R. Smith, R. Jones, C. Rubin vs M. Jackson [1987 - 1994 copyright lawsuit]

Robert Smith, Reynaud Jones and Clifford Rubin have filed a complaint at court on 11/17/1987. A federal jury has ruled on this in favour of Michael Jackson on 01/12/1994.

Am I concluding correct by saying all evidence brougt in front of court/jury (in this case the song titles mentioned in Michael's videotaped Mexico deposition) had to exist prior to the day the suit was filed? Any experts in US law around here?
