Estate, Cascio and Porte Sued Over Three Songs on the "Michael" Album - Vera Senova Class Action

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

Why shouldn't we believe it? Eddie specifically claimed he wrote the songs with Michael. We didnt find out until much later, from his brother Frank, that a version of the same songs were being used for Bobby Ewing's album. e.

Actually, Friedman, in his very first article on the songs, said he had heard them years before, with James Porte on vocals -- Porte being Bobby Ewing, of course.

This is funny but have we guys noticed that this thread has evolved into the great debate. I guess this happened because we have no new news about the filing.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

while I agree with what you said, could you please refresh my memory in some regard. Weren't there some TMZ articles from unnamed sources citing Prince and Paris and saying stuff like these aren't the song they heard? I remember it being repeated quite often back in the day. So is it no one heard anything or Cascio's heard nothing and PPB heard everything?

I'm pretty sure that's a claim that was hinted by Anti-Cascio researchers - that Malachi was in NJ. Don't ask me the logic or details though, I ain't in the elusive group.

I was thinking about that when I wrote it, you make a good point, but again, we'd have to assume what everyone may have been doing at the time. The articles quote mostly Paris, and as we've come to know Paris was daddies little princess and her father was her world. Children like that tend to cling to their parents, perhaps she was closer to Michael, as in downstairs with him to actually hear what was being recorded. I don't know....You raise a valid point though.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

If it is not Michael, any theories on when this impersonator recorded the vocals?

You never answered my post directed to you before. Since you want to believe the voice on these tracks are Michael, could you present some examples on the Cascio songs which sound identical to previous Michael vocals from another song? Can you provide an example of a prior Michael vocal from any song in which he sounds like he does on the Cascio tracks?

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

Jason Malachi went on vacation between February 20 and March 1, 2010. Two and a half weeks later, Angelikson filed copyright registrations for what is believed to be the 12 songs.

So that's one possible time period.

So as Jason Malachi was about to commit a criminal act in the US, he chose to broadcast to the world wide world -- on Facebook even -- that he was overseas, thus both raising suspicions as to his actual whereabouts -- since everybody from his friends to his family to eventually the police were bound to notice he had NOT been overseas -- and destroying any possibility of an alibi, since he could no longer claim he was at home with his wife as the deed was being done.

Basically, Jason Malachi chose to cover his absence from home to commit a crime by freely and willfully claiming publicly that he was in the one place where it would be child's play to prove he was not.

Because if that theory is right, all anybody would have to do to basically prove he's guilty is look at his passport. If he wasn't overseas when he said he was, that's evidence of his crime.

So Jason Malachi is the stupidest criminal of all time, who's also pulled off the perfect crime.

At least one of those tracks was originally co written and produced by Eddie’s brother Frank Cascio for an R&B singer named Bobby Ewing.

Some of the songs were already written by Eddie’s brother Frank Cascio and recorded as demos with a local singer named Bobby Ewing. Michael put his vocals on them during that time he stayed with the Cascios in New Jersey.

Both Frank and Bodyguards have said that the kids were in school at that time at the upper levels of the house. So that would remove school hours and late night time (assuming they go to bed at a reasonable hour) and only leave after school before bedtime to hear anything. Not that we can know for certain. But like I said I agree with you, my friends have a home studio in a 3 story house with proper sound proofing. You can only hear muffled sounds. So I think to be able to identify what is being recorded someone has to be inside the studio.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

It's almost as if Malachi was hinting at something here. Let's remember this interview was conducted a few months after his twelve songs had been successfully sold to Sony Music as "Michael Jackson tracks." I imagine he was probably on cloud nine at the time and thinking pretty highly of himself.

Edit: And another quote...

Hearsay from some guy.

When the Estate called up Malachi, his "manager" basically bragged about it on his web site, as if he was amazed big-shots like the Estate would condescend to call nobodies like them (that was before the statement came out). He did not sound like somebody who had something to hide or wanted to play a game with the Estate by doing the old "maybe it's him, maybe it ain't" routine.

And the Estate's lawyer "confirmed" with Malachi he had nothing to do with the songs. Which, unless we're to believe that a high-priced attorney just asked Malachi for an informal denial -- which would be useless as OF COURSE he would deny being on the songs even if he were --, means Malachi was asked for some official denial, maybe a promise to appear in court, or maybe an affidavit. So it's safe to say that Malachi denies having anything to do with the tracks as clearly as he can. It might still be him, but he's certainly NOT pulling the "I neither confirm nor deny" routine : he denies.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

His posts were vague, the timeline raises doubt and worthy suspicion that he may have been recording these songs while on "vacation", there's no doubt about that. He wasn't outing himself to the world because the world doesn't know Jason Malachi. And you're writing as if this is some major crime that'll give him jail time, Police involvement is very very slim. If proven in court that hes the singer, I'd assume this will be extremely similar to the Milli Vanilli case, in which the label were made to refund album proceeds and to credit and SHOW the actual singers on the cover of future albums, under their own names, as opposed to the duo "Milli Vanilli", Rob & Fab. That will probably be the similar fate the defendants will be met with, if not made to repay album proceeds in California, they'll in most likelihood be made to remove the Michael Jackson name, and if they choose to release these songs, they'd have to be released as Jason Malachi on a Jason Malachi album.

