Of course Katherine is involved. The legal parties in this case are Katherine, Michael's children and the attorneys. If Randy and Katherine's children leaked the papers, it is still Katherine's fault, because it means she allowed them to have the information. Legally, the information should not be given to her children even though we know that Randy has a big stake in this case. Of course she will say she had nothing to do with it. Look how many attorneys she has helping her with this case, and they could not ensure that documents remained secure. This was a deliberate move on their part, and in this I agree with AEG, although I still have contempt for them. However, I have more contempt for Katherine's side because they are causing the continuous stigmatization and ridicule of Michael long after his death, while at the same time trying to get money for his death.

Remember how in the letter against the executors, Randy and the snatchers wrote that the executors were helping AEG to keep materials confidential and were helping AEG. I paraphrase, so we should get the letter again to take a look at it. It appeared that Randy and co did not like that certain information was under seal, so here again we see this was a deliberate move by all of them to circumvent the court's order. AEG should also include that letter to show that Katherine discusses the documents with her kids, and therefore, the document information was already leaked some time ago.

They waited till this moment to send the information to the papers, since based on the snatchers letter, we see that they had the information all the time. Isn't it something that a news outlet could print information even though they are warned the documents were under seal by a court. The news business really benefits from crimes. You can steal some information and give it to them to print. While you are hauled to court and have to pay fines, the news outlet simply collects money from printing the information.

They do these sneaky things and then hide behind their mother. She tolerates it and I can't give her a pass anymore.

The irony is Michael has been trashed all over the media by the Jacksons leaked emails. If the judge reward AEG money sanctions against Jackson's. katherine will spend Michael's money to bail herself out. Damn katherine's whole legal team is paid by Michael's Money. So Michael's money is exploited to trash his name and legacy in exchange for a small chance of winning a AEG gold pot.

The Jackson's had this coming. This is another fine mess KJ has allowed the cubs to get her into. Hopefully they will learn that dragging Michael through the mud will cost them and we all know how much they love to hold money.

Big Apple so true. That money is needed for other children. It seems some are still thinking that Katherine would not do something like this. Katherine talked about Michael's appearance on Oprah when she knew he would not like that. She exploited his children when she knew he would not like that. She allowed others like Mann to exploit Michael and his children when she knew Michael would not like that. She read a bogus statement prepared by the snatchers, as though it was her own words, when she knew it was a lie. Weeks after Michael died she began negotiations with a fraudster when she should have been grieving. Now what does that say about her? She will do some real low things for money.

Even if Randy or another Jackson sold those e-mails, Katherine is still to be blamed because she would be the one who gave them that information. It is Katherine and her attorney who have access to confidential material. Now let's see what their response will be. Be prepared for it was not us.

This post is spot on and I couldn't agree with it any more if I'd written it myself.

why Katherine or her children would leak these documents at this time does not make sense to me. supposing they think they have a strong case in their hands precisely because of these documents, why would they risk having them thrown out from trial by leaking them?

I rushed to post the document but I didn't do a summary. Here's the summary of the motion

AEG had filed for a motion against Katherine Jackson and her lawyers due to the leak of the emails. AEG is asking for
- evidentiary sanctions to NOT allow Katherine to use the leaked emails and documents
- monetary sanctions of at least of $50,000 paid to AEG and $1,500 paid to the court
- an investigation into scope and manner of the breach.

AEG's counsel gets a phone call from LA Times journalist on August 27. The journalist provides them with the emails she has and AEG realizes that this leak could only come from Jacksons - despite the article says the source is Lloyds.

The documents LA Times had was
- 159 pages of discovery from AEG & AEG Live (148 pages confidential)
- 12 pages by Ortega (confidential)
- 1 page from Jacksons
- 36 pages from Murray
- 34 pages from court documents
- 4 pages of news articles

212 pages had Bates numbers and confidentiality notices on them but they were redacted or obstructed in the copies given to LA Times.

AEG says the only AEG counsel and Katherine and her lawyers had access to these documents and therefore the source is Katherine and/or her lawyers.

AEG explains that Ortega and Murray documents were produced in other lawsuits. AEG also says that they provided some but not all of the documents at Lloyds lawsuit.

AEG explains that

- Lloyds discovery documents started from January 2009, Jackson discovery started from September 2008. As LA Times had emails dating back to 2008 AEG argues that the source can only be Jacksons and not Lloyds.

