LOS ANGELES—A judge who presided over the trial of Michael Jackson's doctor refused Friday to release him on bail, saying he would be a danger to any community where he might try to practice medicine.

Conrad Murray's lawyer asked for his release pending appeal of his involuntary manslaughter conviction, but Superior Court Judge Michael Pastor said he saw little chance that Mr. Murray would prevail in getting his case overturned.

Judge Pastor made it clear that his view of Dr. Murray hadn't softened since he gave him the maximum four-year sentence in the superstar's death. He suggested Dr. Murray hurt his own chances for freedom in a documentary interview broadcast after the trial saying use of the powerful anesthetic propofol in the home was appropriate.

Mr. Jackson died in 2009 of an overdose of the drug that Dr. Murray administered in his bedroom as a treatment for insomnia. Expert witnesses testified they never heard of anyone administering the drug outside a hospital.

"I didn't tell Dr. Murray to give an interview for a documentary," the judge said. "When he did, I listened to it and saw it and I was concerned about his attitude toward the use of propofol in the home. ...What he believes scares me."

Judge Pastor also believes Dr. Murray, who was born and raised in the Caribbean, would pose a flight risk if he leaves jail. He said the doctor could go to a foreign country that might allow him to practice medicine, and anyone encountering him as a patient would be in danger.

"He was raised in Trinidad and has seven children by five women in different parts of the country, which does not reflect well on his stability," Deputy District Attorney David Walgren argued during the hearing.

Defense attorney J. Michael Flanagan petitioned for Dr. Murray to be released on bail, his own recognizance or under house arrest with an electronic ankle bracelet. He and appellate attorney Valerie Wass said Dr. Murray should be free during his appeal.

The judge, however, said the defense hasn't shown there is any substantial legal question likely to result in reversal of the verdict."No trial is perfect," the judge said, but nothing cited by Mr. Flanagan rises to the level of legal error.

Mr. Flanagan and Ms. Wass said the appeal issues would include Judge Pastor's refusal to sequester the jury and his decision to allow broadcast of the trial. Judge Pastor said he is confident those rulings and others were legally sound.

He also said he wouldn't reconsider the bail request in the future. "This is my last statement on this matter," he said.
Under current sentencing guidelines, Dr. Murray is likely to serve about half of his four-year term.

Wass claims that widespread publicity was a substantial factor in Murray’s conviction.
The judge said he was not persuaded by Murray’s defense claim, nor did it meet the legal standard of clear and convincing evidence that sequestration would have changed the outcome.
“I have never heard of a case overturned based on failure to sequester,” said Pastor.
Murray remains jailed in one of the nation’s most crowded facilities. Wass said he is spending 23 hours a day in solitary confinement at the Los Angeles County Jail.
“He is lucky to take a walk on the roof for one hour on Monday evenings,” said Wass. “I visited him two days ago and he’s lost about 30 to 40 pounds, but Dr. Murray is in good spirits.”

Jaydom good one, and since he has the same symptoms should we say, like muarry and his team did, that it is due to excess amounts of demerol? Aren't they the ones who claimed that Michael's lack of sleep was due to demerol? I hope now he sees how people could make outlandish claims about what caused another's symptoms.

About Wass, didn't she read that Muarry's appeal to have the ruling about sequestering the jury overturned was declined by the judges. Why is she still blaming Muarry's guilty verdict on a lack of sequestering. she is another one who does not know why Muarry was found not guilty. Apparently she did not listen to evidence showing he abandoned his patient in a dangerous situation--that is why he was charged with manslaughter.

Alverez too, used the wrong words to help Muarry, since many dads who were the main support for their children are in jail. If we turn criminals loose because they have children, then a lot of crooks will be committing more crimes in our communities. What is so special about Muarry that qualifies him to have some special treatment in that regard. I suggest she keep visiting her man in prison and continue to work to take care of her child. There are many women in her condition.
 
I feel sorry for Murray's kids, don't feel sorry for Murray. And I think the media is exaggerating about the treatment he's receiving in jail, which is a shame because that's probably how it should be, according to what they say.

This is the best news I've heard all week. I'm glad they are not allowing that scum out of jail (which he's lucky isn't a prison).

Theoretically, it could happen, not that I believe it either. But if it is true, who cares? B-tch needed to lose weight anyway--he should be thanking prison instead. Protection from everyone who wants his ugly head on a lance (plus those creditors who still want his a--) and free Jenny Craig.
 
Well I think it's a crying shame to leave him locked up in solitary confinement for 23hrs a day, for crying out load at least let the man walk around and mingle!!!!
 
^^ ^ Yes if he is crying about his private cell .. place him in with the general population and very quickly he would be crying to get back to the safety of his confinment .. I bet his attorney will never start a motion asking for him to be allowed to mingle with general population. I find it odd they complain about him being in a soliatry cell being they know its for his own safety and not for cruel and unusual punishment for his crime.

That's the big problem ^^ he is from another country. What if he decides to go back there and live and skip bail? I was even thinking that without his licenses he could return to his native land and work as a doctor there. If he had patients here who knew what he did and still went to him, then it is possible that there will be some nuts in his native land who will use him as their doc too. All he has to do is to charge them less money.

Let's face it jail was not made as a vacation spot--it is not Vegas!!! What did he expect? You are confined there to think about what you did, rehab yourself, and meanwhile the society is protected. I am getting tired of his lawyers crying about how jail-like his jail experience is. There are thousands who share his experiences in jail.

Don't think it's PR, so far the reaction from the general population [meaning non-MJ fans] has been pretty negative. It sounds to them like he's seeking some sort of special treatment, and that kind of behaviour even on a general level does not warrant sympathy. They know if it were them in the same situation, they most probably wouldn't get any sort of special treatment or release pending appeal, so watching somebody think he deserves that and try to get it is aggravating at best.

I think it was just a half-hearted attempt by the attorneys to try and get him freedom just for the sake of trying, an attempt which predictably ended in failure. Even Nicole Alvarez's letter was pretty much devoid of emotion. If it were a PR attempt, I think they would have played her up more, since she and the kid are the two more sympathetic figures out of her, CM, and the kid.

Yeah, someone should remedy that. Let him walk around and get to know the place and his fellow inmates. Y'now, the full experience. Personally, I think 23 hr solitary confinement is doing him a disservice, especially when Bubba and all sorts of charming people are just itching to see and talk [maybe more?] to him.

But Chernoff, Flanagan, and Baldylocks were cruel to him and got him solitary, under the pretense of his "safety." Really, they just like to see him suffer, and that's not very fair. He could be having tons of good old fashioned prison fun with his new friends, but his dumb lawyers won't let him partake in any reindeer games. :(