I don't think anybody in the house would necessarily know what songs were being recorded, like I don't expect Papa Cascio to remember he heard "Soldier Boy" when he once went downstairs to tell MJ the meatballs were getting cold, but certainly the whole family would know if MJ was recording little Eddie's songs in their own house. There's no way the subject would never be raised between the summer of 2007 and the day the songs were revealed : "oh by the way guys, I never mentioned this before, but remember in 2007 when the biggest star in world history lived a few weeks with us? Remember how he'd disappear for hours in the basement with me and James? Yeah, he was actually recording 12 of my compositions, which was the single greatest event in my life. I don't know why I forgot to mention this for years to my own family, with whom I live everyday of my life, and to whom I had no reason to keep this information private, especially since we talk about MJ all the time".

That's why I say that if a hoax happened,

actually thank you for reminding me this. Yes Malachi's manager blogged about Estate calling him - before any song release and Estate statement. So that confirms one part of Weitzman's statement.

Btw when I messaged Malachi's manager he had no problem with me posting his reply to me and hence I did a screenshot I believe.

Unless he wanted to get caught, why would he say he's overseas when he's not?

And if he wanted to get caught, "because it's not such a big crime" (oh really), why hasn't he confessed?

And if he really was overseas, when did he record the songs?

And how long would it take him to record the "complete" songs that you guys say MJ couldn't record in several weeks? A few days? Months? Because the timeline has to work.

Does anybody have his posts from 2008? Even before MJ passed away, I had a feeling he was onto something... It went along the lines of "there are rumours I'm helping to promote Michael... You'll see". Gut feeling made me think he would be collaborating with Michael but I had this uncanny thought he would be in an album where you'd have to guess who's singing...

He certainly would'nt say he's being used to record supposed Michael Jackson songs. That's for sure.

This isn't a big crime in terms of the repercussions, no one is going to jail over this. There are different stages of fraud, some worse than others. This would be toward the lower end. And again, there IS a confession out there from his official account, now whether you want to believe it was actually him or if he was "hacked" is up to the individual.

I'm not of the opinion he was actually overseas, so yeah...

You could continue to doubt the timeline as much as you'd like, fact is, none of this is consistent with any of Michael's past habits. Regardless of who wrote the song or if he wrote it himself, it takes Michael months, sometimes years to complete just one song, from all we know, that never changed up until the very point his life ended. If it did, we'd have the music to show for it, admittedly, little of what the Estate has is neither near completion or completed. Which means Eddie Cascio is essentially the only lucky producer who was blessed with 12 complete songs by Michael Jackson, and we're to believe Michael completed all 12 of these songs in a matter of a few months, and this would be the only songs of their kind, considering Michael's meticulous recording process. Just these 12 songs throughout an entire lifetime, he managed to fully complete in a matter of months, and we're to believe Michael was happy enough with them to leave them like that and to destroy all the alternate takes, and he was this happy with 12 songs that took only months to record. It doesn't add up, he spent exactly three months there, combined with them having to build the basement studio, the work done there for T25 and these twelve songs, that would mean at least one song was recorded and happily finished off every other day or so. That may be possible for the average artist, but again, we all know Michael's standard for his work, and once again, that would make the Cascio tracks the only one's of it's kind. It just doesn't seem very likely.

Eddie Cascio: producer/student

Eddie Cascio

Head of a company receiving royalties on his own songs and soon to be out of college, Eddie Cascio (C'04) has a world of opportunity ahead of him. Only two years after starting Angelikson Music, Cascio was working with high profile celebrities such as Luther Vandross, *NSYNC and Usher.
However, like many, Cascio began in music by taking piano lessons which his parents signed him up for. Cascio found a love of writing music while still in high school.
Through a family friend with connections in the business, Cascio began writing for Sony/ATV Music publishers in New York. Sony/ATV writers have ranged from Joni Mitchell to Destiny's Child.
However, after about one year, Cascio decided that working for himself would be a better solution. "If you want to make it in this industry, you have to own what you do," says Casio. He went on to explain how "owning my own company makes me want to write more."
Using his newly formed music industry contacts, Cascio created Angelikson Music, founded under the studio name Angel. Today, Cascio's business has really taken off to new heights. Cascio worked on *NSYNC's song, "Fallin'" and music for Vandross' "Think About You." Cascio recently worked on songs for Usher's upcoming album, scheduled for release in early November. He also is excited to be producing some new up-and-coming artists, such as Bobby Ewing. After finishing a copy of the album, Cascio hopes that a record deal will be in the future for Ewing, with Cascio himself as producer.
Balancing both college and his music career has been tough, yet both have been very important to Cascio. After graduation, he plans to continue with the musical track, however he says his sociology degree from Drew will still be of great help. "I have a better understanding of people," explains Cascio. "I use what I learn at Drew as a basic knowledge on which to build, as well as it helping me with my creativity in writing."
Casio is thrilled to be in the business of his dreams, explaining, "I'm very grateful for all the opportunities I've had in my life so far."