AEG explains that even AEG employees (such as Phillips and Gongaware etc) did not have access to the documents in the format that they were provided to LA Times.

- AEG explains some of the documents are from "AEG" and not "AEG Live". AEG is only a party to the Jacksons case and they did not produce any documents in Lloyds lawsuit again demonstrating that the source is Jacksons and not Lloyds.

AEG thinks the reason for the leak was to tarnish AEG and the documents was selected carefully from a lot bigger number of actual documents. AEG thinks this leak of confidential documents made AEG unable to respond publicly (as they would be required to break confidentiality as well). AEG also argues that some of the emails were hearsay and they could not been able to be used at trial so leaking them was only way to get them out. AEG also says removal of "confidential" notice and the bates numbers show that whoever leaked these were aware that they were breaking a court order.

AEG is also asking for discovery into the breach and leak and want to depose Katherine Jackson and her lawyers, they are even asking the court to assign a special master to investigate this further.

No, they know they do not have a strong case. All evidence from the Muarry trial and the depositions that AEG conducted and we were able to find out about, show that AEG did not make Michael use prof. AEG did not hire Muarry. Remember Katherine's side could not produce evidence and were using AEG's statements in the documents to send back to them as evidence. Due to this, Katherine and co decided to spill the e-mails to show that AEG were tyrants (which they were), but those e-mails only show that Michael, according to AEG staff, was having some emotional and psychological issues, drank, and was not performing the way he should. The thinking was that they could shame AEG and get some sympathy, maybe also hoping AEG would be shamed into settling the case for millions. These are the actions of desperate people, and when you are desperate for money you do not think about the court sanctioning you. You want to get that information out there because you think it will help you gain money. So these documents do not show they have a strong case as you think. The documents prove nothing about the claims Katherine has against AEG. If they did, there would be no need to leak them, since they would win the case and get millions.

Can court action be taken against the media for their part in this also? According to the court motion documents, the person who wrote the first article about the e-mails had been clearly told by AEG's lawyers not to publish that information and they published it anyway. How can they be allowed to get away with that?

I am a social worker who has worked with parents who drank too much and I am sick and tired of every excuse for getting drunk.

He was Michael Jackson but he was also a father with responsibilties and I see him only as a father not as the superstar on that matter.

This judgmental BS is really irritating and totally unnecessary as well as not constructive. Michael Jackson was the greatest entertainer in the world but he was as human as every other person who has ever been born on this plant. I don’t care what profession we are in no parent is absolutely a perfect one at all times but judging by the way Prince, Paris and Blanket turned out Michael Jackson did better than most.

thank you for your opinion. just to be clear, i don't know if they have a strong case or not. what i said was "supposing they think..."
anyway, i still think that if it's proven they leaked this, and if this is their smoking gun, they would have ruined their case even before trial starts, that's why it does not make sense to me. but i don't want to go into possible motives because i would just be speculating. i'd rather wait for what Katherine has to say.

Does Katherine ever know anything? I am just tired of these people behavior and tactics. The only person that gets hurt is Michael and also his kids. I don't support AEG but I hope the Jacksons lose and don't get a single penny. Instead of worrying about the money they think they deserve to get they should have stopped Murray who killed Michael from making any kind money off what he did. And you know he will and they could have prevented it and they chose not to. His family should be the very first ones to protect Michael. I am still waiting to see when they will ever do that.

So far only Roger Friedman published this story, but if this is really true I think it may hurt Katherine's lawyer request to do an accounting of the estate. The judge may not want to give Katherine acess to confidential documents after that.

Executors definitely should keep on eye and mind what they give to K and her lawyer to see as most likely everything is going to end up in tabloids. There is a case with DeMann and he wants to see more documentation/books than it is necessary to his case, but the estate doesn't want to show as they include business secrets. If K and her lawyer gets access to everything, we will read all the business deals from tabloids.

Allen Duke CNN just tweeted saying he has an exclusive - That the person who leaked the documents admits it and is not a Jackson. But I'm not sure if that lets the Jackson's off the hook yet .. depends on how this person gained access to the documents?

Source of leaked Michael Jackson e-mails identified

Los Angeles (CNN) -- Dramatic e-mails about Michael Jackson's condition before his death were leaked to a reporter by a businessman who just settled a copyright lawsuit with Jackson's estate, that businessman told CNN.

