MJ Estate versus Melissa Johnson and HTWF /Update: Settlement Enforced - HTWF lost the Appeal

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

girl I agree.. It is just so awful.. Michael since the age of 4-5 years old has been a commodity to that woman and her husband.. I am even questioning her 'love' for MJ the man myself now. MJ was a dollar sign to her and that's it. The family's true colors are definitely showing now.

Sadly, I have to agree.

It's so incredibly sad. It's a wonder Michael turned out to be the good person he was. But then it's no wonder he turned out to be as tortured as he was. I can't imagine how does it feel to grow up with the feeling you are nothing but a money bag for your parents, for your family. :(

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

I have no promlem with katherine requesting more money for her and the children
It is all the leeches that surround her with all these side deals wanting a piece of the pie that concern me.
Im sure katherine would be very comfortable with her life style and wouldnt be involved in any of this if is wasnt
for certain family member pushing for this. They want a piece or they want to take over estate. Im glad Michael
protected it with stealth armour so they cant get their hands on iteven if branca is disposed which he wont be
the Jackson do not get control _ Thank God

(but I do fear for how they are brain washing the children and will use them to get their dirty hands in the pie)

And now AP is running the story

Michael Jackson's Mom, Estate, Clash Over Charity

Michael Jackson's mother and singer's estate clash over foundation and charitable legacy
THE ASSOCIATED PRESS
BY ANTHONY MCCARTNEY AP ENTERTAINMENT WRITER

"Heal the world. Make it a better place for you and for me." So sang Michael Jackson in his mega-selling 1992 anthem for change.

Now the singer's estate and Jackson's mother could use a little healing themselves as they fight each other over the non-profit Heal the World Foundation, which claims it's the successor to the pop star's defunct charity inspired by the song. At stake in the skirmish are trademarks worth millions of dollars and a piece of Jackson's legacy.

The dispute, which is playing out in a federal court in Los Angeles, is the latest example of the sometimes strained relationship between Jackson's family and the estate he left in place that has already earned hundreds of millions of dollars.

But the fight against the new incarnation of the Heal the World Foundation has also raised questions about which causes the singer would want to focus on if he hadn't abandoned his charity to fight off allegations of child sexual abuse.

His mother, Katherine Jackson, left little doubt about where her sentiments lie in a recent court filing: "It is not my desire, nor would it be the desire of my son Michael, to continue this lawsuit against Heal the World Foundation."

Last year, Jackson's mother and father joined Heal the World's board of directors and elected to have their three children added to a youth board. Jackson's mother and his children were prominently featured on a recent "Good Morning America" story that also included footage of Heal the World giving a $10,000 donation to a shelter in Los Angeles.

It was a high-profile plug for an entity that according to tax filings reviewed by The Associated Press has done little fundraising or charitable giving, but has fought to stake its claim to several Jackson-related trademarks and likeness rights that the singer's estate maintains it should own.

The estate did not immediately respond to requests seeking comment about how Katherine Jackson's support for Heal the World is impacting the case or the estate.

The foundation's director, Melissa Johnson, claims the pop singer handed her control of Heal the World through intermediaries in 2005, when he was defending himself against child molestation accusations. Despite never having personally met the singer, Johnson's attorneys claim she has the right to manage the charity, use various trademarks and that the permission now comes from the Jackson family itself.

The singer's estate counters that even if Michael Jackson granted Johnson rights to the charity, which it denies, the estate has revoked the permission and Johnson should be barred from using Jackson's name, likeness, and the name Heal the World for any future endeavors. The estate owns Jackson's likeness rights and numerous trademarks and copyrights that have been used to market new products since his June 2009 death.

"People are saying I have been manipulated by Melissa Johnson and that we are exploiting my grandchildren because we joined Heal the World, all while the executors convince people they are only doing what Michael wanted or what is in my best interests by suing everyone who help (sic) us," states Katherine Jackson's declaration, which was offered as sworn testimony in the case. "Please do not believe them. It's not true."

Complicating Katherine Jackson's involvement with the foundation is her business relationship with Howard Mann, a businessman who obtained some of Jackson's recordings years ago. Mann, who is paying to defend Heal the World in court, is also being sued by the estate in a separate lawsuit that accuses him of infringing on estate copyrights.

The singer's estate, which has paid millions in the nearly two years since the pop singer's death to support Katherine Jackson and her grandchildren, claims the organization is trying to supplant the trademarks and has no legitimate affiliation with the singer.

The estate won a preliminary injunction in April 2010, barring Heal the World Foundation from using Michael Jackson's name, likeness and trademarks on its website, but in recent weeks several of the pop singer's former confidantes and his mother have cast their support with Johnson.

