The family of late pop icon Michael Jackson has subpoenaed a Franklin Lakes author, seeking his testimony as part of their ongoing wrongful death suit against AEG Live.


In legal documents filed this week, lawyers for Jackson’s parents and three children subpoenaed Frank Cascio, who detailed his friendship with the King of Pop in a book called “My Friend Michael: An Ordinary Friendship With An Ordinary Man.”


John Perez, a Newark attorney working in concert with the Jackson’s California-based legal team, confirmed Wednesday that subpoenas were being delivered to “several witnesses” as part of the pre-trial discovery process. Perez would not discuss his involvement with the case beyond that.


Cascio has been asked to report to an Iselin-based legal office on Aug. 14, where he will answer questions about his friendship with Jackson.


The Jackson family’s suit, which was filed in California in 2010, lists entertainment conglomerate AEG Live as well as the producers of the posthumous Jackson documentary “This Is It” as defendants.
It is expected the trial will commence in early 2013.


The suit accuses AEG Live of negligently hiring Dr. Conrad Murray to care for Jackson. The suit contends AEG Live “somehow forced Mr. Jackson to receive dangerous medication from his physician,” according to court documents.
Murray was convicted of involuntary manslaughter in Jackson’s death June 25, 2009 death and was sentenced last November to four years in prison.
Jackson was set to perform a string of 50 shows in London for AEG Live, but died of acute propofol intoxication in Los Angeles while rehearsing for the concert series.
The negligence suit is by Jackson’s mother, Katherine, on behalf of herself and her son’s three children, Michael Jr., Paris-Michael Katherine and Prince Michael.
The suit alleges the company was negligent in hiring Murray to treat Michael and claims the conglomerate is also responsible for the medical decisions Murray made.


This week’s subpoena asks that Cascio also provide the Jackson family’s lawyers will any and all documents he may have related to Jackson, Dr. Murray, the “This Is It” documentary and his published book.

Sounds like Katherine's attorney is scraping the bottom of the barrel, in a desperate attempt to find something useful. But I seriously something "useful" will come from Frank.

What is Frank going to add to help show that AEG hired Muarry and caused him to use dangerous drugs on Michael? What documents does Frank have to help them in this case, and what information from his book or relationsihp can he provide to help? These antics from the lawyers are beginning to sound more like the antics in that Jackson letter. Maybe they are going to say that Frank saw Michael taking drugs, then AEG made Muarry give drugs to Michael, and AEG should know that Michael had a history. Yet, isn't that the same thing that AEG will say given their questions about interventions. Oh dear....

Why call Frank? He can only hurt their case and AEG will use him to its advantage. According to Frank's book, Michael used to take pain medication way before 2009 and he details the ocassions he saw Michael under the side effects of the meds.

This is crazy. The family wants to sue for money, brings someone who can help them lose their case and AEG will use all that ammo against Michael. No matter what, Michael is always the one taking all the dirt.

This is crazy. The family wants to sue for money, brings someone who can help them lose their case and AEG will use all that ammo against Michael. No matter what, Michael is always the one taking all the dirt.

Aquarius sometimes I get the feeling that they will willingly show Michael in the most horrible light in order to get money from AEG. It is almost as though they are saying that if we do not win, we will do enough damage as possible.

What lawyer convinced them that they would win this case anyway? We all know what happened to Chernoff's firm.

This reminds me of Chernoff, Flanny and baldy calling Randy Phillips, Cheryl Lynn Lee, Dr. Metzger and and the police detectives to help Murray. These witnesses only helped Walgren bury conrat murray. They had no defense just like KJ has no case against AEG.

Oh that is a good one. Also Debbie was called to help the prosecution case and ended up helping Michael's side. I guess the moral is be careful who you use as a witness. Also, I do not think there is any great love between the Cascios and the Jacksons, so he may not do much to help them win a case. I think the Jacksons were a little jealous of the time Michael spent with that family.

No one in that family has any legal right to question Michael Jackson's Estate Executors. *There is nothing binding them to do so because they are all over 21 years of age.

The only people mentioned in the will were his mother, Katherine Jackson, and his 3 children. *I do not have any idea why his siblings are so hot to wrangle with the Estate Executors. *What law in this land gave them the right to question their brother's financial affairs? *Since they*
must know this, they are using their mother as a way to involve themselves
and perhaps takeover the Estate.