The admission by Howard Mann that he provided the controversial documents to the Los Angeles Times contradicts a claim by lawyers for concert promoter AEG Live that they have "unequivocal evidence" showing that Jackson's mother and her lawyers leaked the e-mails.

The source of the leak is crucial to the wrongful death lawsuit filed by Katherine Jackson and the late pop star's three children since the judge in the case ordered the documents sealed.

AEG's lawyers filed a motion Monday asking the judge to impose tough sanctions on the Jacksons, including fines and preventing them from using the e-mails as evidence in their effort to prove the promoter contributed to Jackson's death as he prepared for comeback concerts in 2009.

AEG did not immediately respond to CNN's request for comment about Mann's claim of responsibility for the leak.
"We were able to learn today that apparently Howard Mann has admitted that he was the source, and that he definitely never received any documents from Katherine, Prince, Paris, or Blanket Jackson, nor from their lawyers in the wrongful death suit against AEG," said Jackson lawyer Kevin Boyle.

Boyle criticized AEG's lawyers for their haste in pointing the finger at the Jacksons.

"AEG made these accusations against the Jackson family and their lawyers apparently without doing even the most rudimentary investigation," Boyle said. "We are further disturbed that the motion for sanctions filed by AEG was given to the press before it was served on Katherine Jackson or her counsel."

If the AEG lawyers had reached out to the Jackson lawyers earlier, they could have helped solve the mystery of the leaked documents, he said.

"AEG has known about the alleged leak since a week before the article was published," Boyle said. "AEG never contacted the Jackson's counsel to inquire about the article or the documents."

The e-mails revealed the promoter for Jackson's "This Is It" concerts expressed doubts about the star's ability to be ready for the shows but expressed confidence in the private doctor eventually convicted in Jackson's death.

AEG Live President Randy Phillips was responding to show director Kenny Ortega's e-mail, which said Jackson had "strong signs of paranoia, anxiety and obsessive-like behavior" and suggesting they hire a "top Psychiatrist in to evaluate him ASAP."

Jackson died on June 25, 2009, from what the Los Angeles County coroner ruled was an overdose of a surgical anesthetic and sedatives, drugs that Dr. Conrad Murray told police he used to help the entertainer sleep as he prepared for the concerts set to start two weeks later.

Murray was convicted of involuntary manslaughter and sentenced to four years in prison last year.

Mann, who once partnered with Katherine Jackson on a book and documentary about her family, said he obtained the documents from various sources, but none of them came from the Jacksons or their lawyers.

He gave them to reporter Harriet Ryan because he wanted the story of Jackson's death to be told, Mann said. Mann's company settled a copyright dispute with Jackson's estate over use of Jackson's images this week.

Ryan, who kept the source of the documents secret in her story, did not immediately respond to CNN requests for comment on Mann's claim that he gave them to her.

AEG lawyer Marvin Putnam went on a public relations and legal offensive against Katherine Jackson and her lawyers this week in response to Ryan's article and the subsequent stories by other news outlets, including CNN.

"AEG believes the unequivocal evidence shows that Katherine Jackson and her attorneys leaked these documents to the press," he said in a statement to CNN. "The documents released to the press were given to Mrs. Jackson and her attorneys -- and to no one else -- confidentially in discovery and subject to a court order."

But Mann said he got the e-mails from several sources, including Jackson fans who contacted him. Some of the documents were part of discovery in other cases, including the criminal trial of Dr. Murray, he said.
Boyle, the Jackson lawyer, also told CNN that other parties had the same documents, including lawyers involved in an ongoing insurance case against AEG.

Lloyds of London seeks to void a $17.5 million policy that AEG purchased in case Jackson was not able to perform the 50 shows scheduled for London's O2 Arena. The insurer contends AEG hid Jackson's health problems and failed to respond to repeated requests for his medical history.

"Katherine, Prince, Paris and Blanket Jackson and their lawyers deny AEG's allegations that we gave any protected documents to the press," Boyle said.

The documents made public in the Los Angeles Times story are not the most damaging to AEG that were uncovered, Boyle said.

"We can assure you that we are in possession of documents that make for an extremely compelling story in the wrongful death case, and that completely support the plaintiffs' claims," he said.
AEG Live's president called Jackson's death "a terrible tragedy" in an e-mail weeks after he died, he added "but life must go on."

