Jury Selection Thread - Katherine Jackson vs. AEG

Not open for further replies.
I was hoping this thing will end by June 25, but now I do not think so. What a shame. I hope at least it is over by August.

Oh god no that is gonna be horrible if this trial will still be on during michael's annivarsy

Actually I did a little estimate

voir dire - the phase to select final 12 jurors + 5 alternates - is Monday April 15. If we say they finalize it in a day or two and the judge gives the jurors a few days to get their life in order, we can expect the trial to start by April 22. If we count 90 business days for trial that would bring us to August 23.

Ok thanks. Let's just pray the jury has a verdict before August 29.

Connections hamper jury selection in Jackson case

LOS ANGELES (AP) — The extensive connections of Michael Jackson, his family and friends became a challenge Monday for a judge trying to seat an impartial jury for his mother's wrongful death lawsuit against the company that promoted Jackson's ill-fated "This is It" concert.
As individual questioning finally began, some jury prospects who had passed the written portion of the process had to be excused because of personal connections.
Among them was David Walsh, a Canadian singer-songwriter who said he had met members of the musical Jackson family and was friends with Lisa Marie Presley, Jackson's ex-wife. He said his own manager was on the witness list.
"I've had friends in Michael's band and my best friend was a backup singer on the "This Is It" concert," Walsh said.
Walsh said he had formed opinions about the case that were probably unshakable.
Katherine Jackson's suit claims AEG endangered Jackson's life by hiring an incompetent doctor, Conrad Murray, to look after the superstar singer. AEG lawyers are expected to argue that Jackson was complicit in his own demise by insisting on hiring Murray and demanding the anesthetic propofol to help him sleep.
The latest phase of jury selection came after jurors filled out questionnaires about their views on Jackson, his family and his life and death.
A preliminary group of 104 prospects was immediately reduced by six when members reported hardships or acquaintances on the witness list.
A medical student said one of her UCLA professors was on the list, but she was allowed to remain when she said she would have no bias about the testimony.
Another panelist said she and her husband do business with one of the law firms involved in the case and that would get in the way of her impartiality.
Murray is serving a prison term after being convicted of involuntary manslaughter in Jackson's death from an overdose of propofol. Jackson died in his bed in June 2009 at the age of 50.
Complicating the case is the fact that neither Jackson nor AEG had signed Murray's $150,000 a month contract. Jackson died before Murray was paid.
Katherine Jackson's lawyers contend AEG was negligent in failing to investigate Murray's qualifications before hiring him.

"A medical student said one of her UCLA professors was on the list, but she was allowed to remain when she said she would have no bias about the testimony."

Hope she remains faithful to her words.

I see the last part was this: "The latest phase of jury selection came after jurors filled out questionnaires about their views on Jackson, his family and his life and death." I wonder if there is a part about AEG & the jurors views on the corporation?

If they are having problems selecting the panel, it is all the lawyers & family's fault for trying this case in the public with their constant statements and the purposeful leaking of information.

Connections hamper jury selection in wrongful death lawsuit involving Michael Jackson

By Associated Press, Tuesday, April 16, 2:10 AM

LOS ANGELES — The extensive connections of Michael Jackson, his family and friends became a challenge Monday for a judge trying to seat an impartial jury for his mother’s wrongful death lawsuit against the company that promoted Jackson’s ill-fated “This is It” concert.

As individual questioning finally began, some jury prospects who had passed the written portion of the process had to be excused because of personal connections.

Among them was David Walsh, a Canadian singer-songwriter who said he had met members of the musical Jackson family and was friends with Lisa Marie Presley, Jackson’s ex-wife. He said his own manager was on the witness list.

“I’ve had friends in Michael’s band and my best friend was a backup singer on the ‘This Is It’ concert,” Walsh said.

Walsh said he had formed opinions about the case that were probably unshakable.

Katherine Jackson’s suit claims AEG endangered Jackson’s life by hiring an incompetent doctor, Conrad Murray, to look after the superstar singer.

A woman who is a superior court judge said she knew a number of people on the witness list but it would not interfere with her ability to be impartial, and she remained on the panel.

By day’s end, 17 prospects had been excused, most because the extended length of the trial would cause them financial hardships. The case is expected to last through the summer.

More panelists sent notes to Superior Court Judge Yvette Palazuelos before court recessed for the day, asking to be excused. She said she would consider their requests Tuesday.

One member of the jury pool said he had met Dr. Conrad Murray at a barbecue sometime after Jackson’s death and they had a social conversation. But he said he didn’t realize who Murray was, and once he did he stopped talking to him. He remained on the panel.

Murray is serving a prison term after being convicted of involuntary manslaughter in Jackson’s death from an overdose of propofol. Jackson died in his bed in June 2009 at the age of 50.

Complicating the case is the fact that neither Jackson nor AEG had signed Murray’s $150,000-a-month contract. Jackson died before Murray was paid.

