I would prefer that the charity just ceased. The estate will fund other charitable organisation and when the children are older they can start a charity in their fathers name if they so desire.

HTWF leaves a bad taste in my mouth, all that money used to fund those trademarks is just so wrong, the image of PPB being used by the likes of Mann, I could go on.

I agree Ivy and LastTear.
Its done and dusted, kids can start their own charity in Michael's name when they are old enough.
HTWF is not the same as it was when Michael started it, it is ruined now.

In not so surprising news 2 days before the opening brief was due HTWF's lawyer has filed a motion to withdraw as counsel due to non payment. HTWF is asking for 60 day extension to find a new lawyer

LOL! Not at all surprising.

Don't those fools know they are stomping with the BIG dogs!

If Johnson's not already broke, she will be broke due to her continued efforts to proceed with this case. Same thing goes for Howard Mann, in my opinion. Both throwing good money after bad thinking that some way, some how they will come out on top. NOT!

around 5-6 in the lower court lawsuit

this is the second lawyer that asking for withdrawal due to nonpayment in appeal court.

When is this circus going to end. These regular delays are becoming an inconvenience. At some point the court will have to say enough is enough. I mean people need to move on. I am sure the Estate wants that too.

Wasting everyone's money. They should fine people heavily who abuse the court system like this.

I'm waiting for the old, "STILL NOT PAID" lawyers to start suing Miss Melissa. (If they haven't started proceedings yet that is.)

I mean, if she can continue to "scrape up" retainer fees in order to secure a new attorney, then she can "scrape up" money to pay her old attorneys. I'm just waiting for one, or all of them to start coming after her!

Estate is probably agreeing with us all so they filed the following the motion.

The motion just asks the facts they listed below to be considered by the court while they are deciding about the lawyer withdrawal and 60 day extension for HTWF to find a new lawyer.

- March 2010, HTWF's lawyers Newman & Newman has requested to withdraw due to non-payment of lawyer fees.
- July 2010, Cohen IP law group became HTWF's lawyers
- Octorber 2010 Cohen IP Law group requested to withdraw due to non-payment of lawyer fees.
- November 2010 Edgar Pease became the lawyer of HTWF.
- May 2011, Pease requested to withdraw as counsel.
- May 2011, Barbag became HTWF's new lawyer
- August 2011, Smith Campbell Clifford became the new lawyers and also got an extension.
- January 2012, Smith Campbell Clifford requested to withdraw due to non-payment of lawyer fees.
- February 2012 Eveland Associates became the lawyer of HTWF.
- May 2012 Eveland Associates asked for an extension citing difficulties in obtaining transcripts and granted.
- August 2012 Eveland Associates asked to withdraw as counsel due to non-payment of lawyer fees.
- Opening brief is due on August 30th.

In other words Estate is trying to demonstrate the never ending hiring a lawyer, not being able to pay them, needing an extension cycle.

Thank goodness for that. I hope the court finally ends this nonsense or Melissa Johnson will keep on doing this for years.
She's obviously not interested in appealing the case as she knows what the ultimate outcome will be. Instead she's just obsessing with stalling the case as much as she can by abusing the court system.
Hopefully the court will realize that there is actually no benefit in granting another extension and deny her request, or alternatively makes sure the extension she gets is the very last one.

oh I think she wants to appeal the case but she doesn't have the money. The only time she had a lawyer was when Howard Mann was paying her legal fees.

But surely the Estate and the Court cannot be penalized for her lack of funding otherwise this cycle will never end. and that's essentially what's happening here. The case has been stalling now for 2 years not because of legal and logistic challenges but because of her own financial issues which should not be the Estate and the court problems.

If they had collected anything - assuming the collection was legit of course- they would have given it to the lawyer to stop him from resigning.

So if they could not pay the old lawyer, how are they going to pay a new one. Further, how are they going to entice a new lawyer to work with them, if the lawyer knows they have no money. It is a pity Oxman is on permanent forced vacation.

Well i know a director of the hwtw charity who seems to have access to unlimited funds to spend on lawyers. Surprised this person hasn't tried to funnel some of her vast allowance mellissa's way.
 
Appellants’ counsel motion to withdraw as counsel of record is granted. Court records shall be amended to reflect that Jeremy D. Eveland of Eveland & Associates is no longer counsel of record for appellants.

Appellants’ are inform that a corporation cannot represent itself. See In Re Highley, 459, F.2d, 554 (9th Cir. 2004). Within 21 days after the date of this order, appellants shall enter an appearance of new counsel. Failure to enter an appearance of new counsel may result in the automatic dismissal of this appeal.

The briefing schedule is reset. The opening brief is due November 9, 2012. The answering brief is due December 10, 2012. The optional reply brief is due within 14 days after service of the answering brief.

^^Haa so a corp cannot represent itself. I thought since Johnson keep going to court, by now she would be a legal eagle and know this. I had the impression that she had some other attorney in mind when she asked for the 60 days. Maybe she could see if one of Katherine's 7 attorneys does appeals, because she only has 21 days. Where do Johnson and Mann get money from to fight these dead end cases?

Right? Here we have a woman who lost her case and does not pay her lawyers, wasting the court's time over and over. I hope they take 1 day to make their decision, so this case can go away.

In my opinion, Mann was using his own money and the money he earned "pimping out" Michael's mother and 3-children, but now that Melissa doesn't appear to be winning, they have ALL left her high and dry.

Which is typical. I mean when they thought they had a chance of legally obtaining the MJ trademarks in question, everybody was on board. Appearing on Good Morning America with Robin Roberts, while making plans to divert some of the Estate's MJ charity monies into this fake Heal The World Charity.

Now that there are problems, (many, many problems) Mother and Company have run for the hills, which is what they always do. For them it's always: "Out with the old scam and in with the new scam."

So an update to the following

HTWF had 21 days to add a lawyer and until November 9 to file their opening brief. HTWF added a new lawyer in the last two days - they were late. They also did not file their opening brief.

As far as I know , the court clerk will now notify them saying that the brief is late and give them 15-30 days to file it. It's possible that the new lawyer will file a motion to ask for yet again another extension.

In other words the never ending HTWF lawsuit still continues.
