I still don't get how is it AEG's fault that Michael was cold and wearing coats and if he was so sick like they say he was what was wrong with him?

do not think of this as determination of "fault" it's simply that the judge might have thought that a jury has to decide about this claims.

It's all about where the responsibility begins and where it ends.

For example
- one might say as Michael was ill a few days ago they should have cancelled the rehearsals for some time
- others can argue that as they sent Michael home for the day and he and his doctor said he was fine they didn't need to do anything further.

similarly
- one can argue that as Murray as a legit doctor with no malpractice that's all AEG needed to know.
- others can argue that regardless AEG was required to ask "what are you doing" to Murray.

Judge could have said "it's better if we let a jury decide".

yeah.from what we have seen over the years with civil cases most seem to go to trial cause the judges prefer the jury to decide unless its obviously a false case or the allegations dont stand up in a legal sense. ie the judge telling the family to go re write their claims over negligence etc

Is the information of him receiving money from AEG as part of

the advance to MJ, and TT International ( Tohme's company)

having a separate agreement with AEG false?

As for my own opinion on this whole thing! I feel as though no one can be trusted, people stories have changed and that's makes me more then just a little comfortable to say the least! Saying MJ was 50 and a grown man don't cut it! And I'll leave it at that!

I think that is not a clear-cut legal area, that would have to be decided by the courts. If I need a car, and a friend buys the car (takes out a loan?) and I'm supposed to pay the friend back (increments, or whatever), the one who bought the car IS responsible for it. (And then there is the issue of who "owns" the title of the car). But, if the friend was paying on a loan for the car (for example) then that person IS responsible, or could be, under the law.

LOS ANGELES — A judge has ruled that Michael Jackson's mother can sue entertainment giant AEG on behalf of the singer's family, allowing her to claim that the concert promoter was responsible for medical decisions that led to Jackson's death.

Los Angeles Superior Court Judge Yvette M. Palazuelos on Wednesday denied AEG's motion to dismiss the suit on grounds that Jackson was responsible for his own medical care and hired Dr. Conrad Murray, who has pleaded not guilty to involuntary manslaughter in the pop star's death.

City News Service says the judge ruled that Jackson family lawyers will have to show evidence of fraud, negligent infliction of emotional distress and civil conspiracy.

The judge gave Jackson family lawyers 20 days to amend the complaint.

so does this judge believe that AEG hired Murry and NOT Michael? Or is that for a Jury to decide? Also....IMO..the Jackson may have their own personal agenda for filing this lawsuit...but ..maybe it will help get more valuable information out there as to what happened to Michael.....Who know anymore.

As far as I can tell from the above article :

breach of contract (not caring of MJ's wellbeing) and negligent hiring, training and supervision of Murray claims stands and can go to trial

but

fraud, conspiracy and emotional distress of Prince is thrown out for the time being- unless KJ can come up with evidence to support those claims.

What kind of fraud did AEG do according to Katherine?

How was the conspiracy layed out according to KJ? (was it that MJ put up his assets in the contract and they all knew he wouldnt be able to make the shows and then AEG would get his assets? Some ppl claim AEG knew MJ would never make it hence they filmed the rehearsals).

It seems as Prince will be dragged into this. Does he have to testify that he saw his father being mistreated by AEG the weeks/days following June 25th???

I wonder if they both offered their testimonies to the lawyers or just waiting to be called?

I'd be interested in what they have to say under oath.

As far as I know, I've never heard them say anything about drug addiction and their testimony could finally put to rest this myth that some family members are perpetuating.

It looks like Katherine will be spending the next year in court between the two cases. I hope to God she doesn't get herself sick at her age. She needs to stay fit and healthy for the sake of Michael's children. Another tragedy at this time in their life would be awful.

It's for a jury to decide. Judges main role in these type of cases is to make sure that there are legal grounds and that the law is followed.

Like elusive said if the claims do not stand in regards to the law - they'll reject those. Anything else -that satisfies the legal grounds - will be left for a jury to decide.

again a case going to trial doesn't mean "guilty" it just means that it can continue further.