Katherine Jackson’s lawyers contend AEG was negligent in failing to investigate Murray’s qualifications before hiring him.

Potential jurors offer crazy excuses as selection begins in lawsuit over Michael Jackson's death
One said karma, not a jury, should decide if negligence caused a death. Katherine Jackson and the King of Pop's three children are suing concert promoter AEG for billions for the alleged negligent hiring and supervision of Conrad Murray, the doctor convicted of causing the “Thriller” singer’s 2009 fatal overdose.

Lawyers for Michael Jackson’s heirs and the concert promoter they’re suing for his death began questioning 104 possible jurors in a Los Angeles court Monday — and heard some off-the-wall excuses.

One juror said she believed karma, not a civil jury, should decide if negligence caused a death.

Another said she might have to renew her driver’s license ... in July.

Neither was immediately excused from possibly serving in the 90-day trial.

Judge: No more excuses for would-be Jackson jurors
By By LINDA DEUTSCH, AP Special Correspondent – 3 minutes ago
LOS ANGELES (AP) — A Los Angeles judge says except for medical emergencies, she won't consider any more excuses from potential jurors in the lawsuit by Michael Jackson's mother against concert promoter AEG.
Superior Court Judge Yvette Palazuelos received a flurry of last-minute notes Tuesday from people asking to leave the case because of scheduling and financial hardships they had not claimed earlier. She excused 10 more panelists from a pool of 87 and ordered attorneys to begin individual questioning.
One man declared he disliked Jackson and his whole family and thought Katherine Jackson's lawsuit blaming AEG for the singer's death is frivolous. He was excused because his employer wouldn't pay for his jury service. Other prospects were less outspoken.
Jury selection in the case is scheduled to continue Wednesday.

^^

90 business days trial - yeah nobody would want to be a jury and will express extreme opinions to be excused

Dont blame them. anyone with 2 brain cells would think this is a waste of time

It's a long time to be away from work or other commitments for anyone.

Is it just me or it feels like nobody wants to be on this jury.

I was thinking the same thing, and it seems some think it is frivolous, which it is to me. The person who said the case is about 2 people is right--about Katherine who wants money & about AEG who does not want to give it. The guy who dislike TII but did not see it is dangerous because he would make decisions that are not based on facts, so I hope they excuse him. The person who does not like the Jackson family and Michael will now hate Michael more because he will be mad that "they" made him waste time in this trial, so I hope he is excused too.

A problem is that if a person is on a jury & they do not want to be there, they can be vindictive or make a quick decision in order to end the jury deliberations. Jurors are humans after all with human failings.

Prospective jurors voice anti-Jackson opinions as week of questioning ends

By Associated Press, Published: April 19

LOS ANGELES — Lawyers have rejected some prospective jurors in a wrongful death lawsuit filed by Michael Jackson’s mother against concert giant AEG.

However, some of replacement candidates voiced strong opinions on Friday critical of the superstar singer. One man said Jackson was too weird and eccentric and he believed he was responsible for his own death.

The lawsuit claims AEG hired Dr. Conrad Murray as Jackson’s physician without checking his credentials. Murray was later convicted of involuntary manslaughter in the death of the superstar.

Another prospect who is the son of a doctor said he had strong bias against Jackson and thought that Murray did nothing wrong in treating the superstar. He said he knew that Murray had been convicted of involuntary manslaughter in Jackson’s death.

Two prospective jurors were excused for bias and lawyers for both sides used a total of five of their 16 peremptory challenges to remove panelists without giving a reason.

In plaintiffs turn, Atty asked judge 2 excuse juror 8 saying he's completely bias against MJ. He's discussed case w/ father, who's a doctor

ABC7 Court News ?@ABC7Courts 19 Apr
Defense argued juror 8 also said he can be fair, impartial and put his preconceived ideas aside.

ABC7 Court News ?@ABC7Courts 19 Apr
Judge denied plaintiffs request to dismiss juror 8 based on cause.

ABC7 Court News ?@ABC7Courts 19 Apr
Then it was about juror 6. Judge said she didn't need to hear argument and that he's dismissed. "He's got an attitude," judge said.

ABC7 Court News ?@ABC7Courts 19 Apr
Plaintiffs atty asked judge to dismiss juror 1 for cause. He argued juror said MJ needed to work on is ethics, but would not explain further

ABC7 Court News ?@ABC7Courts 19 Apr
Defense atty argued juror 1 is a very intelligent man that made clear he thought he could be fair and impartial in the case.

ABC7 Court News ?@ABC7Courts 19 Apr
Judge said she will give one more chance to juror 1 explain his answer, since she said she believes we're entitled to know his thoughts

ABC7 Court News ?@ABC7Courts 19 Apr

I know it's getting very confusing. Once jury is seated/sworn we'll tweet the details about each juror again. Have a great weekend everyone!

so AEG is going after the the anti-jackson jury while the jacksons are going the opposite route.

so AEG is going after the the anti-jackson jury while the jacksons are going the opposite route.