Where is that "SLIDESHOW" album?:

20/07/2006:

"It’s a fresh new start for music manager and mogul, Frank Dileo, who has re-entered the music scene with new projects. The first of such projects is new recording artist, BOBBY EWING.

Frank Dileo is remembered as the former manager for Michael Jackson from 1984 to 1989. Prior to that he was a record executive at Sony Music then called CBS Records.

THE SLIDESHOW is currently the working title of Bobby Ewing’s upcoming album which will be produced by Bobby Ewing & Frank Tyson"

Why did the journalist updated the info in 2009?. -_-

So you really think the voices in this comparison Birchey posted are two different ones? No offense, but I am seriously surprised that someone can think so (let alone think that it's MJ of course).

This was made several years ago during my case, a friend sent it to me last night, I'll share the link. Its a mix of Burn Tonite and Mamacita, its demonstrates clearly that Jason is interchangeable without notice on his own and the cascio tracks.

I thought that he sang the "Jackson-Backround"-Part in Breaking News.

I wanted to see if there is something that he realesed by himself.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

^^I think the songs "Exotic Dancer" and "Angel in Disguise" are from him, i don't know.

EDIT:
I said it is James Porte, because his voice sounds a lot like the 'one' on Breaking News.
When he sings: "Jackson!"

(Everybody wanted a piece of Michael Jackson!)

It's sounds a lot like the Lead Vocal.

Yes, those are his songs. "Exotic Dancer" can be found on the internet.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

I can clearly hear James Porte on backing vocals (particularly on Monster and Stay). He plays a role similar to Dr. Freeze: he sings the chorus but isn't credited in the song title as most featured artists are. I personally don't think he's singing lead vocals, though; I'm dead set on that being Jason Malachi.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

Here is his only song available online, which by the way is obviously the same voice as a lot of the background vocals in these fake songs.

Somebody (AlwaysThere?) mentioned that, far from being « guide vocals » or « demo vocals », all 12 Cascio songs are actually quite complete : they have complete verses and choruses, a bridge, and ad-libs. And it’s true : they are complete in the form we have now. But just how much of those songs feature vocals by the person we’ll refer to as « the Cascio singer »? We know there’s a bunch of ad-libs that are from earlier MJ songs. And we also know there is James Porte on there. We know it because he’s listed as being on the songs, and obviously Eddie/James would have no reason to say he’s on the tracks if he isn’t. So where is James on the songs? Can we point out any part where it’s him, and other parts where it’s the Cascio singer?

Let’s take Burn2Nite as an example. Is the Cascio singer actually on the chorus? I’m not sure I hear him distinctly. And is there really a bridge? Not really : there’s an instrumental passage, with backing vocals that might not even be the Cascio singer. And the ad-libs at the end seem to be partly a repetition of the word « burn » from earlier in the song. So really, on Burn2Nite, you only have two verses of the Cascio singer, and maybe some ad-libs here and there. So even though the song as we have it seems complete, isn’t this a good example of a song where maybe all Eddie had was MJ on the two verses, and some ad-libs from him, and he combined that with James Porte’s vocals to create this instant MJ classic, Burn2Nite?

This is something that has not been done: an analysis of each Cascio song to try to determine where the Cascio singer ends and where James Porte begins.

This I could answer 100% unfortunately, its because of the screenshots I have from the ProTools sessions, which I got with evidence from my case, which is locked away safely. But I did this very thing with Water, I lined up a screenshot of the "MJ" lead vocals takes and all the harmonized backing vocal parts, and created a scrolling video in time with the music. Good thing is you know exactly which parts Porte is on too, as he is the "Ghost" backing vocalist. There are other backing vocalists named on the tracks too. If its legally allowed I will give this info to the plaintiffs lawyers.

Re: Estate, Cascio & Porte sued - Forensic Analysis says MJ is NOT singing the 3 songs on "MICHAEL"

Much is made of the fact that Eddie supposedly told people he had lost/destroyed the hard drives with all of the outtakes. Let's assume that he really did say that, and wasn't misunderstood or lying.

Isn't this point moot anyway? Whatever he had when MJ died is on that CD he registered with the Copyrights Office in June 2009.

So either he did delete/destroy a bunch of alternate takes, in which case he did it before MJ died, which means he's telling the truth, as strange as it may seem to us that precious outtakes wouldn't be preserved.

Or he did no such thing, in which case whatever is on that CD in the Washington Copyright Office's vault would bear no resemblance to what ended up on "Michael". So this registration is the key to everything : Eddie basically painted himself in a corner by filing it two days after MJ's death.

So my question is : wouldn't the Estate have checked the contents of that registration as soon as issues were raised? They'd be allowed to anyway, as Michael Jackson is one of the three registrants. In fact, woudln't the Estate be informed of the registration as soon as it was made?
