Man who bashed coworker with bottle for changing Michael Jackson song just beat the charges

A man who smashed a coworker over the head with a champagne bottle at a team-building happy hour - reportedly because the coworker changed the music from Michael Jackson to dubstep - was acquitted of assault and battery charges Thursday, according to the Public Defender's Office.

The bottle attack at San Francisco advertising firm AKQA reportedly occurred April 27 of last year after the coworker, who witnesses testified was extremely drunk and inhaling nitrous oxide, switched the music from Jackson's "Wanna Be Startin' Somethin" to an electronic dance track and proceeded to dance.

Gaspar Magisa, 52, who had been pouring himself champagne during the music switch,"decided something had to be done," the public defender's office said.

The coworker ended up with 17 stitches and Magisa ended up with criminal charges that packed a possible five-year prison sentence.
But after a week-long trial and six hours of jury deliberation, Magisa was found not guilty.

That result is partly because Magisa wasn't the only AKQA employee who was annoyed with the coworker's music tampering. And frankly, the coworker proved to be the officemate from hell, according to Deputy Public Defender Jacque Wilson.

Before the incident at a company Christmas party, the attorney said, the coworker snuck up behind two men separately as they used a urinal. He poked a man's eye with his finger and smacked the other man's head against the wall.
During the trial, he called the bathroom incident "utterly hilarious."

Magisa had also been assaulted by the crazed coworker, his attorney said. And more witnesses including a police officer testified to incidents of belligerence and violence. At a Thanksgiving party, employees said, the coworker wrestled a homeless person while out on a beer run.
When a bubbling Magisa attacked with a champagne bottle last year, he was defending himself, Wilson said.

"The complaining witness was a bully who had injured people again and again," Wilson said. "Mr. Magisa is a kind and gentle man, but he wasn't going to allow himself to be hurt again."

Public Defender Jeff Adachi added, "Standing up for yourself against a person known for violence is not a crime."

HA, sounds like the co-worker is an asshole. Funny story, though. Sometimes people do need a good "smack" over the head to discipline them. That being said, he should know better than to turn off Michael Jackson. ;)
 
I feel kinda bad for the guy, but at the same time, you don't change MJ to crap.

Well, apparently the guy was more than annoying anyway:

Not the right person to feel sorry for IMO. I'm pretty sure the Judge didn't acquit Magisa because the Judge too was an MJ fan, but because of legitimate reasons.
So YES, it IS hilarious!
 
I really can't even condone anyone being violent and injuring someone because someone else is annoying, let alone find it amusing. The other guy may have been a bully, but that STILL doesn't warrant this kind of response in my book. There are ways to deal with bullying in the workplace - or even assault on this person, it seems - but taking the law into your own hands isn't it.

^^Oh that is a good one. You know, I can think of some people related to the trial, who need a poke in the eye. Maybe when the guy changed the Michael song he should have gotten a poke in the ear!!

nadalette yes we know all that about violence, taking the law in your own hands, bullying & the way to handle it. However, we are focusing on the funny aspect of the story, even though we know this is not the way for humans to act.

Also changing the music at a party when everyone else is enjoying it is just rude. I've been to plenty of parties where music is playing that i don't like but i never change it cause i can see that other people are enjoying it
 
If he was already assaulted, it was fair he defended himself back. Too much abuse to deal with, that bully deserved a good lesson and tuning Michael off was the last straw. It was a matter of time for him to explode and the "turn the other cheek" thing is :bs:.

I'm still :rofl: trying to imagine the scene!

^^This is good. Didn't we have another story like this about a husband and wife in England? I think the wife was an MJ fan and the husband was not and called Michael names. For a slender and gentle man, Michael can sure bring out some strong emotions in people. We need to compile all these funny stories.

Creds, ain't no one ever changing my idols to crappy dubstep of today (other than nero:speed demon) dubstep is something that is way overproduced and Michael's music does not belong anywhere near this genre.
 
Man, MJ fans got alot of pent up emotions when it comes to MJ! so that's when one normally blows up! I can understand! hehe but all the stuff that guy was doing, I would have been retaliated against him! lol
