Confusion over 1993 Case

I know Michael is 100% innocent so there's no need to convince me.

I just wanted to inquire into some detail which has been bugging me as of late.

In the Official 2005 Trial documents it was stated - “the 1993 civil settlement was made by Mr. Jackson’sinsurance company and was not within Mr. Jackson’s control…The settlement agreement was for global claims of negligence and the lawsuit was defended by Mr. Jackson’s insurance carrier. The insurance carrier negotiated and paid the settlement, over the protests of Mr. Jackson and his personal legal counsel.”

What confuses me is that in an interview on Primetime with Diane Sawyer, Michael said that "I had to do something to get out from under this nightmare... I got together with my advisors and it was a hands-down unanimous decision - solve the case".

Can anyone please clear this up for me? Why did Michael say this?

Because, they sworn never to speak of the case, it was confidential. If Michael would reveal the information from the case settlement , then lawsuit would ensue, and Michael, would have had to pay millions more, for breach of contract. You see, Michael wasn't suppose to talk about it (how, when and who paid), but he was forced to go public and set the record. So, Michael said, things that wasn't on the settlement. But, nevertheless, Evan Chandler filed a lawsuit in Santa Barbara against Jackson, Lisa Marie Presley and other defendants including ABC TV, Diane Sawyer and Sony Music for claimed fraud conspiracy, breach of contract slander and intentional infliction of emotional distress. Court overthrow it , Evan’s case lacked substance and ordered the family to pay Jackson’s legal fees and costs (media never reported this, only after MJJ death, this info was revealed). According to the court that Jackson had not breached the original agreement by going on a Diane Sawyer ABC special with Lisa Marie Presley and by making public statements about the case.


You have to understand, that Michael was under enormous pressure; he couldn't speak of the settlement, publicly or privately. Whatever he has said, to Diane, it was constructed in the way, that wouldn't inflict him. But, the vultures, never left him alone, and poke him over and over and over regard the 93 case. It took the trial in 2005, for the truth to come out.

He had to say SOMETHING, but imagine being stuck between a rock and a hard place. He can't talk about the actual details, but is forced to say something, because he KNOWS that it looks odd to people- yet he can't really go there either. So he tries to say SOMETHING without violating the agreements- because the vultures never stopped looking, either.

It also wouldn't be unheard of that a bunch of lawyers have one opinion, but don't see a choice when confronted with insurance companies, courts etc.

He also said a number of contradictory things in interviews- and I can't really blame him for that. He didn't have much of a choice.

You probably already know that Michael is not exactly eloquent or precise when he’s talking in an interview or when he has to explain something so complicated. Yes he was under pressure and wanted to get out but on the other hand, his advisors told them to do so.

Civil Case (negligence accusation) is not the same as a Criminal Case (molestation accusation)

At the last second the Chandlers changed the charges for Negligence instead of Molestation. This is the point when MJ’s Insurance Carrier enters in the scene wanting to settle the dispute for “negligence” (it’s what Insurance Companies do in all “negligence” suing).


This is what MJ said

Diane: Why did you settle the case, and, and it looks to everyone as if you paid a huge amount of money...

Michael: That's...that's...most of that's folklore. I talked to my lawyers and I said, Can you guarantee me that justice will prevail? and they said, Michael we cannot guarantee you that a judge or a jury will do anything. And with that I was like catatonic. I was outraged...

And that is right : In a cilvil case anybody can win because there’s no need to get factual proves like in a criminal case.

Diane: How much money...

Michael: Totally outraged. So what I said...I have got to do something to get out from under this nightmare. All these lies and all these people coming forth to get paid and all these tabloid shows, just lies, lies, lies. So what I did - we got together again with my advisors and they advised me, it was hands down, a unanimous decision - resolve the case. This could be something that could go on for seven years.

Again, he was right.
A lot of advisors, maybe even Sony guys include saying “It’s better for you to get out from this right away”

Michael: This could be something that could go on for seven years.

True again: Civil Cases can last for years and years. They are not like criminal cases.

Can i ask something? Why is so important for people if Michael or his insurance paid for the settlement? Why don't they give the same amount of thought on the fact that if the Chandlers wanted justice, If they really thought that Mike did something to their kid, they wouldn't have sued Michael for 30.000.000 dollars. Instead ,they would have reported the claims to the police and then go to trial. But they didn't. First they asked for money and when Michael didn't give it to them, they went to the police with claims and then sued him for money.

Money is what Evan Chandler wanted all along. If Evan thought that Mike did something to his child, why didn't he tried to frame him in some way, i.e videotape him or something like that? If Evan didn't want money, then why did he sued MJ for additional 60.000.000 $ after the Diane Sawyer interview, while asking for the court to permit him to release a cd called Evanstory?

The man was sick in his brains and what happened to him few months after Mike's death was karma striking back.

By the way in his song money MJ says " Insurance?
Where do your loyalties lie?
Is that your alibi?
I don't think so
You don't care"

This are all facts.

I agree. It doesn't matter much if it was the insurance company or it wasn't. A settlement is not a sign of guilt - innocent people settle all the time. Like you said, why don't people focus on the fact that the Chandlers were terrified by the prospect of a criminal trial and they were desperate to push the civil case to precede it? Or why don't they take a look at Ray Chandlers' book where he says:

“Had Michael paid the twenty million dollars demanded of him in August, rather than the following January, he might have spent the next ten years as the world’s most famous entertainer, instead of the world’s most infamous child molester.”

Is that the concerned family of a molested child? They want money and not justice?
