Judge delays criminal trial for Jackson doctor

yeah I still wonder why White has not given any of his testimony in writing or in a written statement. Mike didn't have demerol in his system so Whites' speculation should be excluded. He is an expert in anesthesiology and propofol but if he gets up there and said what Murray did was right and ok in his book then he will be losing his license. I wonder if he has ever left any of his propofol induced patients alone at home in the bed

White does not want to put this in writing because he knows it is a bunch of hooey. The most he can say is when prop is given correctly, as Murray did, it is safe. I hope he remembers that there would be cross-examination. Many experts forget about the cross-examination, and I have seen them look very foolish indeed. They begin to stammer and can't think of answers to explain the evidence in a way the jury will believe.

^^If White is their most important witness, then the defense should just tell Murray to plead guilty. White is the doctor who said Michael was addicted to a drug that was not even in the autopsy report. Is it possible that the defense could get a doctor who can give evidence to back up the REAL autopsy findings?

It is just that when we heard about March, we were expecting the trial would be finished by June. Now we don't know.
 
I too think that this was actually planned tactic by the defense - which failed.

They asked for speedy trial and argued that they were getting ready for the trial and that's the reason why they didn't turn in any discovery. If they were to get away with it, they would give prosecution limited information and make them unprepared.

Luckily the judge is holding on the no surprises and 30 day before the trial discovery rule.

I agree... But the DA in the OJ trial was no match for Johny Cohcoran, Rob Kardashian, etc.
I don't think it's a bad thing that it's delayed because most murder cases take about two years to go trail anyway. They just finished handing out the verdicts in Anna Nicole Smith case in 2009 and 2010 and she died in 2007.
Correct me if I'm wrong.. From the article the reason they are delaying the case is because the evidence wasn't presented to both sides. The defense s the side that doesn't have their stuff together??

it will end up well i know that i believe that and it must be that...

4 weeks alright if they than start trial and get a cross exam like in prelim and they have no anwers there done.. so 1 favor for the defense is delay the favors for pros comes.. wait and see it will be our turn to strike back
 
For me this is a shame. This guy is being given all the time in the world, while an innocent man was given no single chance at all. The kids have been stolen his father. We have been stolen a man we loved to much. The world has been stolen his creativity, passion and talent.

I totally agree with you. Hearing this is just making me cry all over again. I am really beginning to think that no one cares about Michael Jackson. And the fact that there are 3 children now that no longer has a father in their lives. And these people are happy what Dr. Death did to him. It is just so beyond ridiculous just how f up my country's justice system is. I want to see justice for my beloved Michael now not later. That murderer needs to pay for what he did right now. He should spend the rest of his life in prison. Him only serving 4 years is just way beyond insane. This is truly junk justice to me. When any other killer who would kill a regular person. That killer will be in prison now. Waiting for their trial to begin. But no not Michael's killer his killer is out there walking around free. While that is something that Michael won't ever be doing again. Especially with his children.
 
So it's delayed 4 wks, I'm not sure what the defence are expecting to come up with in 4 wks, when it seems that the past two years produced zippo for them.
I know, mught as well delay it till June 25 and make it a bigger event. I undertsnd why this is taking so long, almost 2 years since Michael's passing and if they haven't gathered the evidence they need or came up with a defense they're going to run with they probably never will. This whole case hasn't sat well with me from day one.

The defense planned this. They expect to gain something by this delay, probably more psychological. I think they wanted a delay from the beginning but did not want to state it, so they planned this scheme. They would ask for a speedy trial and not give all the documents. This would force the Proc to suggest a delay. They wanted that move to come from the Proc not them.

This delay is just disgraceful.

Sickening. This so called doctor has continued to practise for almost two years after blatant bad practise which ended a man's life. Where is the fairness in that? The trial should have been much speedier and Murray should have had his license taken away until it was resolved.

I totally agree.. it is totally sickening.. Poor MJ has not gotten justice in almost 2 years and Murray so blatantly and cruelly snuffed out his life. He drugged him to the max, didn't monitor him and then left him to die and this fool still is practicing medicine as a cardiologist. Where is the fairness in all of this?

Michael has us fighting and praying for him but I ask again where is his family? Where is the outrage over this farce?

i dont get why ppl are saying this is bad for the prosecution and are unhappy that its been delayed. this is GOOD news. the defence went out there with a plan to get to trial with the prosecution having as little of the defence case evidence as possible. call for a quick trial then withhold their evidence for aslong as possible so the pros will find it harder to counter act murrays defence because they wont have witness statements etc. it was total gamesmanship by the defence that if allowed to have gone on would have damaged the chances of a conviction.thankfully the judge aint taking any of their crap

Looks like the prosecution wanted the delay...but I don't quite get it. If the defense is not ready why wouldn't that be good for the prosecution? Or are they, the pros., concerned that the defense will pull some surprise?
as i said above the pros asked for a dealy cause the defence arent handing over their witness statements. how is the pros for example going to counter act what that expert on dip is gonna say about demoral if the pros dont even have his sworn statement about what hes gonna testify to on the stand. if the pros dont know what hes gonna say in court how are they supposed to get their own expert in to counter act what the defence witness will say? the pros needs to counter act murrays defence yet if the pros dont have the evidence and witness statements of what the defence witnesses will say how are they supposed to do that? they cant.and that is why the defence are claiming they dont have witness statements to hand over which imo is rubbish. they are trying to withold important info from the pros nothing more.

the judge is concered about the defence not being ready cause it damages murrays right to a fair trial. and gives him something to use as a basis for an apeal after conviction.the judge is there to see that the law and rules are followed right. and to make sure the defence hand over their evidence to the pros which they havnt. the main issue is that if there wasnt a delay it would have hurt the prosecutions case more and thats why it was the pros who were asking for the delay and the defence were the ones agruing against it
 
good post elusive.. It sounds like to me that the defense wanted a speedy trial without giving the prosecution any of there evidence. Now they know that is wrong and unlawful. Discovery is needed on both sides and the defense is trying to ambush the prosecution. I'm pretty sure their expert is smart enough to write down a statement regarding his expertise on propofol

A judge today delayed the start of opening statements in the involuntary manslaughter trial of Michael Jackson's personal physician by just over a month.