Fraud - KJ claim that with MJ-AEG agreement that AEG promised to look after for MJ's well-being and told MJ that they hired Murray to keep him healthy. KJ also claims that it was actually done to get MJ to rehearsals. Therefore saying "I'm doing everything for your well-being" but actually "trying to get him to rehearsal no matter what" is a lie and therefore a fraud.

Conspiracy - it's mentioned in every claim. Civil conspiracy means this

"In law, a civil conspiracy refers to collusion between two or more individuals or entities that share a common plan to commit an illegal or wrongful act that leads to an illegal or unjust end result."

so you can see it needs 2 or more parties, coming together and planning and carrying out a wrongful act against one person and resulting him harm.

In KJ's lawsuit this claim has nothing to do with the concerts or MJ's catalog. For example in the above fraud claim the civil conspiracy will be like AEG defendants (Phillips, Leiweke, Gongaware) meeting together and planning in advance how they are going to lie to Michael to harm him (in anyway) and carrying out their plan and actually hurting him.

emotional distress claim - I think they'll remove it because they cannot satisfy it. Emotional distress claim requires the person to see the event and understand it's harm. As Prince didn't see Murray giving MJ propofol and as when he saw CPR efforts he didn't know it was because of Murray - it's very unlikely that it will stick.

I thought it was against Michael also since we heard that Michael was scared of missing rehearsals and afraid AEG would pull the plug on the shows and Michael Bush said on TV Michael told him something like "Please don't say anything" (regarding his loss of weight).

as we learned by the testimony Prince the only one that went upstairs before the bodyguards and when bodyguards came Prince was standing by the bedroom door watching and Paris was on her hands and knees outside the door. So it's likely that Prince saw it and Paris didn't.

I have to say..I am probably amongst the minority that is not happy about Kenny's name being taken off the lawsuit...and that is ok. I feel by taking him off that the door is being closed for others that may have been responsible for Michael contributing death....I realize my opinion is not a popular one. But I just felt that I had to post it and get it out....I still and always will feel that everyone around Michael on a daily bases in their own way helped contribute to is death....they ll saw him ..they all had eyes. Everyone chose to say nothing..do nothing..except insist that he gets up on that stage. Michael is gone now and they have to live with themselves. ...alot went on behind the scene that we will never know about.... Like I said I don't expect to be applauded for my post....I do however hope I can be respected for my opinion.

I respect your opinion, but do see things with a different, perhaps even niave view. I was actually glad Kenny was there for MJ. To me, he was somewhat of a middleman between Michael and AEG. I think it would have been horrific for Michael if he hadn't had someone to act as a buffer for the company that he now basically worked for and the vision he wanted to accomplish. .

This was a different tour experience completely for Michael. He was not upfront footing the bill and therefore was not completely in charge. He was in a position where he had to take orders, instead of give them. I would have hated an AEG executive directing him and dictating to him what he should and should not do in the actual execution of his performances. I do believe Kenny always respected him, took in everything he said seriously, and made the best decisions to carry out Michael's wishes and the needs of the tour.

In my opinioin, with Kenny there, MJ was not alone in this new situtation for him. He had someone who was in a position of authority but still was in his corner. And this someone was a person who instinctively was in tune to what he wanted to create because of their long history of working together.

I just don't believe after a few weeks Ortega developed this blinding allegiance to AEG or Colony to the extent that he no longer cared about MJ after years and years of a successful professional and personal relationship. As has been often reiterated, Kenny was a major motion picture director. He didn't need this concert series at this point in his career, even if it was with MJ. If anything, the import of TII was far more relevant for MJ's career than it was for Kenny's at this stage.

I know there are bad people out there in every area of life. But as MJ fans, we are painfully aware of how a set of circumstances can be misconstrued and an innocent person can be lumped in the same pool as those with bad intentions. I've seen no evidence to suggest Kenny Ortega was this bad unscrupulous person who had abandoned all feeling for MJ for TII. Yeah, he definitely wanted to pull all the elements together to get the show up and running. But I believe Michael wanted that too and wanted him to see to it happening. So I'm glad Kenny was eliminated from the suit. I wouldn't want him to suffer and be presumed guilty just by association with AEG.