This is also jeopardizing Katherine's legal guardianship because if sometime had passed and the guardian of these children are not able to do their job, the Children's Services will takeover if Katherine had been missing for a long time and that will further screw up the structure setup for them.

So, I would love to know whose brilliant idea this is because it will never work. *There are no legal responsibilities Michael had with his siblings and it is also true vice versa.

The only thing I can transparently see is that MJ's siblings are fighting without cause. *So they could keep Katherine as long as they want but they will never get their hands on MJ's fortune. *Tough luck for them. *Their mastermind should be dipped in boiling oil.

The bolded part, it is well known fact that they have single vision what comes to their plans. While they go full ahead with their "plan"(whatever that might be) against the estate, they left kids guardianship open to be questioned.

Randy hasn't being doing much in these last years, so I would say its his plan. He had a few years to go over every single detail, and now we can read the results of his plans.

Maybe one good thing coming out of this debacle, is that randy is thoroughly discredited and this ridiculous aeg lawsuit that he championed might be abandoned -ideally with the costs being bourne by mj's siblings and mrs j's existing allowance.

Update

KJ's lawyers responded to AEG's claims saying that
- the documents they produced aren't necessarily in chronological order,
- the documents are produced in single page format, (for example rather than sending 1 PDF with 12 pages they send 12 separate pages)
-claim the hard-copy, TIFF and PDF was AEG's choice,
- the last submission was in password protected RAR compression format which KJ's lawyers say their computers cannot open RAR and it's time consuming to enter the password
- and the rolling production cannot continue indefinitely

They ask the judge for
- a date the document production should end
- monetary sanctions
- order AEG to sort the documents and label them according to the requests

this was my last update about AEG case, I have a minor update to it

As for Frank Cascio being served a deposition / witness notice : As you know Katherine's lawsuit claims that AEG was the one that dictated Michael to take Propofol, AEG's defense is that Michael had a history with Propofol. Frank Cascio in his book mentions two events he saw Michael taking Propofol, 99 Munich bridge collapse and 2001 during recording of Invincible. So that could be helpful to AEG. It's hard to say if he could be helpful to Jacksons as well. He saw Michael's interactions with people he might be able to testify about if people could have power over Michael or not.

I have just read the last 15 pages of this thread and I gotta say - I wish the Michael Jackson fan community could file a class action suit against certain parties in the Jackson family.

It truly sickens me that that "family" will dishonour Michael and all he stood for, and expect Michael to pay for it! There are no words to describe how much I despise their actions.

this was my last update about AEG case, I have a minor update to it

Judge ordered a discovery referee to be determined. This referee is going to solve the discovery issues without need to file motions with the judge.

You see that is the problems with these "I think" statements. Eventually the "I think" drops off and people use statements like Frank saw Michael take Prof on 2 occasions. Who was the idiot who told the Katherine to claim that AEG dictated Michael to take Prof. How stupid could they be. Even after hearing the trial evidence, they still went along with this. It is a pity Michael left Katherine so much money, because she knows she can get into any legal situation, and the fees will be paid from dear Michael's estate.

^ Agree, it's completely risk free to file lawsuits if you know you don't have to pay lawyers' fees if you lose. I haven't heard randy say anything about estate interference in getting mrs j to drop the aeg lawsuit and you know if there was any hint of that, he would have ranted about it. The estate is being really generous and diplomatic here, as they must know there is no chance of winning and yet they know they'll have a massive bill to pay at the end with mrs j's costs and presumably aeg's costs.

Agree with loveforever, i read the extract where frank talked about some drug that was being administered to mj on tour, which he assumed with hindsight was propofol, but can't imagine this recollection wd be gd enough for court, a x exam wd make mincemeat out of him.

He did not know at the time, so who told him it was demerol Michael used. This suggests that later when he got older someone told him Michael had used demerol, so this is all conjecture on Franks part or hearsay if someone told him that.

That's why I say the best thing is to stay silent when you do not have absolute certainty about something, but it seems that this is completely impossible. Hear certain things about Michael by mouth of another person... never be very reliable. NEVER! :nono: It is very easy for people to say things about Michael when himself is not here to defend himself. If Michael were here, nobody would dare open his mouth to say anything. -_-


After June 25, some people have shown their real faces... this is scary. :fear:
