Hello people.

I think today starts the opening agurments regarding R. Kelly's trial. Finally the trial begins to see what is the real deal here. I have a lot of opinions about the Kels but one thing is for sure, innocent until proven guilty. I will give that right to Kells.

I have some rules here that I want everyone to respect:

1. Please, please, PLEASE do not even compare this trial to Michael's trial in ANY WAY! I do not care if you are trying to "make a point". Mike's trial and Kels' trial are two different things.

2. This thread is for news and discussion ONLY. Nothing else.

3. Please, try to be respectful and if you have somthing to post that is news worthy, please post it. Make sure the news information comes with links. Sidenote: I am iffy of posting things from gossip blogs such as tmz, bossip, or perezhilton.com. However, that doesn't mean that you cannot post them. Just that, I will not post them on here.

4. Do not bash others. Just make a point and leave it at that.

He rose from poverty on Chicago's South Side, inspired by a single mother, who helped him find his voice, and soared to heights that not even his dreams could eclipse.

The soulful R&B superstar achieved fortune and fame, sold millions of albums, won his industry's top honors, and even wrote hits for the legends who inspired him as a youth.

But, for the past six years, R. Kelly has lived under a criminal indictment that threatens the very future he managed to escape while growing up in the city's impoverished projects.

That irony takes center stage today as Kelly's long-awaited child pornography trial gets under way with lawyers' opening statements in Chicago. His 12-member jury was selected last week.

The Grammy-winning hit maker, whose first name is Robert, faces up to 15 years in prison if convicted of child pornography. Kelly, 41, who lives in Olympia Fields, has pleaded innocent.

Prosecutors allege Kelly made a 30-minute sexually explicit videotape between Jan. 1, 1998, and Nov. 1, 2000, and that the girl it features was born in September 1984. A

Cook County grand jury indicted Kelly June 5, 2002, after the tape surfaced.

Bootleg copies later were sold illegally on the Internet and street corners.

The prosecution, led by Shauna Boliker, who heads the office's sex-crimes division, faces a unique challenge. His alleged accuser, now 23, isn't cooperating. In fact, she's expected to deny that is her depicted while testifying for the defense. And the defense team, headed by veteran attorney Edward Genson, hasn't admitted that it is Kelly in the video.

The jury of eight men, four women includes a pastor's wife; a young rape survivor; a criminal justice student; a Romanian immigrant; a teacher's aide and several parents. Eight of the members are white.

This isn't the only time Kelly has faced such allegations, though it does mark his first trial. In 2003, he was arrested in Florida on child pornography charges after police said a search of his home netted sexually explicit photos of him having sex with a minor. The allegations later were dismissed after a judge ruled detectives illegally seized the photos in his home.

It also has been widely reported that Kelly settled three lawsuits in which he was accused of having sex with underage girls.

It's unclear if the jury will be told of the civil suits.

In an attempt to avoid a circus-like atmosphere, Cook County Circuit Judge Vincent Gaughan has set down draconian rules for the trial -- from a gag order on the attorneys to sealed court documents, closed-door meetings and threats of jail for any member of the media who bends the rules. The judge already jailed a grandmother for several days and had her cell phone destroyed after she used the phone's camera to snap a photo during one of Kelly's earlier court appearances.

Kelly credits his singer mother, Joann, who died of cancer in 1993, with inspiring him to pursue music. Discovered at a neighborhood barbecue, Kelly scored his best-known hit, "I Believe I Can Fly," on the soundtrack to the Michael Jordan 1996 movie "Space Jam." He has been called a musical genius known for lyrics that exploit sex as a form of artistic specialty, with other hits that include "Bump N' Grind," "Ignition," and his video series, "Trapped in the Closet."

Opening statements in the singer, songwriter and producer's trial are expected to begin today, after which prosecutors will begin presenting their evidence. The cornerstone of their case will be the 30-minute videotape, which will be played in court.

CHICAGO (AP) - A juror in R&B star R. Kelly's child pornography was dismissed this morning after she complained that sitting on the panel would leave her unable to pay her bills.

The woman told a judge that she only has 30 hours of vacation time at her job and wouldn't be paid for serving on the jury after that time expires.

She says she'd be unable to pay attention to her jury duties because of concern over their financial implication.

She's being replaced by 1 of 4 alternate jurors.

Kelly's accused of videotaping himself having sex with a female as young as 13.

The 41-year-old singer pleaded not guilty and faces up to 15 years if convicted.

Opening statements are set to begin today.