Los Angeles Superior Court Judge Michael E. Pastor said prospective jurors are due at the downtown courthouse on March 24, as initially scheduled, to fill out questionnaires in the trial of Dr. Conrad Murray.

But he pushed back opening statements -- which had tentatively been set for April 5 -- to May 9.

The judge noted that he did not want to push back the March 24 date because several hundred prospective jurors had been summoned that day.

"I did not warn to burn prospective jurors," Pastor said, noting that they are a rarity in the current economic climate.

The judge noted that material about prospective witnesses is still being exchanged between attorneys, and he thinks "this is a very realistic view of the case."

"We're going to have a lot of work to do between now and then," the judge said.

Murray, 58, is charged with a felony count of involuntary manslaughter stemming from Jackson's death at the age of 50, amid a series of rehearsals in Los Angeles for an upcoming series of sold-out concerts in London.

Murray is accused of administering the powerful anesthetic propofol to the singer to help him sleep, then failing to properly monitor him.

Jackson was pronounced dead at 2:26 p.m. on June 25, 2009, after doctors at Ronald Reagan UCLA Medical Center were unable to revive him.

Paramedics who responded to the entertainer's rented Holmby Hills estate about two hours earlier said he appeared to have been dead for 20 minutes to an hour.

Murray proclaimed himself "an innocent man" during a Jan. 25 court appearance, two weeks after he was ordered to stand trial following a six-day preliminary hearing.

I agree.. Thanks for making it clearer for me. I knew one side hadn't presented their evidence to the other side, but I didn't know who. As you stated in your last paragraph it s very important.

Worst case senario: ( if the judge didn't delay it) Muarry gets convicted. After he is found guilty he appeals his conviction on the grounds of "x, y, and z" and then he is set free. That would suck big time.
Also it's not that no one cares, because if they didnt the DA wouldn't have picked up the case. They are just making sure everything is done right to ensure a fair trail on both sides.

How can Murray claim he is innocent? Michael was under his care heavily medicated with anesthesia. Michael dies under Murray's watch. How is Murray not responsible?

This is extremely upsetting I understand that this case not being delayed would have hurt the prosecution more, but the issue here (at least the issue I have) is, that Michael's being deprived of ANY kind of justice since the day he died. It's been nearly two long years, it almost took half a year to charge this lying bastard with anything. The fact that this SOB is only facing a maximum sentence of 4 year IF convicted AT ALL, is extremely upsetting, and this new delay is even further upsetting. The way it seems to me Murray is getting all the time in the world, he is living his goddamn life, life that Michael was denied to live. I've seen numerous pictures of this ass parading around his bastard son and stripper girlfriend, having photo op's at Forrest Lawn, going shopping, having dinner, sunbathing etc etc, he's even allowed to practice medicine while not so long ago Michael Jackson was denied the basic right of being innocent until proven guilty.

exactly. and the judge is wanting to make sure the pros get a far trial aswell. interms of they have legal right to have the defences evidence at least 30 days b4 the trial starts.if the trial had started at the end of the month that right would have gone out of the window. its a typcial tactic of lawyers to delay handing things over to try and get one over the otherside. a weak judge may have allowed it but this judge seems to very good from what we have seen so far. not like melvile. so yes we all want this over. but like a wise man once said lies win sprints the truth wins marathons. id rather wait a few more months and get a conviction then see the games the defence have played lead to an aquital.as if hes aquited i dont believe theres any comeback for the pros unlike the defence

Opening statements have been pushed back in the trial of Dr. Conrad Murray who's charged with involuntary manslaughter in the death of pop superstar Michael Jackson, RadarOnline.com is reporting.

Jury selection will begin this month as planned, but opening statements have been postponed until May.

Superior Court Judge Michael Pastor announced Wednesday that opening statements will begin May 9 after meeting in closed session with Murray, his attorneys and prosecutors.

As RadarOnline.com has previously reported, prosecutors say Murray -- a Houston-based cardiologist -- gave the King Of Pop a lethal dose of the powerful anesthetic propofol, which is normally administered only in hospital settings.
Murray has pleaded not guilty and maintains he did nothing wrong.

Murray consented to the postponement after his attorneys and prosecutors said they could be ready for his involuntary manslaughter trial by then, a transcript of the closed session meeting shows.

"It is only acceptable to me if this is not strung along over a long period of time," Murray told the judge, according to the transcript. "I don't want to lose my constitutional right to speedy trial."

Conrad -- Jackson's live-in physician at the time of his death -- has been seeking a speedy trial because of financial difficulties. He told Superior Court Judge Michael Pastor he understood the delay was necessary to allow both sides to better prepare for the trial, which could last up to two months.

Murray told the judge he would agree to the delay if the screening of prospective jurors begins as scheduled on March 24.

The judge agreed, saying he did not want to lose a jury pool and that a month-long delay might allow potential jurors to re-arrange their schedules for what could be a lengthy trial.

Pastor scheduled a status hearing for March 9.
