American cable and satellite television network C-SPAN has to give its consent to that release.

That is because C-SPAN holds the copyrights not only of Michael Jackson's performance at the Night At The Apollo, but also the copyrights of all the other artists/acts that performed that night at that 2002 event:

"Because of copyright restrictions, only the first minute of each musical act was shown" (C-SPAN)