Kelly arrived at a courthouse around 9:30 this morning, escorted by an entourage. He sported his signature cornrows and a navy pin striped suit.

As R. Kelly Trial Finally Begins, Meet The Key Players In The Courtroom

We offer insight into the judge, prosecution and defense behind the long-delayed child-pornography trial.

CHICAGO — You already know the defendant. You already know the jury. But who are the major players in R. Kelly's child-pornography trial, which starts with opening arguments Tuesday? And what effect will their backgrounds and experience have on the case? Here's a look at the judge, prosecution and defense.

Kelly faces 14 counts of child pornography — seven for directing, seven for producing.

What's at Stake?
Kelly faces 15 years in prison and a $100,000 fine. If convicted, he'd have to register as a sex offender.

The Judge

Judge Vincent Gaughan, 66, can be a tough guy when it comes to presiding over his courtroom. He has already jailed one observer for contempt of court after she snapped a picture of R. Kelly on her cell phone. He has admonished Kelly on several occasions, for failing to call his probation officer one of the first times the singer was allowed outside the jurisdiction and for failing to show up to court for a hearing last December. (Gaughan ordered him to cancel a concert date to ensure his appearance at the makeup hearing date.)

But he's not a Scrooge. Over the past six years, he's given Kelly a number of breaks, allowing him out of the jurisdiction and to perform concert tours in the first place and not revoking his bond and jailing him whenever the singer goofed up.

Some might argue that those many tours delayed the trial. However, when potential jurors referred to the delay during the jury-selection process, Gaughan was quick to tell them that the delay was partly his fault, as he fell off a ladder trying to fix a skylight in July 2006 and broke his shoulder, leg, seven ribs and four vertebrae. Gaughan got right back to work soon after he recovered, presiding over a major murder trial known locally as Brown's Chicken — in which one defendant was sentenced to life in prison for a 1993 massacre at a fast-food eatery (the second defendant goes to trial next year). Much of the courtroom procedure in the Kelly trial has been adopted from the Brown's Chicken courtroom experience, as well as the Michael Jackson trial. Gaughan consulted with California court officials to make sure the R. Kelly trial didn't become as much of a media circus.

Gaughan has kept publicity to a minimum (including keeping some hearings closed and some documents sealed, at least until the conclusion of the trial), which could prevent the singer from having a fair trial. He denied a request from the press to lift the court decorum order, which bars lawyers and witnesses from discussing the case with the media, but tries to make light of it. When one reporter grabbed a soda intended for prospective jurors, he joked, "You can drink it, but you can't talk to it!"

Gaughan, who earned a Bronze Star for valor in Vietnam, has also been quick to thank prospective jurors with military backgrounds for serving their country.

The Prosecution

Assistant State's Attorney Shauna Boliker, 48, doesn't act like any stereotypical prosecutor you might see on "Law & Order" or other courtroom dramas. She's sunny and friendly, despite her draining work in Cook County's Sex Crimes Division, which she's headed since 2003, where she's responsible for all crimes of sexual assault, child pornography, Internet solicitation and clergy abuse.

One of Boliker's last big cases (of the 75 trials she's prosecuted) involved Catholic priest Daniel McCormack, who pleaded guilty to molesting five boys in his parish when Boliker reached an agreement with him to serve a lesser sentence of five years in order to spare the victims from having to testify. That case came up during the R. Kelly jury-selection process, as a prospective juror turned out to be a teacher's assistant at the very school McCormack's victims attended. Boliker picked up on the connection but kept the juror anyway.

When explaining some of the delays in R. Kelly's trial, Judge Gaughan also told prospective jurors that one factor was Boliker having a baby last August. At one point in between jurors, a blushing Boliker asked the judge to not mention her last pregnancy quite so much. "Why?" he asked in surprise. "When you have children as wonderful as yours?" (She has three sons.) Boliker had planned to go to work immediately after a very short maternity leave, but her doctor ordered bed rest just three weeks before the trial was set to start.

Boliker made local headlines for changing her own flat tire — despite being eight months pregnant — en route to the criminal courthouse in the 95-degree heat last summer. And during the course of one murder trial, a tooth flew out of her mouth during closing arguments, yet despite the missing tooth, she continued — and won the case.

Joining her at the prosecution table will be fellow Assistant State's Attorney Robert Heilingoetter.

The Defense

Kelly's lead attorney is Ed Genson, 66, who is a man of contradictions. He's known as the guy celebrities, politicians and alleged mobsters — from Shia LaBeouf to former Congressman Mel Reynolds to media mogul Conrad Black — call when they're in trouble in Chicago, but he's not known for always winning.

