Michael Jackson physician Dr. Conrad Murray pre-trial motions to begin

CBS/KCBS/AP) LOS ANGELES - A judge is expected to hear pre-trial motions Monday in the trial of Dr. Conrad Murray, Michael Jackson's personal physician who is accused of involuntary manslaughter in the June 2009 death of the pop star.


Prosecutors want the jury to hear evidence that the Los Angeles Police Department and the L.A. County Coroner's office tried to reach Murray on four separate occasions, but he never returned their calls, reports CBS station KCBS.
A jury of seven men and five women were selected out of 84 prospective jurors for the trial, which is expected to begin Tuesday.

Murray has pleaded not guilty to involuntary manslaughter. His lawyers have said Jackson was contemplating calling off his ten-concert tour, "This is It," if he couldn't sleep. Murray told police he was giving Jackson the anesthetic propofol as a sleeping aid.

The prosecution claims Murray , a Houston cardiologist, was grossly negligent in administering the drug at home without the proper equipment, and then left the room long enough to find his patient not breathing when he returned.

Murray's defense claims the singer, desperate for sleep, swallowed an additional dose of the drug when the doctor was out of the room.

The defense's theory is based on evidence that a trace amount of propofol - .13 milligrams - was found in Jackson's stomach. The drug is administered intravenously, usually during surgery. Scientific witnesses may be asked to explain how it could have gotten into Jackson's stomach. Some doctors say ingesting it orally is almost unheard of.

The prosecution has a key expert witness, as well as forensic experts from the Los Angeles County coroner's office who are considered at the top of the field.

The defense boasts an advantage in one of its lawyers, J. Michael Flanagan, who says he is the only California attorney ever to try a propofol death case.

Murray, who had been consulted by Jackson in his Las Vegas office, was promised $150,000 a month when he signed on as Jackson's personal physician six weeks before he died. He closed the doors of his offices there and in Houston to devote himself to the singer.

Murray said he had been giving Jackson drugs known as benzodiazephines to help with his insomnia, but when they didn't work Jackson demanded propofol.

The physician told police he was trying to wean Jackson off the drug and gave him a minimal dose, then left the room for five minutes to use the bathroom. However, cell phone records suggest he was making phone calls for a longer time. His actions after he found Jackson not breathing are also central to the case.

Jackson died of a propofol overdose in June 2009 at his rented mansion in Holmby Hills, an affluent neighborhood in West Los Angeles.

LOS ANGELES (KABC) -- Lawyers were in court on Monday morning for a final day of pre-trial motions in the involuntary manslaughter trial of Dr. Conrad Murray.


Judge Michael Pastor denied a request from the defense to show video of Michael Jackson during a press conference announcing the "This is It" tour in London.

However, Pastor sided with the defense on the prosecution's request to tell jurors about multiple attempts by authorities to talk to Murray just days after Jackson's death. Defense attorneys argued that Murray could not be blamed for the lack of contact because authorities contacted his attorney, not him.

Pastor agree, but said he would revisit the issue if the defense tried to attack the way police conducted its investigation. Opening statements in the high-profile trial are scheduled to begin on Tuesday. Testimony about the powerful sedative propofol is expected to dominate the case.

It has been two years since the sudden death of the Michael Jackson, but this week, a jury and the public will hear Murray's account of how the pop star died at the age of 50.

Murray is accused of administering a deadly dose of propofol to Jackson, and then failing to properly monitor him.

The Jackson family has taken to Twitter in anticipation of the massive media coverage.

Of course is irrelevant the TII annoucement! Everything they try it's irrelevant!

Fact : MURRAY INJECTED THE PROPOFOL WHICH CAUSED THE DEATH.

That's it. No need more, with that he will go in jail, and will not be allow to practice anymore.

If we don't have this at the end of the trial, THERE IS NO JUSTICE!

And with what we saw with Troy Davis, I'm afraid that there is no justice in US

Because Murray was never required to contact anyone. That is what lawyers are for

yes Ben that is true...guess he is trying to keep everyone focused on that date only. Another good friend of mine told me the same thing,,,Judge Pastore...wont have any junk going on in that courtroom.

That's what I think too. In the end of the day what happened months prior has nothing to do with what happened in June so I'm glad Pastor has put his foot down here.

A day before opening statements in the trial of Michael Jackson’s personal physician, a judge ruled jurors will not see video of the pop star’s final news conference.

Lawyers for Dr. Conrad Murray had argued that the footage showed Jackson “under the influence” in public three months before his death and that it established the singer had agreed to a comeback concert series of just 10 “This Is It” shows and not the 50 ultimately scheduled.

