He was likely surprised the guy knew it existed. Mike Smallcombe believes it to be HIStory era, and if that is indeed the case, it would've been freshly written at the time of the deposition.

the estate is so damn smart for the way they are putting out the material they have. there isnt a single track they have put out that is in 100 percent complete/mixed in the best way possible. they are gonna milk michael's released demos DRY with "remasters", alt mixes and extended versions, and everyone will eat it all up.

It seems as though they were given access to MJ’s personal collection of song tapes. Most of the unreleased songs they named have never been registered.