One client, Frank Caruso Jr. (from alleged crime family the Rotis), was convicted of aggravated battery and sentenced to eight years (later reduced to two). Another client, former state Senator John D'Arco, was found guilty on extortion and bribery charges. Black is doing time for obstruction of justice and mail fraud. And Reynolds, who was up on charges of sexual misconduct and child pornography in 1995 (Genson's only other case prior to Kelly's involving a sex crime), was convicted and sentenced to five years.

Thanks to the neuromuscular disorder dystonia, Genson arrives to the courtroom on a motorized scooter. He uses a cane to walk around, his head and hands shake, and he stammers when he talks. And yet, this works to his advantage in a courtroom (he once said that he purposely uses his disability to gain sympathy from the jury but later tried to take back the statement). A king at cross-examination, Genson catches people off-guard with what appears to be a disorganized, bumbling personality and then turns on a dime to reveal a sharp mind. He often asks his questions while sitting down on a stool.

Joining Genson at the defense table are attorneys Marc Martin, Sam Adam Sr. and Sam Adam Jr. And during jury selection, they were joined by jury consultant J. Lee Meihls, who worked for the defense during the Michael Jackson trial. Is this a dream team? Only time will tell.

R. Kelly's child porn trial began in Chicago today, six years after the singer was originally charged.

According to Reuters in their opening statements, prosecutors told a jury that Kelly was the mastermind behind a "vile, disturbing and disgusting" sex video with an underaged girl.

"The case will unfold before you frame by disgusting frame," Shauna Boliker of the Cook County state's attorney's office said.

Meanwhile the defense denounced the tape which was to be shown in court today, claiming its origin remains a mystery and that neither Kelly nor the alleged victim is depicted in it.

According to the prosecution, the tape was made some time between January 1998 and November 2000 when the girl was 13 or 14. Denying it is her in the video the girl refused to testify against Kelly and may instead be called as a defense witness.

In 2002 The tape in question was turned over to police by The Chicago Sun-Times and after reviewing it, the FBI concluded that they could not identify Kelly.

Kelly's defense lawyer, Sam Adam, Jr. said, "The tape you're going to see here is at best a copy of a copy of a copy of the original."

"It has gone through five or six generations and there are no identifying marks," Adam added.

According to the defense, police took pictures of Kelly in his underwear and a "significant mole" was present on his lower back that is not present on the man in the tape.

The trial which is projected to last up to seven weeks is being presided over by Judge Vincent Gaughan of the Cook County Criminal Court.

The Grammy award winning R&B singer faces 14 counts of child pornography charges and if convicted could face up to 15 years in prison.
 
his defense should be hella prepared...they've been doging this damn thing for five yrs. they're resting everything on the fact that r(ah) has a mole on his back and the dude in the video doesnt...yawn.

this is from the same guy who said he didn't recognize the room the vid was shot in when the room was a very famous part of his house...looked like a cabin in aspen...liar
 
The defense has to explain how do you go from saying that R. Kelly wasn't on the tape because he has a mole and then change it around to say his face was altered? Which one is it?
 
I'm just finding it ironic how this case is'nt even getting any t.v. media attention at all.
 
I've actually seen plenty about this on the news. It's been on the cover of the Chicago Tribune, it's been in my local newspaper, I've seen multiple coverings on CNN... it's also in the early stages as well. As the case picks up, so will the coverage.

Sounds like a major photoshop job done on video if even the FBI can't identify R.Kelly. If the tape is altered then who knows who the heck that really is on the tape cleverly edited to look legit...with R. Kelly's face. Anyone who watched the American Idol finale this year and saw the Gladys Knight part will know how far technology has come. Someone seriously had time on their hands IF this tape has been this well edited. The missing mole and the girl saying it's not even her in the video pretty much makes the State's case a bust from the jump. 1) They don't have a "victim" and 2) The body of the perpertrator doesn't "allegedly" match. Lawd!

I guess we'll see what the defense can prove when their side is up. :fortuneteller:

Not if this case turns out to be a fraud/sham. We probably won't hear dookie about it if it starts becoming clear that the tape is fake. It'll get a quick mention and just fall off the news radar. :ermm:

Well, I guess if the case falls apart and there's not much to report on... then there won't be much to report on!

If it turns out the tape is a huge point of dispute and witnesses called, I think the coverage will increase. I am personally a bit surprised it's gotten as much press as it has.