"AEG will make a fortune from merch sales, ticket retention, the touring exhibition and the film/dvd," Phillips wrote. In fact, AEG Live was allowed to sell Jackson tour merchandise and share in the profits from the documentary "This Is It," produced from rehearsal video.

The e-mails suggest AEG Live's president saw Jackson's problems first hand the day the pop star was to appear at the O2 Arena to publicly announce the shows.

"MJ is locked in his room drunk and despondent," Phillips wrote in a March 5, 2009, e-mail to AEG Live's parent company, the paper reported. "I (am) trying to sober him up."

"I screamed at him so loud the walls are shaking," Phillips wrote. "He is an emotionally paralyzed mess riddled with self loathing and doubt now that it is show time."

The promoter blamed London traffic when Jackson was 90 minutes late for the announcement that day.
"He's as healthy as he can be -- no health problems whatsoever," Phillips told CNN two months later to refute reports Jackson's health was threatening the concerts.

The Los Angeles Times story, however, said the e-mails indicated major doubts about Jackson's ability to perform.
"We cannot be forced into stopping this, which MJ will try to do because he is lazy and constantly changes his mind to fit his immediate wants," AEG Live executive Paul Gongaware e-mailed to Phillips.

Jackson's missed rehearsals in June triggered concerns in e-mails that he was slow in learning his dance routines and would have to lip-sync on stage, the newspaper reported.

"MJ is not in shape enough yet to sing this stuff live and dance at the same time," one e-mail from the show's music director read, the paper reported.

A production manager wrote: "He was a basket case. Doubt is pervasive."

A loud warning from Ortega, who worked closely with Jackson on previous tours, came in mid-June, just over a week before his death.

"It is like there are two people there. One (deep inside) trying to hold on to what he was and still can be and not wanting us to quit him, the other in this weakened and troubled state," Ortega wrote. "I believe we need professional guidance in this matter."

Ortega testified at Murray's trial about his concerns about Jackson's frail condition and missed rehearsals. It resulted in a meeting six days before Jackson's death in which Murray assured the promoters he would have Jackson ready for rehearsals that next week.

An e-mail from Phillips after that meeting said he had confidence in Murray "who I am gaining immense respect for as I get to deal with him more."

"This doctor is extremely successful (we check everyone out) and does not need this gig, so he (is) totally unbiased and ethical," Phillips' e-mail said.

The correspondence could play a role in the wrongful death lawsuit, which accuses the promoter of contributing to his death by pressuring him to prepare for the concerts despite his weak condition.

A production manager wrote: "He was a basket case. Doubt is pervasive."


A loud warning from Ortega, who worked closely with Jackson on previous tours, came in mid-June, just over a week before his death.


"It is like there are two people there. One (deep inside) trying to hold on to what he was and still can be and not wanting us to quit him, the other in this weakened and troubled state," Ortega wrote. "I believe we need professional guidance in this matter."


Ortega testified at Murray's trial about his concerns about Jackson's frail condition and missed rehearsals. It resulted in a meeting six days before Jackson's death in which Murray assured the promoters he would have Jackson ready for rehearsals that next week.


An e-mail from Phillips after that meeting said he had confidence in Murray "who I am gaining immense respect for as I get to deal with him more."


"This doctor is extremely successful (we check everyone out) and does not need this gig, so he (is) totally unbiased and ethical," Phillips' e-mail said.


The correspondence could play a role in the wrongful death lawsuit, which accuses the promoter of contributing to his death by pressuring him to prepare for the concerts despite his weak condition.

AEG already stated the documents released for the Murray case and Loyds of london - Are not the same docs that were leaked to LA times. AEG said those particular docs were ONLY Given to the Jacksons - Howard Mann most likely got them from his good buddy Randy Jackson. I dont think this will allow jacksons off the hook especially if AEG can prove the particular documents leaked to LA time were not released anywhere else but to the Jacksons.

Ridiculous story, alan duke must realise he's been taken for a ride. Randy was apparently the one who introd howard mann to mrs j so it's clearly him and he got them from mrs j. AEG are really furious, i'm sure they'll be demanding full costs to be paid when the jacksons lose this case, whichof course will come out of mj's estate.

