Murray sentencing hearing 29th November-/ UPDATE Judge Pastor Sentences MAXimum Penalty

Michael Flanagan is on TMZ right now.
he's such an attention seeker, by the way he acts out you'd think he's the small lawyer from houston and and chernoff. guess his hate for michael is strong enough to make a mockery out of his senile self.

elusive them Jackson's are still living in 1971 don't u know?

just saw the youtube video of Pastor's speech sentencing Murray,,,just wanna say,,,I LOVE Judge Pastor..and I Miss you Michael...there will NEVER be another KING OF POP. Today is the day that Michael Jackson got SOME justice..and for that I am thankful.

Michael Flanagan is on TMZ right now. Seems like he's implying that the documentary was in order to make some sort of income cause the judge had not allowed him to practice since January. Flanagan nor Chernoff approved of the documentary. Dr Murray was the one who wanted to do it. Used the money to pay for witness', legal staff etc Flanagan says he hasn't been payed in a LONG time.Says if he apologized today at court he basically admits the verdict is correct, if he denied wrong doing he basically would look stupid.
murray couldnt work since jan? were his licences suspended in tezas and vegas?

"Tape recording = Dr Murrays insurance policy".. well said Judge, well said

So so glad Pastaur spoke so well and direct! I love Walgreen and Pasteur!

I missed this because I was at work. Thank you to everyone with updates and helping those us who missed it.

I am relieved but I still feel angry. Murray thinks he did nothing wrong. I really hate him and I don't hate a lot of people. He actually feels offended and betrayed that Michael died. That Michael did this to him. He is so sick. During the trial is was having a good time shopping, getting pedicures and having fun at the beach. He doesn't care. I am glad the judge and jury saw right through him.

Michael was such a good person and it makes me sad to think how he probably had no idea how badly Murray was treating him. Murray probably from what it seems left him alone during the other times too not just that night. If he had any idea of that recording he would be mortified that Murray recorded him like that. That recording was hard to hear but it did help do good things. It helped show what kind of person Murray is and it has helped some people see Michael differently. Not everyone but if can change some people's minds that Michael was a good person than I think it helped. Michael was a good person and always thought about others. He would never hurt anyone.

4 years is not enough but I will take it. Now it will be forever known that Murray killed Michael. Michael is not here anymore. He can't enjoy his life and see his kids grow up. I hope Murray is never able to make a penny off what he did to Michael. I also hope that his life will seem like a prison and he always be reminded for what he did.

no his licence wasn't suspended in tx and nv it was just limited to diprivan and suspended in cali, nv and tx said they'd wait for murray to be convicted of an actual crime before makign a decision. so senile flanazepam is talking out of his wrinkled ass.

I can't stand TMZ, but I'm stomaching them for this Flanazepam phone interview. He said Murray was NEVER suicidal or lost his will to live. That info was apparently an act by Murray.

*EDIT* Flanagan quote just now: "If we can get that goddamned thing reversed, I would do it again." Harvey asked him about working another high profile case and that's how he responded. That "goddamned thing" he was talking about getting reversed was the verdict.

Delusions of grandeur, I see.... *roll eyes*

What i dont get: In the docu the lawuers speak of a believe Cm was innocent and that this would be the first case they loose with an innocent man. Why if that is true in there mind do they dont represent him in appeal? The story they told about that i dont buy it.
I think they 1 know he was quilty and 2 know there gonna loose the appeal so there not gonna dare trying.

what do you guys think?

http://abcnews.go.com/US/michael-jackson-doctor-serve-half-sentence/story?id=15047162#.TtVd1WNFu7s

Dr. Conrad Murray, the man convicted of involuntary manslaughter in the death of Michael Jackson, will likely serve only half of his four-year jail sentence due to a recent change in California law that allows non-violent felony offenders to serve their time in county jail instead of state prison.

Officials from the Los Angeles Sheriff's Department said the cardiologist, who was convicted of involuntary manslaughter, would more than likely be released in two years due to factors such as jail overcrowding.

District Attorney Steve Cooley said he was considering asking Judge Michael Pastor to modify the sentence so Murray's crime could be reclassified as a serious felony, which would then send Murray into the state prison system, where he would serve the entire four years of his sentence.

"This is going to be a real test of our criminal justice system to see if it's meaningful at all," Cooley said at a news conference after the sentencing.

Judge Pastor acknowledged he had no control of how much of the four year sentence he imposed the doctor would actually serve, saying it was out of his hands due to California law.

Pastor did, however, rip into Murray, calling his treatment of Jackson a "cycle of horrible medicine" and "medicine madness."

Murray, 58, treated Jackson like a "medical experiment," the judge said, which factored into his decision to hand down the maximum sentence.

"Four years is not enough for someone's life," Katherine Jackson, the singer's mother, said after sentencing. "It won't bring him back, but at least he got the maximum."