As for the tape, I have a hard time believing that is not R. Kelly. If it truly is not him, then this is a bigger and more planned conspiracy than ANYTHING people have alleged MJ to go through.

well i haven't heard much about it. usually if something is of a great magnitude, i can't turn on the computer without seeing it on my homepage..

one would almost think R. Kelly isn't famous.
 
like i said, he ain't a threat to white america...unless kids start peeing on each other.

the defense said the tape was a copy of a copy of a copy yet it was stated in court to be clearer than the defense wants others to believe.

y else would this man initially lie about recognizing the room teh sex act took place in, then try to blame it on his brother ? if it ain'thim, he had knowledge of it. proof of that was in florida where his computers had pics from the video on it. too bad the police couldn't wait for an appropriate warrant. losers
 
if you got a strong case it doesn't take no 6 years. alot of holes are in this case. timeline, idenity and when the FBI can't say then you know you got some problems.

it ain't talked about widely because R.Kelly is seen as a R&B Giant and not a Pop Act per se.Bill O'reilly did talk about it but not for a long drawn out discussion.

both sides will have some moments of points with technical things, but in the end I see R.Kelly walking because you can't have any doubt and if the Prosecution is gonna play a full deck this early and have some shaking head moments then there follow up ain't gonna be rock solid and right now I see cross examination breaking them down. we shall see but I feel Kellz will be alright.

that was shocking to find out right at the start of this trial. they identified the girl but said they (the FBI) couldnt say if that was him. and that was kept quiet till now. that along with all of the new developments with sparkle and her brother and sister in law trying to blackmail him will surely get him off..and dont' forget they trying to find out exactly were derogatis got the tape since R has a huge mole on his back but the man in the tape doesnt. and the pics the chicago police took back in 2002 clearly shows the mole. and when R's lawyer showed it (the pic) to the female who identified him on the tape the only thing she could say was that the mole might be cancerous...but she never did say why he doesnt have the mole in the tape. this will either in up in a mistrial or a not guilty verdict.

yep and this shows me they were making this federal beyond states evidence to make a stronger case. you gotta have DNA and a High tech overall vibe and they are coming up empty in the big picture.

oh Derogatis got alot of explainging to do because memory me serves me right back in 02 the Po-Po said anyone spreading this tape,etc... would be charged and this tape spreaded like wildfire and Degrotis knows more than he is willing to say. the truth to me is that you don't turn over supposendly strong evidence to a Newspaper you go directly to the Police. this is R.Kelly's best defense at a smear campaign right there because to deliever a tape of a act directly to a newspaper and have someone who knowingly Hates R.kelly adds fuel to the fire. suspect and this one might get the suntimes in real trouble.
 
sorry but the fact the dude had the damn images from th etape in a computer in a diff state means homie knew about it and he's involved w/ it. if it ain't him, it's his bro.

so just cuz they can't make a positive id, which is hard if the vid is grainy, doesn't mean it's not him an dhe'll most likely skate on this....

No offense, but if you do not care, EM, why are you posting on the thread? This trial is news whether it is mainstream or not.

From what I have heard, a lot of people, a former employee, I believe either R. Kelly's relatives or the alleged victim relatives have identifed R. Kelly on the tape. The defense is even trying to prevent the a woman from testifying in the trial because she claims that she had a threesome with R. Kelly and the alleged victim.

However, it is a good point that the pros. does not have a "victim" but R. Kelly is on trial for child porn and not necessary child abuse.

just like it took the female who claims she was in a threesome with him. so this guy coming forward after 6 years knows her and knows something isnt right. so he coming to tell his side for the defense.


Surprise Witness Could Mean Turmoil For Kelly Case

Defense Announced Witness Out Of The Blue Wednesday Afternoon

CHICAGO (CBS) ― A surprise witness has tossed the R. Kelly child pornography trial into turmoil, and could deal a powerful blow to the prosecution's case.

CBS 2 Chief Correspondent Jay Levine reports that the witness has already thrown a monkey wrench into court proceedings. Everything is now on hold while both prosecutors and defense attorneys find out what impact the man, who rushed to Chicago less than 12 hours after he surfaced, will have on the case.

CBS 2 captured exclusive video of the man arriving at Midway International Airport Wednesday night. He called Kelly's attorneys on Wednesday morning, and they hastily flew him in.

Defense attorneys have been talking to him for hours, and they were scheduled to send Judge Vincent Gaughan a summary of his testimony around 2 a.m. Thursday.