The lawsuit has reignited division between Jackson's family and the overseers of his estate, namely co-executor John Branca. Branca was Jackson's longtime attorney, but did not work with him for several years until being re-hired shortly before the singer's death.

Since Mann's involvement in the Heal the World lawsuit, several former figures from Jackson's sphere signed statements saying they were aware Michael Jackson had given Johnson authority to run his charity. Among those expected to testify are attorney Brian Oxman, who was fired from Jackson's criminal defense team and now represents Jackson family patriarch Joe Jackson, and the singer's former manager and spokeswoman Raymone Bain. Bain sued Jackson before his death for $44 million dollars, claiming she was cut out of her share of the deal for the singer's planned series of comeback concerts titled "This Is It."

In written testimony, Bain stated she became aware of Johnson's actions in 2006 and that Michael Jackson told her that he had handed her the reigns of the foundation in 2005. Oxman claims Jackson told him to confer rights to the foundation to Johnson in 2005, but estate attorneys have cast doubt on the statement and say Oxman's name was never mentioned in years of correspondence from Johnson to Jackson's attorneys and representatives.

Johnson's attorney, Edgar Pease III, admits that there is no formal written agreement between Michael Jackson and Johnson regarding Heal the World. But he says the involvement of Jackson's mother and three children, who are entitled to 80 percent of the estate's earnings, means the foundation should have some legitimacy.

"The estate is suing their left foot," Pease said. "They're suing themselves."

He said Johnson's aim in applying for various trademarks was to preserve them for the charity and protect them from others. Tax records show in recent years, Johnson has not received a salary for her work on Heal the World Foundation, and in court filings claims she has spent tens of thousands of her own money to develop it.

Since Jackson's June 2009 death, there at times has been an uneasy relationship between the Jackson family and the estate. Michael Jackson's 2002 will calls for his mother and three children to receive 80 percent of his estate, with the final 20 percent designated for an unnamed charity.

Katherine Jackson had sought to challenge Branca and co-administrator John McClain's authority to run the estate in 2009, but dropped the bid.

In the meantime the estate has worked to repair major financial damage incurred by Michael Jackson during his lifetime. The "Thriller" singer died more than $400 million in debt, but in the first 17 months after his death earned more than $310 million, court records show.

More than $9 million has been paid to and for Katherine Jackson and her son's children. Nearly $4 million of that paid off the family's longtime home in the San Fernando Valley, with portions of the rest paying for security, staff and other expenses for the family.

For its part, the new incarnation of Heal the World Foundation spending has far outpaced its donations. Tax records for the nonprofit show that in 2009, the last year available, Heal the World, spent more than $76,000 in trademark and advertising fees. It handed out roughly $5,000 in donations.

In court filings, Johnson states she registered 1,800 website domain names and dozens of trademarks, which Pease said would give the foundation the basis it needs to fulfill Johnson's vision for the charity.

Pease claims Johnson came up with the idea for a Cirque-du-Soleil-style show featuring Jackson's work, as well as a telethon, television show, board game and other merchandise that would elevate Heal the World to a major charitable organization.

Jackson's estate is hoping next week's trial before U.S. District Court Judge Dolly Gee will end Johnson's efforts.

"The ultimate fact critical to this litigation remains, after over a year and a half of litigation, unchanged," the estate's attorney's wrote in a trial brief. "Defendants have infringed and will continue to infringe on (the estate's) intellectual property and Mr. Jackson's name, image and likeness to the fullest extent they are able to do so."

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

- Michael Amir Williams : There's also several emails listed as being sent to Michael Amir Williams , Michael's assistant at the time of his death. Interestingly there's also an email to Van Alexander asking him to vouch for Melissa to Michael Amir Williams so that he wouldn't think that she's just another fan.

Food for thought : So Michael's own charity's sole director needs introduction?

Thanks ivy, that's a good one. LOL!

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

Ivy, Didn't a judge determine how much money Katherine got a month? And if she gets more doesn't the judge have to ok that too? If you had to guess how do you feel this will all turn out? Because personally I want the estate to blast some of these people back to the stoneage. Seriously they need to take a look around this poor planet and be grateful for the HUGE blessings they have. I am choking on their greed!

One more thing and I will shut it! I realize the estate has made hundreds of millions of dollars but debts have to be paid and secondly maybe Michael wanted his grandchildren and great grandchildren to enjoy the rewards of his very hard work. But NOOOOOOOO! I think the Jackson's want to spend it all right now!

