Jury sequestering discussion / Appeal / Stay denied

Re: Jackson doctor defense files appeal, seeks delay

Pastor is not the one making the decision. They are actually taking Pastor (and his decision) to a higher court.

Re: Jackson doctor defense files appeal, seeks delay

Seriously, how many delays can a trial have?
This is getting ridiculous.

Re: Jackson doctor defense files appeal, seeks delay

But isnt judge pastor the one who MUST make all the rules bout this trial?

Re: Jackson doctor defense files appeal, seeks delay

Personally, I agree that the jury should be sequestered. But not for the reasons the defense is talking about. I'm wondering if the defense has really been paying much attention to what the media has been saying about Michael for the last two years. Seriously, how is the media coverage all prejudicial to Murray when the media have been blaming Michael entirely for his own death from the very beginning? I don't understand that. This is all just my opinion.

normally yes. but they are accusing of Pastor abuse of discretion and asking for a higher court to evaluate his decision.

Re: Jackson doctor defense files appeal, seeks delay

Just when u think they cant get anymore desperate they do. How long will it take the apoeals court to rule. Total bluff as the media support murray and they hope a locked up jury will get fed up and just aquit for the sake of it

Re: Jackson doctor defense files appeal, seeks delay

Monday, September 5, is Labor Day, a U.S. public holiday. The Appelate Court probably will not start looking at the filing on Sep 6. So, the trial will most likely get delayed again. Jury selection is unlikely to start at the 8th.

Exactly.

Re: Jackson doctor defense files appeal, seeks delay

Just a quick question...

If a jury is not sequestered and the trial results in a conviction, would Murray be able to file a notice to appeal on the grounds of the jury making the wrong decision due to being "poisoned" by the media coverage? If that the case maybe it's better that they be sequestered.

I don't think the defense can appeal because the jury is not sequestered. Legally, jury's decision can not be wrong. The jury may not make a decision that sides with the truth. But, that's not wrong. Also, the jury is instructed by the judge to make decision based on evidence admitted in court, not information from the idea. Of course the defense can appeal on the ground that there is technical errors, like mistakes by the judge. Or, when there is new discoveries or evidence. Just my two cents. Ivy, please help.

Re: Jackson doctor defense files appeal, seeks delay

Thanks for the info love is magical. I was worried about that. :huggy:

Forgive me in advance if I ask silly questions as this trial gets underway. I'm no lawyer :D

Re: Murray: Judge made an error by not sequestering jury

You know I was thinking, and I feel that there should be a sequestered jury for this case. Not sequestering the jury could be positive and negative for both Michael and Murray. There will most definitely be Michael bashing and there will be anti-Murray as well in the media. It's a lose-lose situation for both sides and I think it would have been the smarter choice in order to have the fairest trial possible, since it will most likely involve HUGE media coverage. Knowing the crap that goes on about Michael constantly in the media, this couldn't be too good for him either. Too many people's opinions on Michael have been influenced by the media already. The people on the jury are only HUMAN and are not infallible! But I really hope the people on the jury have some brains and keep their minds as open as possible.

Sure, Murray wants this as a benefit to him, but it would also be greatly beneficial to Michael.

Re: Murray: Judge made an error by not sequestering jury

What dude, whatever...

Re: Jackson doctor defense files appeal, seeks delay

When Muarry is convicted I hope they charge him for all the extra occured expenses during this trial

Re: Jackson doctor defense files appeal, seeks delay

My heart hurts

Re: Jackson doctor defense files appeal, seeks delay

The issue of t.v cameras is also a bluff.what does that have to do with jury tainting.the defence just dont want the public to see the facts of what he has done

Re: Jackson doctor defense files appeal, seeks delay

I think I'm going to kill myself if this is delayed again. What a freaking nightmare. And I want it televised so people with half a freaking brain can see how messed up people around our Mike were and that he is NOT TO BLAME FOR BEING DEAD.

*sigh*

Sorry, I'm just really angry.

Re: Jackson doctor defense files appeal, seeks delay

Re: August 30th statement:A large point of our defense has been gutted," Murray's lawyer Edward Chernoff said, "but if we have to go to a tank battle with a switchblade, that is exactly what we'll do."

They will do everything to obstruct and delay that they can...they don't have much left in the way of defence...perhaps they are hoping that 'something will turn up' to help their case, and the more they delay the more time they have to find something.

Re: Jackson doctor defense files appeal, seeks delay

Funny how nobody cares about the character assassination of Michael in the lead up to the trial.

I think the next hearing date with Pastor is on the 6th, I wonder if that will still go ahead.

Re: Jackson doctor defense files appeal, seeks delay

How long do the appeals court take. Might they rush it through and make a ruling on tuesday seeing as its supp to start thursday? or does it not work like that.are we looking at a delay of days or weeks?

Re: Jackson doctor defense files appeal, seeks delay

It seemed the tv cameras didn't become an issue with Murray's team until after the judge rule that they couldn't bring in stuff from 2003 and a bunch of hearsay. The judge has narrowed it down to the weeks before Michael's death and Murry has next to no excuse at this point.

They try to use TII to prove Michael was ill in some form, but that didn't work and they can't really use the addict angle since all the drugs in his system when he died belonged to Murray. It's obvious they are running on empty. Which is why they now want to hide the cameras because this trial is becoming more about Murray and least about Michael.

Re: Jackson doctor defense files appeal, seeks delay

Twice denied due to dire finances, what do you expect the judge to do?
Is the Defence going to pay for the sequestration?
And what's with opposing a televised trial ?
I'm with talking heads zipping up and
staying the hell outta the picture..
but even to request denying a live feed?
Yeah right...might as well have the case heard in camera and the world be
obscured of Murray's gross negligence.
The things he do trying to cover up, the truth and all facts of the autospy report will never see the light of day. Pfft!

Re: Jackson doctor defense files appeal, seeks delay

Oh no please not another delay coming. Murray and his lawyers are doing this on purpose. All their ideas are going out the window and they are desperate. This is just painful to watch. How long will this nonsense go on?

Re: Jackson doctor defense files appeal, seeks delay

Just get on with it!

Re: Jackson doctor defense files appeal, seeks delay

Why am I not surprised?

Re: Jackson doctor defense files appeal, seeks delay

They can delay this trial but they can't stop it from happening so they might as well just save themselves and the world loads of time and just get it over with.

Judge Michael Pastor
had previously said that sequestering the jury might cost too much money, but the defense argues: “Although there is cost with ordering sequestration, it is comparatively minimal compared to to the costs that would be incurred by a retrial or new trial that would be required as a result as a result of jury contamination.”
Dr. Murray says his right to a fair trial will be compromised if the jury isn’t sequestered.

Don't know what the Appeal Court will decide, but if the argument Judge Pastor provided was the cost, they will probably accept the alternative the defense are asking for, the no TV emission.

I hope none of the two is granted, yet, I wonder if they will appeal a conviction with a jury not being sequestered...