Prosecutors from the Cook County State's Attorney's office are expected to speak to the judge about the man beginning at 7 a.m. Thursday.

CBS 2 sources say the man is from Atlanta, and could be the ex-boyfriend of a woman who claims she witnessed a sexual encounter with Kelly and the alleged victim who appears in the infamous sex tape at the center of the trial. But Kelly's attorneys said the woman, who was set to be a star prosecution witness, tried to extort money from Kelly.

The trial adjourned abruptly on Wednesday when the defense announced the man would be called as a witness.

On Wednesday, defense attorneys said they needed to speak with their new witness before the prosecution witness testified and the judge agreed.
 
Neither side has a clear-cut case in my opinion. R. Kelly's side has ran with a number of different defenses already, some seemingly more plausible than others. The "missing mole" defense seemed plausible, but I feel they took it too far when they implied that R. Kelly's head may have been digitally added to the entire 26-minute home video, as if it were some huge budget Hollywood motion picture. The prosecutors have been just plain clumsy throughout the entire case, no way should a child porn case have taken SIX YEARS to begin (nevermind the fact that all the Florida charges against R. Kelly were dropped because prosecutors acted without a valid search warrant). Yes, a lot of third party witnesses have identified what appears to be R. Kelly and the girl on tape, but I'm hoping that the prosecution/defense will still go through a point-by-point analysis of the real people versus those in the film, so that the jurors can more carefully evaluate the profiles on their own.

I'm glad that the judge allowed the defense to question this new potential witness, since the woman who claims to have a three-some seems to have come out of the blue right on the heels of the trial...which I find peculiar.

I dont understand how the mole could be missing, if have identified R kelly in the video, how could it be possible that in the video he has a mole? Is there a logical explanation to this? Could the evidence have been tapmered with during the 6 years, maybe someone made the mole disapear digatally after being paid. Or is R kelly being framed, if so how is technology THAT advanced? And what ever happened to the story that it is R Kellys long lost twin brother in the video, is there a twin brother?

Looks like there's a mole that fits, so there may not be any acquitting.
On Thursday, the R. Kelly child porno trial prosecutors brought in a video forensics expert who found the mole, according to a report.
The expert froze several frames of the sex tape where a dark spot was visible on the video porn man's back.
For comparison, the expert showed the jury a still photo taken of Kelly's back after his arrest in 2002, revealing a dark fingernail-sized mole.
"There is a mark on the man's back in the exact same position," said the expert, referring to the tape.
Kelly and his attorneys looked grim and dejected during the expert's testimony, while prosecutors looked pleased, appearing to smile as they sat at their courtroom table.
The prosecution also finally got around to validating the tape.
They also brought in an FBI forensic expert who testified that the male and female in a sex tape at the heart of the case weren't computer-generated or altered.
The defense has sworn up and down that Kelly is not the man in the video and has repeatedly suggested that his likeness could have been computer-generated onto the tape.
The federal agent told jurors that even if someone wanted to create digital images, it would be costly and could take years.

:yes:. I think the defense went way overboard in claiming that R. Kelly's head was perfectly "digitally added" to the lengthy, grainy home video... It's absolutely preposterous. They should have just stuck with the "mole" defense, but apparently as you posted that too has now been debunked. It may not have been the wisest for the defense to repeatedly and aggressively claim that R. Kelly isn't the man on the tape, when it's been fairly well-established now that he probably is. Doesn't help that R. Kelly has ran with so many different defenses already.

agree. it makes his defence look bad and makes u looks very guilty to go so OTT and use crazy theories.
 
too bad they don't have an 1108 type clause in illinois...cuz he's settled a few underage sex allegations in the past and what's significant about that is that no one knew about it so they can't say he was a targetand once he settled the vultures kept coming.

I heard about the forensic situation this morning on the radio and I had a feeling that was the case. I didn't know this, but a mole can grow back so even if Kels would have gotten rid of the mole, it can grow back.

This does not look good for the Kels.Both sides have their own issues, but I cannot believe that the defense wanted to focus on a mole and try to tell the jury that it is not R. Kelly. I mean, let's be real, I know a lot of people who seen the tape and every last of of those people said it was R. Kelly. I can't understand why it takes an FBI guy to basically confirm that it was Kels on that tape. The defense was trying to say that it was not him on the tape, his face was changed digitilty. Are they serious? I guess they did not know that it takes over 40 years to completely fake that tape. It is all sad that tax payers money is wasted on something that the Kels should have done a plea bargin on.

The whole thing is tragic and sad like Tatum's life.
