did the prosecution needed to get consent from the family before releasing the tape?
Nope. It's considered evidence. The judge is the only person who can deny evidence to be seen and or heard and that's generally done based on the relevance of the evidence, not whether or not the family approves or might be disturbed.
The judge's only concern is to make sure the defendant and victim are getting due process; at least that's supposed to be the judge's role as we know some seriously fail at this.
Three cheers for Judge Michael E. Pastor. I think he's doing a great job in this case. He takes no foolishness but is still kinda cool; pleasant...imo.