That was a pretty good article. I'm shocked that they actually did some research before hand. Pleasant surprise!

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

A big sorry mess :-/

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

As far as Katherine - Estate and her allowance goes they can discuss an increase, agree upon something and the judge could approve it if it's acceptable according to the probate. they raised children's allowance once, they can do it for Katherine as well. (and most probably Segye Times could file a document to get what Katherine is getting). Katherine getting more money is not an issue in my book.

You need to see the main issue here

Katherine - if true - in her statement labeled Branca as a man that Michael was worried about , a thief and this lawsuit as an awful thing that's not representative of Michael's wishes. Her "business partner" calls this events "corruption". Then you sit down to negotiations. My question is if Estate agrees to give her more money are they going to turn into wonderful people that Michael loved ?

If Katherine is entitled to more money she can simply ask for it. If Estate executors are being unreasonable she can simply ask it from the judge. Those statements aren't needed.

If she puts those accusations out but then does nothing to back them up and just sits down to negotiations for more money, I personally cannot take those accusations seriously and I can't see them anything more than intimidation tactics to force people to give more money.

See intimidation has been my feeling for sometime now. Estate doesn't include Katherine in their lawsuits, complaints, subpoenas. But yet the other side is putting her in a position against the estate. Why? Well to put them in a position that's "damned if they do, damned if they don't". If the continue to pursue this things they are damned because they are against Michael's mother, if they don't pursue them anymore they are damned because they'll allow anyone to do anything as long as they hide behind Katherine.

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

Thanks Ivy.

Unbelievable that the lawyer for the kids don't say nothing about that.

The vultures and morons try to have access to the money of the kids, and their lawyer say nothing! o_0

Really does break your heart, because the truth of the matter is, if HTWF didn't have those valuable trademarks which Johnson/Mann & the Jacksons want to exploit, KJ would be telling HTWF, "I'm sorry, we have to wait for probate".

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

the rush is cause katherine is the only way the rest of the family are gonna get money. once she dies thats it.her money goes back to the kids and it will be difficult to get at it unlike it is now interms of her hadning out a few $ when they com asking

That's what I think too. I still believe KJ is behind manipulated, and wants to make sure her other kids (the broke ones anyway) will have enough money once she's gone. For us, only Michael and his kids matter. Katherine had 7 kids. And I've lost the count of how many grandkids. She knows, and must be remembered by some, that a few of those other kids need, and will need money. She must find a way to insure their future too. In the process though, she's jeopardizing 3 of her grandkids financial future, and disrespecting her son's wishes. I dont think she even realizes that. I believe she's worried about what will happen to the broke branches of the Jackson tree once she's gone.
Shame should go to the others, who are playing the guilty and sensitive maternal cord.

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

What do you think will happen? Does the estate have a good chance of winning here?

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

Johnson's attorney, Edgar Pease III, admits that there is no formal written agreement between Michael Jackson and Johnson regarding Heal the World.
That's what will doom them in the end! Hearsay won't be good enough, u need proof! And saying because Katherine and the children approve this fake charity and that's good enough is pure B.S too! What a sneaky way to try to get there way!

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

So Katherine hired Perry Sanders. Any info on him?

"a big time litigator who, among other things, was pivotal in securing the publishing rights for the proper owners against Master P and the No Limit Records catalog."

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

@ Katherine Jackson. Remember everything you son had to suffer when he was alive. Just remember. I don't know if there is a sensitivity chip in you, but maybe David Maloney can remind you what your son had to endure. I wish someone would send her this video clip, I doubt she comes to these threads anyway.

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

I wonder if Kathrine at some level realizes what she is doing to her own grandchildren.....one would think she learnt a thing or two by now.

My heart bleeds for them and Michael

What do you think will happen? Does the estate have a good chance of winning here?

Let's try to guess it then or see if we have "psychic" abilities as well

Count 1 : Trademark infringement (for unauthorized use of "Michael Jackson" mark)

Count 2: Unfair competition and false designation of origin (using these trademarks create confusion or deceive people to believe these items HTWF sell are connected or associated with Michael Jackson and MJ Estate)

Count 3: Trademark infringement and unfair competition under CA Law (for using the trademarks in commerce)

Count 4: Violation of right of publicity (the unauthorized use of Michael's name , image and likeliness).

There is a reason that she does not want to go the true route to request money, which is simply petitioning the court for an increase. I think the judge would want to confer with all parties involved, including the children's lawyer, because it affects the dollars. She would have to give a valid reason.

