KJ vs AEG - Appeal Thread

They'd better hurry up, KJ is not getting any younger.

Ivy, I know this was asked before, but I cannot remember the answer (see ref my previous post:)), can someone else take over this case if KJ passes before its concluded?

Yeah you remember we were discussing that maybe one of the reasons why they are appealing, is that if she died her winnings, if she wins the case, would go to her heirs. To me, that is the only reason why they would allow someone at her age to endure such a cruel and time consuming experience and activity. They feel even if she dies her winnings will survive.

Let's see if the attorney did better this time around.

^^Funny!! Yeah what does the surreply brief mean. Is that the name they give it when it is not the first brief? You know like redirect cross examination?

normally there's opening brief (by Jacksons), response brief (by AEG) and reply brief (by Jacksons). Now AEG wants to reply to the reply brief.

:blink: It sounds like a legal version of a hamster in a wheel! How many times can they reply to each other's briefs and for how long? Is there a time limit, a number limit? No wonder our courts are clogged up with :bs

Good news!

I believe the AEG reply would be allowed if there was new information in the Jacksons’ reply to their response. It seems the AEG reply would rehash points already discussed so, time has been saved.

I wish the Jacksons' success with this appeal.

LOL.. This hasn't been really a hamster in the wheel situation. Pretty routine appeal with just 1 month extra time for each brief.. so an average appeal takes about 15 months..so if we get a decision by Feb 2015 this would be pretty routine and average. and I think that's when this one would approximately be decided.

HTWF case was a real "hamster in the wheel" and I think they still have an open request in HTWF case. I just got so tired and bored to follow that one..
 
^^Funny!! I got so used to the "hamster in the wheel process with especially Johnson, that after a while all the cases seems to be like that. Glad to hear that this one has not sunk into that situation yet.

11/20/2014 Grant request to continue oral argument. Appellant's request to continue argument is granted. The above-entitled matter is rescheduled for January 22, 2015 at 9:00 a.m.

so oral argument has been moved to January 22.

As for media don't worry, court's ruling will be available online.

LOS ANGELES — A California appellate court has heard arguments on behalf of Michael Jackson's mother for a new trial in her lawsuit against concert giant AEG Live LLC.

Attorneys for Katherine Jackson told a three justice panel of the 2nd District Court of Appeal in Los Angeles that a new trial should be ordered because jurors who decided a nearly six-month trial in AEG's favor last year were given an improper verdict form.

Katherine Jackson sued AEG, the promoters of her son's ill-fated "[lexicon]This is it[/lexicon]" comeback concerts, claiming they were responsible for her son's 2009 death because they hired the doctor who administered a fatal dose of anesthetic.

AEG's lawyers however argue that the Jackson family matriarch's attorneys sought the exact question jurors used to decide the case in AEG's favor.
