Michael Jackson could not have swallowed anesthetic, doctor says

A medical expert for the prosecution in Dr. Conrad Murray’s involuntary manslaughter case says it would have been impossible for Michael Jackson to have swallowed the fatal dose of the powerful anesthetic propofol, attorneys said on Friday.
The physician’s defense team has contended that Jackson, desperate for sleep so that he could be ready for rehearsals for his comeback tour, drank or injected himself with the drug while Murray was out of the room. At a preliminary hearing, they zeroed in on levels of the drug found in Jackson’s stomach at the time of his autopsy.
The prosecution expert “says categorically it’s not possible Michael Jackson orally ingested propofol, based on the science,” Deputy Dist. Atty. David Walgren told Los Angeles Superior Court Judge Michael Pastor at a hearing Friday. But attorneys during the hearing did not go into detail about why the expert reached that conclusion or what the science behind the opinion was.
Defense attorneys asked the judge to exclude the testimony of at least two of the prosecution’s new medical experts, saying they were being “sandbagged” with brand-new theories on the eve of trial, set to begin with jury selection next week. They argued that prosecutors had violated rules on turning over materials prior to trial.
“I think the only remedy in this case is not allow these two experts to testify,” said attorney Michael Flanagan, saying they could not be ready to respond to the experts’ opinions by the time of trial.
Pastor declined to bar the witnesses from testifying, saying “there are sophisticated forensic issues involved.”
Attorneys are expected back in court Friday afternoon to discuss a possible delay in starting the trial.

Defence have got a fecking cheek.they are the ones that brought up the drinking theory at the last min.yet they act like the pros just brought it up out of the blue.

Exactly elusive.. did Flannagan and company think the prosecution was not going to counter what they were saying? they are the ones that brought up ingestion and drinking. Of course the prosecution was going to counter that

And the defence shouldnt need extra time as they are the ones that created the theory therefore they should already have their evidence to support it

Murray just needs to man the hell up admit his guilt and take his sentence like a man...enough is enough already of the defense bullshit....start the damn trial and put his sorry ass in jail for the 4 years....it should be life in prison...he took Michael's life.

I have difficulty reading this stuff it makes me so damn angry. More bullshit and delaying tactics from the defense. The pig thing is disgusting. How ****** dare they! It's ridiculous - another attempt to dehumanise MJ even further in people's minds. I wish this whole thing was over. I wish Conrad Murray wuld disappear off the face of this earth.

we don't know whether that will be done or not but animal testing is normal. They do test the effects of the drugs on animals and pigs are suitable for body weight etc. It's not like they can give the same propofol to a human and see what would happen.

LOS ANGELES – Lawyers for Michael Jackson's doctor told a judge Friday they may need a delay in his upcoming trial because prosecutors have disclosed new witnesses with surprising scientific theories the defense did not anticipate.
Attorneys Edward Chernoff and J. Michael Flanagan argued that the new evidence against Dr. Conrad Murray should be barred from the trial because it arrived too late.
Deputy District Attorney David Walgren said that would be absurd and called the situation the defense team's own fault for refusing to delay the trial when he and the judge suggested it.
Among the new expert opinions proposed by prosecutors is that Jackson could not have caused his own death by swallowing the powerful anesthetic propofol because it is not absorbed through the intestines.
At a preliminary hearing earlier this year, the defense posed the idea that Jackson, desperate for sleep, swallowed the drug while his doctor was out of the room. Propofol is normally is administered intravenously for surgery.
Superior Court Judge Michael Pastor said he would not exclude the expert testimony and declared he prosecution was not trying to "sandbag" the defense by disclosing the witness so close to the possible end of jury selection next week.
"This case involves sophisticated scientific issues," Pastor said, adding it was likely that new theories would arise during discovery of evidence.
"I'm not surprised by the situation," the judge said. "I anticipated these problems when I was advised that this case was going to proceed within 60 days after the preliminary hearing."
Murray, who has pleaded not guilty to involuntary manslaughter in the death of the pop superstar, has insisted on moving forward quickly.
Walgren said the prosecution, which originally listed 11 anticipated expert witnesses, has cut that down to four, most of them new.
"When the first experts got into this, it was not anticipated the defense would go with the theory that Michael killed himself," the prosecutor said. "This is a situation they created ... It was always our theory that Dr. Murray was incompetent, untruthful and caused the death of Michael Jackson."
With the new defense theory in play, prosecutors had to seek new scientific experts, he said.
Flanagan said he and Chernoff now need additional experts to respond to the newly added prosecution witnesses.
Chernoff was scheduled to report back to the judge later Friday. He said he would consult with Murray to determine whether to request a delay.
Jury selection, which began with a panel filling out written questionnaires, is set to continue May 4, with opening statements the following week.

The defense has just informed the court they will be filing for a delay on Monday.Judge aPastor acted as if he were quite upset making mention of six figure funds the court had spent as well as numerous departments placing countless hours into prepairing for the case.Once the session recessed both sides of counsel spoke with eachother and perhaps the defense was asking the prosecution to withdraw their latest witnesses. The way things are going nothing is certain. Is this what they planned all along? Please see my article "Accomodations" 3.16.11

It seems like the defense strategy failed. From autopsy report we saw that prosecution was ready for injection theory so the defense came up with drinking theory and asked for a fast trial so that prosecution wouldn't be ready for it. Now they got an expert, the defense is trying to come up with how to respond to it and therefore they need more time.