Jermaine Jackson said he would miss playing music with his brother Michael and being a family.

"One hundred years is not enough," he said.

Along with Jermaine, Katherine, siblings LaToya, Tito, Rebbie and Randy were present at today's sentencing, but did not speak, instead allowing family friend and attorney Brian Panish to read a statement on behalf of Jackson's three children and family.

In the statement, Jackson's children told the Los Angeles court that they lost their "father, best friend, and playmate" when the singer died, but stressed they were not seeking "revenge".

The statement asked the judge to "impose a sentence that reminds physicians they cannot sell their services to the highest bidder."

Michael Jackson's Doctor Sentenced to Four Years

"As Michael's parents, we never imagined we would live to witness his passing," Panish read, on behalf of the singer's parents Katherine and Joe Jackson. "There is no way to describe the loss of our beloved brother, son, father and friend."

The judge's tone grew sterner as he gave a scathing review of Murray's actions while treating Jackson, saying the doctor "violated his sworn oath for money, fame, prestige." He said there was a "recurring, continuous pattern of deceit, lies," and cited a "longstanding failure of character" by Murray.

Murray "unquestionably violated the trust and confidence of his patient," Pastor said.

The judge also mentioned the tape Murray made of a drugged-up Michael Jackson who was slurring his words so badly he could barely be understood and suggested that Murray was contemplating a new tactic if he needed one at a later date.

"That tape recording was Dr. Murray's insurance policy. It was designed to record his patient surreptitiously at that patient's most vulnerable point," Pastor said.

The judge called the recording a "horrific violation of trust," and asked, "What value would be placed on that tape recording if it were to be released?"

Prosecutor David Walgren read from a statement Katherine Jackson made shortly after her son's death, telling of how the family's world "collapsed" after Jackson died.

Walgren described how Jackson's daughter Paris was crying at the hospital.

"I want to go with you," she told her father after he had passed.

"He trusted he would be cared for by Conrad Murray so he would see another day," Walgren said.

He mentioned that Jackson had plans to go into filmmaking with his children, a passion they had recently developed.

Murray's defense attorney pleaded with Pastor to consider the cardiologist's humble beginnings and good deeds, stressing that this was an unfortunate, tragic chapter in the doctor's life.

"Whether he's a barista or a greeter at Walmart, he's still going to be the man who killed Michael Jackson," defense lawyer Ed Chernoff said.

Chernoff also put some of the blame on Jackson. "Michael Jackson was a drug seeker... He was a powerful, famous and wealthy individual."

i wasnt aware of the fact walgren is going to appeal the sentence?? is that even possible because he got the max??

It's about appealing the 'non-state prison' element...ie to make the offence 'state prisonable', contrary to the new re- alignment ruling. Cooley mentioned this in the press conference and it is referenced in the article below:

DA to seek to have Conrad Murray serve his time in state prison
November 29, 2011 | 11:29 am

Los Angeles County Dist. Atty. Steve Cooley on Tuesday said his office would fight to have Dr. Conrad Murray serve his four-year sentence in a state prison, rather than county jail.

Under a new state law, defendants convicted of certain nonviolent crimes will spend their terms in county jail instead of the overcrowded state prison system. Sheriff's spokesman Steve Whitmore told The Times that officials were still trying to determine the exact details of his incarceration. But under state law, nonviolent felons in California serve 50% of their sentences.

Cooley, however, said his office is considering an appeal that would ask the judge to send Murray to prison and serve more of his sentence.Cooley is a strong critic of the new state law. He expressed concern that Murray could actually spend less than two years in county jail because of overcrowding at that facility.
Cooley said he admires the judge's decision but said he's frustrated that Murray will not go to state prison. He added that the state will see more of these high-profile cases in the coming months.

While the Sheriff's Department is considering electronic monitoring at home for some inmates, Whitmore said Murray's involuntary manslaughter conviction in the death of Michael Jackson will likely mean he spends the entire two years in jail. That's the maximum sentence the law will allow, Whitmore said.

Superior Court Judge Michael Pastor, in blistering and lengthy remarks Tuesday, sentenced Murray to four years behind bars. He also criticized the doctor for failing to express any remorse for the pop star’s death and for suggesting in a recent documentary that Jackson bore responsibility for his own demise.

“Talk about blaming the victim,” Pastor said. “Not only isn’t there any remorse, there is umbrage and outrage on the part of Dr. Murray against the decedent.”
Pastor denied the defense's request for probation.

Also another question, in the beginning of todays court the defense asked for no cameras because of private letters etc. But no letters where readed?????? so why would they ask for no camaras?

I posted this 2 pages back but incase anyone missed it here's the full updated interview from TMZ with Flanagan
Michael Flanagan is on TMZ right now. Seems like he's implying that the documentary was in order to make some sort of income cause the judge had not allowed him to practice since January. Flanagan nor Chernoff approved of the documentary. Dr Murray was the one who wanted to do it. Used the money to pay for witness', legal staff etc Flanagan says he hasn't been payed in a LONG time.