^^That is what I was laughing at too. The family wants the guy who sees AEG as responsible. Why were they waiting for that juror who could not understand English. How would this guy understand the technical words, etc. He should have been excused a long time ago. I am getting the feeling that this jury panel is not good for both sides. How are they going to be fair with such strong views. It seems some think Michael was weird and caused his death. I know they claim they could be fair, but if they had information on the Muarry trial and still think Michael caused his death, how are they going to be fair when they receive the information from this trial. Maybe once the group is whittled down to 12 plus alternates, the picture would look much better.

I agree with the guy who said that all that questioning goes beyond civic duty. I mean you have to state your business in front of not only the other jurors, lawyers, and judge, but to people sitting in the court and press--all of them strangers.

I am getting the feeling that this jury panel is not good for both sides.

you nailed it there. most people are finding excuses to leave the pool because they feel the trial is a joke and a sham.

Jury have been picked.

"Los Angeles (CNN) - A jury of six men and six women has been chosen to hear the Michael Jackson family's wrongful death lawsuit against concert promoter AEG Live.

Another six jurors must now be selected to serve as alternates in the trial, which is expected to last two or three months, in a Los Angeles courtroom.

Jackson's mother and three children are suing AEG Live, claiming the promoter was liable in the pop icon's death in 2009.

The judge has not set a date for opening statements and testimony to begin, although the trial opening could happen later this week".

AEG response: "The law allows each party to make peremptory challenges to jurors. However, they cannot strike jurors on the basis of race or ethnicity or gender or other protected classes. If this issue comes up at all - and it shouldn't, then it usually occurs when someone Strikes a series of potential jurors in row of the same gender or race, leading one to question whether peremptory challenges are being made on impermissible grounds. Even though this has not happened, Katherine Jackson's counsel nonetheless brought such a challenge today when I asked the court to dismiss a juror - even though I had not previously struck any juror from that juror's racial group and he replacement juror was in fact from his same racial group. There thus was absolutely no basis to even make such a challenge. And the judge found exactly that; she found that Katherine Jackson's counsel had not even met his burden of bringing the challenge. So, the Court's warning was just a reminder that the parties should conduct themselves ethically and without prejudice against any juror as the law requires. Of course, that is what we have been doing and will continue to do - as the composition of the actual jury demonstrates It was a baseless challenge and the Court appears to have recognized it as such." Marvin Putnam, attorney for AEG

^^Is Marvin telling the truth. From what the other reporter said above, it seemed as though the judge thought Marvin was removing people based on race.

After lunch, judge heard argument from Jacksons attorney that AEG was using their peremptory challenged to dismiss African American jurors
Jacksons attorney said that AEG was dismissing jurors just because they were black.
Judge Yvette Palazuelos strongly admonished AEG attorney Marvin Putnam and said she won't tolerate this anymore.

I see certain pattern here that Katherine's lawyers are playing by.
They say and do things, and then accuse AEG doing and saying those things.

Now they accuse AEG selecting or wanting white jury members, like it is automatically that white members will be on AEG's side and blacks on Jackson's side. I personally hate that sort of tactics, they put blacks and whites in certain category and assume that it is the color of the skin that determinate how they vote for verdict.

Katherine's lawyers were the ones that brought up the paternity of kids so they can go to tabloids and accuse AEG for trying to embarrass kids.
They also brought up Michael's molestation trial that AEG is trying to bring that up in this trial.

See the pattern?

^^^^ Yes I noticed that as well. Honestly, I wouldn't have the patience with KJ's lawyers, they would make me very angry and frustrated if I had to deal with them.

I can't see Katherine and her team winning this case at all.

The tactics are questionable too, even the award they're going for is ridiculous. I think they're just trying to throw everything they can at AEG, hoping that they'll end up received a much lesser (but still very large) payout at the end. If they went for a more sensible figure to start with, any payout would be smaller.

Katherine and her team are on a 'fishing trip' and it's going to backfire, especially as all they're currently doing is damaging MJ's image further, and that will only get worse as the case continues. Do they really want the abuse allegations, history of drug use, medical records, financial details and paternity issues all being brought back into the forefront of people's minds? :mat: It's so unnecessary.

Unfortunately if Katherine can't even get hardened MJ fans on their side, then they have no chance with an unbiased jury pool IMO.

At the end of the day MJ DID have a history of hiring multiple doctors to administer inappropriate treatments in the past. He was using propofol on previous tours. He had entered rehab in the early 90s for addiction to pain meds. He had sought out Dr Murray and arranged his services himself.
AEG didn't sign the contract of employment with Dr Murray, so Katherine's attorneys can't argue that AEG are legally responsible in any way. When MJ's health was questioned by AEG and Ortega, Murray denied there being problems.

There is a moral issue at play here, but no basis for legal case IMO.
