no family related reasons although I rather not provide the details

It's hard to say , it depends on the decision maker and they can give the extension but even if it's rejected they would be getting some time till the decision is made.

Haa sorry but I have passed the point of being upset and now comedy has set in. What is wrong with this woman? Where did the documents go? I hope they are not going to blame hurricane Sandy for misplacing these documents.

I have forgotten why this thing is still going on!!!

Ivy could have posted only one word - extension - and we would have known what is it about:D

Personal reasons - hmm. I guess she of out of her mind.
Inability to get/find some sealed documents?
What are the chances her getting/finding some sealed documents 60 days later if she hasn't got them by now?
I bet, if she gets extension, there is another 60 days extension after that, and another 60 days after that........
I'm probably six feet under before this case is thrown out or finished one way or the other.

Wasn't she just denied an extension for something else, or am I thinking of another case. At this point all these cases are becoming a blur to me.

This is just as I expected, they are given some time to file their opening brief and is also warned that this would be the final extension.

Haa don't worry ^^ I am confused too. I began all case threads with a clear mind, understanding what was happening, but now within my head is a fuzzy cloud. It seems she asks for several extensions & have been getting them.

The court should just dismiss this case. Melissa Johnson is clearly wasting everybody's time.

Really, this is an EXTREME abuse of the legal system. She's obviously trying to frustrate the Estate, which isn't fair. and I hope the court takes this into account as well. Holding the case like this for long against the Estate or any party for that matter is extremely prejudicial.

Legal system isn't quick but this time the delay is solely on Melissa. 2 lawyer leaving due to non payment, finding a new lawyer and multiple delay requests is the reason why there's no movement on this appeal.

I agree. There is a real problem if a case is stalled for this long because a person keeps dragging their feet. It's not fair to the court or to anyone else and especially during an appeals process. And Melissa is constantly getting new lawyers which means that they always have to start the appeals case over again and that is perfect evidence to me that she is just playing games with the court. She's been doing this for over a year at least. At some point, the appeal will have to either be dealt with or thrown out. But it got ridiculous a long time ago, in my opinion.

Not surprisingly Estate has filed an objection to the extension request and requested the court to dismiss the appeal for failure to prosecute

Now let's see what the good court will do this time. I will be surprised if they don't allow her this delay based on their previous laxity in giving her delays in the past. I guess the court's decision is based on law, but having got her way so many times, it seems Johnson keeps doing the same thing over & over.

There are several options now

1. The court will dismiss the case for failure to prosecute

2. The court will say no to extension request and give HTWF 1 to 15 days to file the brief

3. The court will give HTWF partial extension

4. The court will give HTWF the full extension they want.

Given that the court previously said they disfavor any more extensions I think options 3-4 is unlikely and either 1 or 2 will happen. Either 1 or 2 still means that hopefully this never ending extension cycle will end and this will come to a conclusion soon.

This case already once settled but MJ decided it wasn't good enough for her. Wonder if she still think she did the right thing? She'll be paying her attorney costs for several years:D

So judge is going to decide one way or other at the end of this month

wrong court , that's probate court and it's looking to estate matters and I'm thinking that motion to dismiss is about Tohme. HTWF one is being heard at California Court of Appeals.

there are multiple courts hearing multiple different things at multiple different lawsuit.

There's no time frame as when Appeals court will make a decision, Estate has filed their opposition and now they'll take it under consideration. Previous example shows that they take 14 days the longest, so I would expect to see a decision by January 24th.

I suppose it not that the estate is asking to dismiss Tohme's claim or is it? Might be too much to wish for:D

because probate documents/filings aren't available and at best we can take guesses. as to who is filing a motion to dismiss, to dismiss what exactly etc. would probably be Tohme and we will know it when we see the probate notes on January 30. Actually I tend to wait until I collect all information and so on.

let's play a game...we all know that come February 25 2013, Melissa Johnson will ask for another extension. who can guess her next excuse ( or exceptional circumstance as the appeal court calls it)? I think this should keep us busy until then.

Insane. You read things like that and stop to wonder why so often Michael didn't want to fight in court and just chose to settle.

Wonder what % the judge is on for lawyers fees if he keeps dragging this out. naive or stupid??