Says if he apologized today at court he basically admits the verdict is correct, if he denied wrong doing he basically would look stupid.

Asking why they didn't bring in the estate money issue. Says if he brought that up it would basically be inappropriate to claim that the family and his children are better off with him dead then alive. Says that whether Murray was fined 1,000 or 10,000 dollars it wouldn't have mattered. Harvey is asking why not let him walk out with a clean slate after 2 years by arguing the fine which was imposed today.

Murray hasn't spoken with Flanagan yet will speak with him tomorrow though, but he expected it basically. They knew the judges attitude. Murray has NOT lost his will to live never once mentioned this to any of his legal council so suicide claims were untrue. In medical wing in order to isolate him from other prisoners. Not within council's power to get him house arrest. It's the sheriffs control and decision. This will change daily he thinks. Has a unique relationship with Chernoff. Looking back he would NOT have taken this case under these circumstances but he doesn't regret taking it. Says it was interesting he's learned from it.

Sorry if this is not 100% clear I'm typing as fast as I can as the interview goes on.

CONRAD MURRAY'S LAWYER Driven Away by Hecklers

Conrad Murray's defense attorney J. Michael Flanagan just stormed away from a news conference -- after he was ambushed by hecklers.

Flanagan was in the middle of making a statement, claiming, Murray "led 56 years of exemplary life" -- at which point he was interrupted by someone in the crowd ... "And then he killed Michael Jackson."

Video (TMZ) http://www.tmz.com/2011/11/29/conrad-murray-lawyer-news-conference-hecklers/#.TtVZxmNXtQQ

That's really quite funny. I didn't hear what the heckler said, wondered why flanny went off in a huff.

Ingelief - flanny and chernoff probably not doing the appeal because murray has no more money to give them.

I actually found walgren reading the family statements from the probation report about mrs j and the children far more affecting and moving than what the family's lawyer had to say - the brothers missed performing with mj (they performed 2 nights in the last 25 yrs with him), adn the chldren lost a playmate?!

I hope it's not just Cooley's pre-election games and he'll go further than just stating in a front of the media and do something really useful

Jackson's brother slams jail sentence
Jermaine Jackson has slammed Dr Conrad Murray's four year jail sentence as "not enough time".

The medic was given the maximum penalty for the involuntary manslaughter of Jermaine's brother Michael - who died from acute Propofol intoxication in 2009 - but the musician's sibling believes Superior Court Judge Michael Pastor was too lenient with his ruling.

As he left the courtroom, following the verdict in Los Angeles, Jermaine told E! News: "It wasn't enough time."

However, his sister LaToya was happy, saying: "Justice was served. Now we just have to deal with the jail overcrowding."

Longtime family friend Kathy Hilton, who accompanied LaToya to court, added: "They were complaining about [Murray] being in an eight-foot jail cell, Michael is in a box forever."

It is unclear how long Conrad will actually serve with District Attorney Steve Cooley commenting: "This is one of the great mysteries of life: What amount of time is someone going to actually do when they're sentenced to do so by a judge?"

Los Angeles Sheriff spokesman Steve Whitmore, explained: "As far as the Sheriff is concerned, after the state takes away two years and he gets credit for time served, he will do a little less than two years."
Jackson's close family friend Reverend Al Sharpton also called for the maximum four year sentence.

He told the New York Daily News: "I hope he gets the maximum and more. Anything short of the maximum would send the wrong message to people who are willing to exploit the medical profession for personal greed and gain.

"Michael wasn't just a megastar, he was a father. His three kids will never have a father again. They should see justice and be compensated. They shouldn't be treated any differently just because they're the children of a megastar."

:lmao: Yeah, what was THAT all about?! Are they implying that they were financially compromised and/or ruined by Michael's death on the HOPES of performing with him again?

sane here Bonnie I found Katherine's statements given to to the sherrif's department way more effective and emotional than whatever was read by panish or whatever his name is. thanks God Walgren read off the additional statements as well. he's really sharp that way.

The Judge was lenient? What does Jermaine think? Pastor sentenced Murray to the max. He couldn't sentence him for more than four years.

And this is why Jermaine is an idiot. Judge Pastor gave the maximum he could give. He couldn't send him to state prison due to the re-alignment act and he gave him 4 years, the maximum sentence. There was nothing more he can do!

I'm over the moon at max 4yr sentence and Pastor was great with his words.

4 years...um...2years....Oh well...perhaps he'll fall off the roof whilst star gazing.

maybe this is not a big deal since Katherine gave a victim impact statement... but the probabtion department office also asked Joe to give one too but he did not respond to them, oh well.. (page 11)

the probation department office also recommended for probabtion to be denied and that murray should be sent to state prison... (page 20)
