlements but not this. This has caused so much pain and damage in Michael's life. It scarred him and caused so much damage to his reputation. Even though he went through the trial in 2005 there are people out there who still think he was guilty. Michael was driven from his home and suffered from this. These people are liars just like the others and they don't deserve a dime. These people should be put in their places and exposed for what they are. Michael doesn't deserve this anymore. He deserves respect and peace. Enough is enough.

Honestly I feel myself getting so tired of this, I've never experienced myself like this before in my life.
Going through all this money greed and sorry by all what I've read and heard since 1993 to it just comes down to this every stupid time nothing else.

To me it's important Michael can't be hurt by this anymore. I pray his children are strong enough to not get hurt by this.
Everybody knowing Michael does know there's no truth in this but only greed, jealousy and fame junkies seeking the fix of five minutes on any cheap stage.

If WR will get any penny for this, no matter if by any kind of media or even a settlement and I personally don't care if there will be one or not, he'll have to pay it back the very very hard way... I do believe in final justice one day may it be in this life or when it's over.

Ok just had to vent as yesterday was the 25th June...

I respect TMezz, but he ain't this oracle that knows everything and what he says is to be taken as true.
Remember what he said about family members during granny-napping and not to mention his support to Randall "crybabe" Sullivan's book. He is not free from mistakes.

If you think about it, it just doesn't make any sense that the estate would settle, because if it happens, there is going to be tons of other who suffers from repressed memory or lack of money.

If they want to make money to the estate, they need to keep Michael's name clean and free from this sort of publicity, so I think they will fight.

T-Mez has been wrong about a lot of things lately and this case is no acceptation in my opinion. Trying to throw shade on Michael’s Estate executor is a low blow on T-Mez part and lowers my respect level for him.

He'll be back on King Jordan Radio for MJ's birthday. I assume it will be held August 29, but the event link Jordan posted didn't work for me so I don't have the exact information. If somebody else knows and can post that will be great. Otherwise I asked Jordan to clarify this and I'm just waiting to hear back.

Anyway, if anyone wants to know why he feels this way- he already said it's based on past behavior- but you want to discuss it with him more, you can always call the show and ask him. Maybe he can elaborate a little more.

Sorry but what are you talking about. They settled with Michael's ex-manager DeMann about commissions. They DID NOT settle with Wade. Are you even reading people? Geez.

and their first attempt was and still is getting the claims dismissed. I don't get why anyone is fixated on settlement. This is a case of creating a fantasy and then getting scared of your fantasies.