But Los Angeles County Superior Court Judge Michael Pastor noted Jackson never mentioned the number of shows in the video and said that it was irrelevant to how he died, the issue at Murray’s trial.

“The proposed evidence is not relevant to what may or may not have happened on June 25, 2009, or shortly beforehand,” Pastor said.

The judge also ruled that prosecutors cannot tell jurors that investigators made four unsuccessful attempts to re-interview Murray.
The physician and his lawyer met with police for a lengthy interview two days after Jackson died, but an e-mail and phone calls to the attorney and Murray’s office were not returned.

Pastor said it was not clear whether Murray ever received the requests.

The 58-year-old cardiologist faces four years in prison and the possible loss of his medical license if convicted of involuntary manslaughter.

Prosecutors contend he grossly violated medical norms by providing Jackson with propofol, a surgical anesthetic, at his home.

The defense maintains Jackson dosed himself.

Jurors in the upcoming trial of Michael Jackson's doctor won't see a recording of a press conference by the singer promoting his final concerts, a judge ruled Monday.

Defense attorneys for Dr. Conrad Murray had wanted to show the footage, claiming it showed Jackson wasn't healthy and had only committed to 10 shows. By the time of his death, the singer had been committed to 50 shows at London's O2 arena.

Superior Court Judge Michael Pastor ruled the March 2009 press conference wasn't relevant to the involuntary manslaughter case against Murray, which will focus on the pop superstar's final weeks and hours.

Defense attorney Nareg Gourjian said that according to promoters of the shows, Jackson's press conference was delayed 90 minutes because the singer was passed out and appeared to be "hung over."

Pastor said showing the footage would be prejudicial and the defense's request included speculation that should not be shown to jurors.

The judge also blocked prosecutors from mentioning efforts by investigators to speak to Murray after his initial interview with police days after Jackson's June 2009 death.

The rulings were some of the final bits of housekeeping before opening statements, set for Tuesday.

Murray has pleaded not guilty. He could face up to four years in prison if convicted and the loss of his medical license.

Authorities contend the Houston-based cardiologist gave Jackson a lethal dose of the anesthetic propofol and other sedatives. Murray first disclosed he had been giving Jackson the anesthetic in the bedroom of the singer's rented mansion during his interview with police.

Murray's lead defense attorney Ed Chernoff disputed whether authorities left messages seeking another interview with the physician. Ultimately, Pastor determined attempts to contact Murray through his counsel should not be brought up during the trial.

The bolded part - I hope so. Other than that, the judge really seems to want to keep the trial focused and as short as possible.
 
So the hearings over with just rulings on those two things. nothing on chile?
 
You remember the research about swallowing propofol? With the volunteer students? I was wondering if I had missed it. Still nothing on this? It's a rather important question though.

Thank you for reminding me...I've seen nothing yet but will keep a look out for anything that comes up. :) There is nothing yet to say that the court session has finished. (I don't think, anyway..??)

Michael Jackson death: Choreographer Ortega to be first witness

Famed choreographer Kenny Ortega will be the first witness to take the stand at the trial of Michael Jackson’s doctor, a prosecutor said Monday.

Ortega, famed for “Dirty Dancing” and “High School Musical,” was the co-creator and co-director of the “This Is It” comeback concerts Jackson was preparing for at the time of his death. In a hearing earlier this year Ortega said the singer’s personal physician, Conrad Murray, assured him that Jackson was healthy enough to perform and even scolded him for canceling rehearsals when Jackson seemed weak.

“Dr. Murray told me that this was not my responsibility and asked me to not act like a doctor or psychologist ... and leave Michael's health to him," Ortega said.

Prosecutors contend that at the time Murray brushed off Ortega and other concert executives, he was giving Jackson nightly doses of the surgical anesthetic on which the singer later overdosed. In comments to a judge Monday, Deputy Dist. Atty. David Walgren said he planned to summon witnesses in a chronological order leading up to and then following Jackson’s death.

Ortega is to be followed to the stand by Paul Gongaware, who worked for Jackson’s concert promoter, AEG Live. Gongaware, according to another prosecutor, will also testify about conversations with Murray and Jackson.Deputy Dist. Atty. Deborah Brazil said Gongaware would testify about a meeting in which he and other AEG officials “were sharing their concerns with the defendant concerning Mr. Jackson’s health.”

Murray, 58, stands accused of involuntary manslaughter. His trial begins with opening statements Tuesday and is expected to last about five weeks.

I thought Michael looked great at the press conference. Once the opening statements are over fo they go right to the first witness? I am scared about this.
 
I love the way the pro's are presenting their witnesses, the drugs Murray was giving Michael other than propofol will follow in due course and have more of a wham as to what Murray was doing to him. Way to go Pro's