The thing is that now that the media has picked up on this story, which they love messy estate battles, the media is going to start fishing. That article doesn't paint a favorable picture of the charitable givings of the foundation at this point. What will happen when they start digging about who are the "long-time" associates backing up Johnson's claims, or the contract Mrs. Jackson signed with Mann, or her accusations towards Branca, or why so much urgency for more money.

The truth of the matter is that when the estate does not equal Michael's mother or his children. They are beneficiaries of that estate but there is a difference in saying that they are the estate as one quote from the article implied. What Michael did with his will and trusts are no different that a lot of wealthy people do to ensure the longevity and profitability of their estates. Mrs. Jackson needs to respect that Michael did not leave money to everyone in that family. If they all want to share from the pot, go to Janet's while they can ask for it straight from the source.

I think the estate should win since they are the ones in charge eveything related to Michael in the business sense. That's why Michael had a will and plans. He created the estate. There is no formal agreement with this person and Michael. She never even met him.

At the end of the day this will not end well for Mrs Jackson at the very best Mann or this Johnson woman will end up suing her. At the very worst she will get sued

Then, it will be time to play naive-and-innocent-frail-old-lady, and for the Jacksons to go on Tweeter

about how mean people are towards their saintly mom who just wanted to do charity from

her good heart without expecting anything in return.

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

Yes I agree with you 100%. I've been saying the same thing to myself that I think I finally understand what Michael had to endure. To feel like you are being used simply as a meal ticket and money maker is just wrong on so many levels. Just thinking about that does make me angry. I try to keep in it check because I do not want to send out the negative vibes. With regards to Prince, Paris and Blanket, I believe that Michael taught them very well. His children are very intelligent. I just hope they use discernment in their judgement of what is going on before their eyes;including with family members. I pray for that every single day. I pray they are protected from all the greed and selfishness that will no doubt be very prevalent in their lives. I believe Michael will watch out for them. We have to believe it.

Ivy, thank you once again for the updates. I will certainly look for your posts. I'm glad you have legal knowledge. It helps to have someone able to share some legal insight to what is going on without the media spin. Thank you very much.

It's not just Katherine but every person who's involved or not involved but thinks he or she has a right to get a slice of the pie...
It makes me sick! I realize much more now what MJ had to go through in his life...he could trust no one!
My heart bleeds for Prince, Paris, and Blanket. They didn't only lose their father but they will have such a hard life with all these fake people surrounding them. I hope they will find some true people..and I hope so much that they will always remember what their father taught them!

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

And now AP is running the story

Michael Jackson's Mom, Estate, Clash Over Charity

Michael Jackson's mother and singer's estate clash over foundation and charitable legacy

AP Updated this story with some new statements from Katherine's and Estate's lawyers

--------------

Her attorney, Perry R. Sanders Jr., said Friday that Katherine Jackson supports the charity but hopes that a more civil relationship between her and the estate can be restored. Sanders was hired late Thursday after Katherine Jackson's former attorney publicly cast doubts about the authenticity of her filing.

"Bottom line -- I am going to do anything in my power to try to tone down the rhetoric that has happened to date to the extent possible," Sanders said.

-----

Jackson's estate wrote in a statement to the AP that the new Heal the World Foundation "has no relations to Michael Jackson's charity that touched so many lives before becoming inactive several years before Michael's death."

The estate did not say whether Katherine Jackson's involvement with the charity was costing the estate money, but said the "costs would be far greater if the estate did nothing to protect (Michael Jackson's) name and his trademarks because others would be profiting from intellectual property that rightfully belongs to Michael's children."

"Mrs. Jackson has been told that Ms. Johnson's foundation is Michael's but that is not the truth," Jackson's estate said in a statement. "The estate hopes Mrs. Jackson will eventually understand the true facts and cooperate with the estate executors in selecting worthy charities as Michael would have wished."

The estate accused Mann of trying to secure Jackson copyrights for profit, which it said would deprive Jackson's children of money they are owed.

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

Jesus, the comments to this newest article are just nasty to the family. People are clearly disgusted by what they're doing.

The public now gets what MJ had to go through.

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

what I got from this latest AP release??....Katherine continues to support a fake charity....she STILL doesn't get it. This new Sanders lawyer of hers needs to tell her she is putting herself in a bad situation...but then again if he does that..no doubt she will FIRE HIM with her next breath...or Randy will..:ninja:

Re: Update: MJ Estate files supplement to their complaint against Melissa Johnson and HTWF

^^ and estate is still protecting her saying that she was lied to.

Like I said before Estate never includes her in any of their legal actions , they never accuse or blame her.

My guess is the $80,000 to pay off Alejandra came out of Katherine Jackson's pocket; so, now
she feels she is short of money.
