Could it be that the fans' actions are beginning to get heard finally?

Could it be that the fans' actions are beginning to get heard finally?
Unfortunately this is because how the USA system is set up. Here we have states and each one of them has their own medical boards, certification etc. You get certified in each state and each state has to go through their own process to suspend or revoke a licence. In all cases this takes time. Also even though a patient died as of know we don't know whether it was intentional or an accident (remember he's not charged with murder so it means that they think it's not intentional).
and like I said it's good that they are filing this case but in the end of the day it doesn't matter much as Murray does not have a practice in California and it doesn't stop him from practicing in Nevada and Texas.
WTF? Is this a joke? He killed someone and people are worried about Child Support???
I dont understand why these courts think it is ok for Murray to keep his license...WHY the hell he is continuing to get special treatment is beyond me.
Nevada medical board tried to suspend his licence based on a technicality (they acted quite smartly IMO). When doctors apply for a licence they fill out information such as "are you ever convicted of a crime" , did you this, does this apply to you etc etc.
Murray lied on this application about the child support (he said he didn't have any outstanding child support, in reality he wasn't paying child support). Nevada medical board tried to suspend his licence based on the fact that he lied on it. (so they don't care about the child support, they were just trying to use that to suspend his licence). Apparently the court did not approve this request.
Murray as a doctor is not getting any special treatment. In US it's very hard and long process to get doctor's licences revoked. The law is based on "innocent until found guilty" logic and Murray has not yet found guilty in a court of law.
so we have to wait and stay strong. it will happen eventually.
yes I understand....I just get very angry at times...it is patience that I lack....this just isn't moving fast enough for me. I live in the US and our court system is all red tape..it take forever to get from point A to point B unfortunately. Thank you for your legal advice..I have a feeling that once the trial starts...or should I say IF it starts...you will be in demand here....![]()
thank you. and I agree with you. law is not perfect and is not working as quickly and as efficiently/ effectively it should (both in US and in other countries). From a personal standpoint I too have several issues with how the legal system works (or doesn't work) but when you separate your emotions you realize that this is the reality, this is the law and you have to wait it to run its course. :flowers:
How is it he can afford 5 lawyers (why do you need that many lawyers?) but he can't afford child support?Dr. Conrad Murray won a legal skirmish Friday when a child support hearing master denied a prosecutor's push to suspend his Nevada medical license for failing to pay $16,000 in child support.
Murray, the doctor accused of playing a role in the death of pop icon Michael Jackson in June, could dodge the license suspension if a California judge allows the mother of his child to formally waive the back payments at a hearing later this month.
"Because the arrears are approximately $16,000, that triggers a potential professional license suspension," said Clark County Chief Deputy District Attorney Gerard Constantian.
Accompanied by five attorneys, including three from Texas who will defend him against involuntary manslaughter charges related to Jackson's overdose death, Murray remained silent during the hearing.
Chris Aaron, his Nevada child support lawyer, advised Hearing Master Elliott Yug that the doctor has made regular and full payments of $1,003 per month as ordered in November.
At that time, Nenita Malibirin agreed to waive the multiple thousands of dollars Murray owes her in back child support.
Aaron and Constantian were at odds over whether Murray has paid any arrears. Aaron told Yug that $203 of Murray's monthly payments goes to child support.
Constantian disagreed. "He has not paid one iota," he said. "His current child support obligation is $1,003."
Aaron said Murray has never been disciplined as a doctor or been accused of malpractice. He indicated Murray, a cardiologist, is working in Texas.
"He wants to work," Aaron said. "He wants to resolve this."
Exactly where Murray is working was not indicated.
In any event, a judge in Santa Clara County, California, did not accept Malibirin's waiver and set a hearing for May 27. Constantian said there is no guarantee the judge will grant the waiver. He said Murray would not be harmed if Yug moved to suspend the license prior to the California hearing.
He said it would be two weeks before the suspension became an order, and Murray would then have a month to appeal the decision.
Aaron disagreed, saying it is the policy of Texas to suspend licenses in tandem with other states, such as Nevada.
Citing judicial economy, Yug denied the request pending the May 27 hearing.
After the hearing, when asked how Murray could be expected to pay child support or arrears if his medical license was suspended, Constantian said the Legislature enacted laws to allow the suspension because it is a proven motivator.
"It could be a driver's license, a barber's license. It could be any license," Constantian said. "We don't want to harm Doctor Murray. We want to be fair to him as we would any noncustodial parent."
California is the original jurisdiction of the child support case involving a son, now 12. Constantian said Nevada became involved when Murray moved his practice to Las Vegas and the case transferred to Nevada.
Yug set another hearing for 10 a.m. June 25.
How is it he can afford 5 lawyers (why do you need that many lawyers?) but he can't afford child support?
there are several cases (criminal, medical malpractice, licence suspension and child support) against him.
Several cases? Its child support. Criminal, medical malpractice, license suspension are all re manslaughter, not child support.
hard to understand what you mean but let me try. yes the criminal, medical malpractice, licence suspension are all because of the manslaughter charge but still they are different cases nonetheless and require different lawyers with different specialties.
for his civil medical malpractice lawsuit he has Charles Peckham
for the child support case he has Chris Aaron
for the criminal case he has J. Michael Flanagan, Ed Chernoff and Joseph Low
That's 5. It's also quite probable that he has another lawyer that deals with medical licence suspensions.
+ the article says "Accompanied by five attorneys, including three from Texas who will defend him against involuntary manslaughter charges"
so apparently his lawyers from criminal manslaughter case also attended to the child support hearing.
so he doesn't have 5 child support lawyers, his lawyers from other cases show up to the hearings.
"It could be a driver's license, a barber's license. It could be any license," Constantian said. "We don't want to harm Doctor Murray. We want to be fair to him as we would any noncustodial parent."
What about casualties in lifetime due to these delays? How does the law provide for that? What if someone else dies because of Murray while he is still free until proven guilty?
This person will be in L.V. .. that's the only thing that counts for me atm.Murray's next hearing is June 25th?I understand how frustrating it all is for everyone, I'm frustrated, but these things do take time. He will have it revoked eventually and when he does every state will revoke it. Doctors have a lot of protection under the law but we need to stay strong and patient.
Legally they have protected other people by putting bans on his licence - remember when the judge said that he shouldn't be using propofol and other sedatives? that's how the law provides until the decision in the case is reached.
And the next hearing is for June 25th?