I really wish the Jacksons, who are always calling for 'justice for Michael', would stop trying to battle things out in the court of public opinion. They have the regrettable tendency of trying to be smart and having it severely backfire on them. I don't understand how they have not grasped a very simple concept when it comes to the media - NO MATTER WHAT THE INTENTION IS, IT ALWAYS ENDS UP REFLECTING BADLY ON MICHAEL.

So if they truly CARED about Michael (YES, I went there), they need to be asking themselves one thing before they leak - how does this impact on Michael's legacy? But apparently some of them are still tied up with the notion of Michael's legacy being bound up with Gary, Indiana and can't seem to see beyond that. But I digress.


I don't know that anyone here on this board is a fan of AEG. But at least they are not leaking confidential documents from a legal proceeding. What a low-class thing to do. This is not about calling out AEG or revealing them to be monsters! Because the lawsuit itself calls them out. No, this is about playing dirty and smearing Michael in the process.

Well said. I cannot believe the tunnel vision they have in regards what they do now and how it is going to effect on Michael's legacy and his kids in a future.

His family should be the very first ones to protect Michael. I am still waiting to see when they will ever do that.

Remember how in the letter against the executors, Randy and the snatchers wrote that the executors were helping AEG to keep materials confidential and were helping AEG. I paraphrase, so we should get the letter again to take a look at it. It appeared that Randy and co did not like that certain information was under seal, so here again we see this was a deliberate move by all of them to circumvent the court's order. AEG should also include that letter to show that Katherine discusses the documents with her kids, and therefore, the document information was already leaked some time ago.

They waited till this moment to send the information to the papers, since based on the snatchers letter, we see that they had the information all the time. Isn't it something that a news outlet could print information even though they are warned the documents were under seal by a court.

Good thinking, this is just another Randy's fucked up plan that backfired.

I think reporters don't have to reveal their sources so we might never know her source for sure, but in my own opinion, I just cannot see K or her lawyers leaking these emails as her lawyers should have known that AEG will asks the judge to exclude these emails from trial.



The irony is Michael has been trashed all over the media by the Jacksons leaked emails. If the judge reward AEG money sanctions against Jackson's. katherine will spend Michael's money to bail herself out. Damn katherine's whole legal team is paid by Michael's Money. So Michael's money is exploited to trash his name and legacy in exchange for a small chance of winning a AEG gold pot.

Wasn't there a talk about K lawyers working on no win, no fee basis, so if they lose, they don't get paid, and if their win, they take certain amount from what K is awarded?

It is sickening thought that K using money what she gets from estate to trash Michael even further, and if she gets slapped with sanctions, that money should not be coming from estate.

Interesting that he never makes any mention of protecting his brother's reputation - every single media outlet used the emails to embarrass mj, not randy phillips or aeg. It goes further than randy not caring, i believe he actively goes out to hurt mj's reputation - eg the drug stories in the media before mj died. And the disgusting comments made in x17online about paris and prince during spagate suggests his resentment carries on to the next generation.

The source of the leak is crucial to the wrongful death lawsuit filed by Katherine Jackson and the late pop star's three children since the judge in the case ordered the documents sealed.

and that is the reason why Mann was brought in to take the heat. Randy most likely leaked them and he talked Mann to take the blame. Lets not forget that it was Randy who introduced Mann to K.

That's the thing, they leaked emails that LLoyds don't have so they cannot blame them.

"Katherine, Prince, Paris and Blanket Jackson and their lawyers deny AEG's allegations that we gave any protected documents to the press," Boyle said.

The documents made public in the Los Angeles Times story are not the most damaging to AEG that were uncovered, Boyle said.
"We can assure you that we are in possession of documents that make for an extremely compelling story in the wrongful death case, and that completely support the plaintiffs' claims," he said.

If they have more damaging documents and they are so sure that supports their case, why resort such a dirty tricks?
To my eyes, it screams desperation, not confidence to winning the case

I would love to email to AEG about that connection, but I don't think they deserve any help on this. They are as much bastards than any other employee that hires staff and expect them to work as agreed in the contract, and they don't care if the employee is not well, they care about their money and their investment, so I leave this discovery for themselves:)

No doubt soon we will hear dirt on Jacksons, AEG will not let this one go on without punishment. Something is going to show up in tabloids about them, of course the source cannot be identified as AEG.
