Dr. Murray was charged in connection with his former patient, Michael Jackson’sdeath on June 25, 2009. Murray’s defense team filed the motion on Friday.
The court docs cite Casey Anthony’srecent murder trial for the grounds of their motion. “The recent case of State of Florida v. Casey Anthony, which took place in Orange County Florida…demonstrated the danger that is created to a fair trial when basic information is managed for the purpose of entertainment and television ratings. Judge Belvin Perry, who presided over the Anthony trial, expressed dissatisfaction with the amount of media coverage.”

Judge Michael Pastor
had previously said that sequestering the jury might cost too much money, but the defense argues: “Although there is cost with ordering sequestration, it is comparatively minimal compared to to the costs that would be incurred by a retrial or new trial that would be required as a result as a result of jury contamination.”
Dr. Murray says his right to a fair trial will be compromised if the jury isn’t sequestered.
“The nature and extent of the publicity including the massive print and Internet media coverage of this case has been widespread and prejudicial to Dr. Murray. There is great danger that Dr. Murray will not be able to rely on a fair trial, if the jury is allowed access to this prejudicial coverage. Accordingly, Dr. Murray respectfully asks this Court for an order sequestering the jury, during the entire trial, including jury deliberations.”
A hearing is scheduled on the matter for August 25, 2011. Jury selection is expected to begin on September 8, 2011.

I don't know what decision the judge will take, but I wonder if the risk of a new trial could be so easily required and granted... maybe to avoid that possibility the judge orders jury sequestration.

I remember this did come up the last time, but didn't the judge say it was too costly and California did not have the money at the time?

Yeah it was mentioned at a previous hearing and the judge pretty much said no way then.but the defence still have a right to file a motion and ask.considering the defence are trying to put mj on trial this is laughable.infact a sequested jury would prop help mj

I hope the judge does allow this, at least that way we might have less comeback after the trial.

You have a point there, that way the stupid media commentators like Dr. Drew will not be clouding their minds with rot about Michael. Drew and company will be saying how sorry they are for Murray so the defense should really ask that the jury not be serquestered.

I agree that the jury should be sequestered. But not for the reasons the defense is talking about. I'm wondering if the defense has really been paying much attention to what the media has been saying about Michael for the last two years. Seriously, how is the media coverage all prejudicial to Murray when the media have been supporting Murray from the day he was first interviewed by the police? I don't understand that. This is all just my opinion.

I don't think this will help Murray...but it's funny that even him is afraid of the media, a media that was never pro Michael!

The only thing Murray is a victim of is his own stupidity. He needs to look at all the things he did that night and morning and understand how his actions caused him to be in the situation he is in now. If he comes forward and say I did not do these things and provides evidence that someone else did it, then I would gladly ask for his forgiveness. However, he stated he gave Michael a list of these medications and he provided a time. Also, too many lies: he did not have a phone, yet he had 2 cells and was on the phone; he went to pee for a minute, yet it shows he was on the phone, and on, and on.

Oh please, look how dark Murray got, probably because he is having a good time enjoying his vacation. Michael however, is in not here to enjoy his vacation. Notice he was not at the hearing again today. I hope I do not see Murray when I go to LA.

Oh boo hoo. If Murray hadn't given Michael that Propofol to no matter what to start with, which he has admitted to doing, he wouldn't be in this mess, in my opinion. I do not feel sorry for him at all.

Murray has missed many days of hearing, so it is interesting that he has something to say about a judge's decision. He should be stating that he is innocent and that some other guy came in the room and did it. At one point that was one of the defences responses. Lately they have abandoned that and now stick with Michael killed himself.

LOS ANGELES (AP) — Lawyers for Michael Jackson's doctor have filed an emergency appeal seeking to overturn a judge's refusal to sequester jurors in his upcoming trial.
Attorneys asked to delay the start of jury selection on Sept. 8 until the issue of sequestration is decided by the appellate court.
In a 28-page petition filed late Friday, lawyers said jurors will be poisoned by publicity unless they are locked up in a hotel during Dr. Conrad Murray's trial. They acknowledged that their request is extraordinary, but so was Jackson, whose legacy will feed news coverage.
In the alternative, they asked that the judge rescind his decision to have the trial televised.
Murray is accused of giving Jackson an overdose of the anesthetic propofol.

LOS ANGELES (KABC) -- Attorneys for Conrad Murray, Michael Jackson's doctor, filed a Petition for Writ of Mandate and immediate stay of trial Friday.

Attorneys want the trial held pending the Court of Appeal's determination of the petition for writ relief.

On Aug 25, 2011, Judge Michael Pastor denied Murray's request to sequester the jury during the entire trial. Judge Pastor further denied Murray's request to remove television cameras from the courtroom. The judge said sequestration was not appropriate because it would inconvenience the jury and "make them feel like inmates."

Murray wants the Court of Appeal to reverse that ruling and order jury sequestration or, in the alternative, reverse the trial court's order permitting cameras in the courtroom during trial. His attorneys are asking for an immediate stay of trial until Court of Appeal rules on the writ.

The trial is scheduled to begin on Sept. 8.

Attorneys for the physician facing trial for Michael Jackson’s death asked an appellate court late Friday to order sequestration for jurors, calling a judge’s earlier order denying the defense’s request an “abuse of discretion.”

Without around-the-clock isolation, the jury will be “poisoned” by a flood of media reports and commentary on Dr. Conrad Murray’s involuntary manslaughter trial, the attorneys wrote. They cautioned that the level of coverage would be even more extensive than in Casey Anthony’s trial in Florida, in which they said cable personality Nancy Grace “used airtime to campaign for the conviction of Ms. Anthony.”

“It is Pollyanna to expect the jury members to go home each workday and weekend for six weeks and entirely avoid the mass of exposure this trial will engender,” Nareg Gourjian, one of Murray’s attorneys, wrote in Friday’s filing. He noted that, according to one database, there had already been 7,000 articles written on the case, and contended that it would be impossible for jurors to avoid outside information or opinion on the trial.

In the filing, defense attorneys noted that even prosecutors had written that they were “concerned about the risk of jury contamination” in a civil case brought by a British insurer over Jackson’s canceled concerts. Prosecutors this week asked for release of evidence to be delayed in that case, citing “significant, unrelenting media attention” and saying documents and photographs could be leaked to the media and affect potential jurors.

Los Angeles County Superior Court Judge Michael Pastor twice denied the request for sequestration, saying he had faith that jurors would heed his warnings to avoid media coverage of the trial. He also said the court system could not afford the cost, given its dire financial situation.

Murray faces a maximum of four years in prison on the manslaughter charge. He is accused of causing Jackson’s death by overdose on a surgical anesthetic. Jury selection is set to begin Thursday.
