Joe Jackson has no business dragging his wife into the wrongful death lawsuit he's filing against Dr. Conrad Murray ... this according to her lawyer.



TMZ broke the story ... Brian Oxman is filing the wrongful death suit in federal court today. Oxman has named Katherine and Michael Jackson's three kids as "nominal plaintiff."

It's bizarre to name anyone as a "nominal plaintiff" in such a case. As far as we can tell -- plaintiffs in wrongful death cases never bring in others as "nominal plaintiffs."

That said, Katherine's lawyer, Adam Streisand, tells TMZ, "Mrs. Jackson has no interest in Conrad Murray other than seeing that justice is done in the criminal courts."

Streisand adds, "She certainly would never tap Brian Oxman for the job of filing any kind of lawsuit for her or the kids."

In a CNN interview Oxman said that the health information is from the autopsy report.
And he also challenged anybody to come forward and prove that Michael was healthy.

I don't get the whole thing about the emails have those emails been released I'd like to read them.

The attorney to the late Michael Jackson's former personal physician Dr. Conrad Murray released a statement to ET in reaction to the wrongful death lawsuit filed by the King of Pop's father Joe Jackson.
Dr. Murray's attorney tells ET of the suit: "We continue to maintain Dr. Murray neither prescribed or administered anything that should have killed Michael Jackson. Dr. Murray is beloved by his patients because he is a compassionate, responsible physician dedicated to his patients' health. We'd like to remind people that Dr. Murray has not been found guilty of anything and we believe his innocence will be proven in a court of law. We've been told we were going to be sued for months so today's filing is no surprise to us."
The Jackson family patriarch seeks a minimum of $75,000 in the lawsuit and accuses Murray of professional negligence, providing Michael substandard medical care, and withholding information about Propofol, the drug that authorities believe killed the King of Pop. Acres Home Heart & Vascular Associates Inc. and GCA Holdings LLC are also named as defendants in the suit.
Dr. Murray has pleaded not guilty to an involuntary manslaughter charge in Michael's death.

After reading Joe's wrongful death suit I wonder what it's going to take for AEG to stick to the case.
I really hope it does as Murray was definitely not acting alone. Joe says he doesn't have sufficient evidence to expand charges against them--is that a hint that he is on to something?
This PI he supposedly hired must have come up with something by now.

I dont get this. Can he even file a lawsuit? Doesnt he have to prove he was dependent of Michael first? If so, how is that even gonna happen now when he pulled his request back for a monthly allowance...

of course he isn't going to jeopordize his client...but he knows his client is laughing at him behind his back + he knows he'll be charged to the fullest of the law.:angry:

Anyone can file a lwasuit, can it stand is the question. I agree that IF he did pull back his request(tmz isn't the most reliable source) then how can he continue this law suit and expect it to go somewhere? maybe he's just doing is as a father. I would rather see a parent try to seek justice than not try at all.
 
err the autopsy report brian. whats his definition of healthy?
does the autopsy report say he was healthy? i know it says his organs were ok and that he didn't have anything wrong that should have contributed to his death. Insomnia isn't healthy niether is lupus and didnt he have slight lung inflammation along with other ailments.

I am not sure how that affects the lawsuit- but I think he was scheduled to be deposed - they didn't want that, I'm sure - between June & July.

I do think that MJ supported his parents, but maybe not in the last years after the trial, perhaps just giving them money off & on. The Hayvenhurst home was in foreclosure off & on according to RF - that would be public info, so probably correct. MJ did have a cash flow problem.

as i said it depends on what you definition of healthy is. and what your (oxman) is trying to imply. mj had cronic lung inflamation but that was the only thing that stood out. for his age is was pretty healthy as the report said.insomnia isnt a phsyical issue that shows up on an autopsy and lupus could be covered by the lung issue as its not written itself in the report as theres no real test for it oxman has already lied and claimed mj had bronchitus (sp) and other other things which is totally false.
 
The more Oxman opens his mouth the more he's screwing up the DA case against Conrad Murray. Does he think he can force AEG's hand to surrender Michael's medical fitness report for O2?
Even if they did have, would'nt that be handed to the DA.
Don't even dare think the DA would give away anything that might be considered discovery when preliminary hearing is still months ahead.
 
I remember Randy Jackson telling Oxman to be quiet months ago, Oxman still hasn't listened.... I think the ENTIRE Jackson family needs to say something.
 
i doubt half of them care they are screwing up the case themselves while making money off interviews.the never called oxman out in the past i doubt its gonna start now

TMZ has learned a federal judge is taking Jackson and his attorney Brian Oxman to task for failing to specify where two of the defendants -- health clinics where Dr. Murray practiced -- conduct their business. Without that information the judge can't determine if the federal court has jurisdiction over the case.

The judge has given Jackson one week to amend the complaint or have the suit tossed.

Even if this case is dismissed, Dr. Murray might not be fully in the clear. Jackson has a lot of options -- including refiling the federal suit with Murray as the lone defendant.

I'd suggest joe ditch oxman if he wants to get far with this lawsuit, isn't this the 2nd mistake? he's lucky the judge didn't dimiss this altogether is this is true.

Still getting your news from a tabloid like TMZ? - explains why people post what they do on these threads - do your research. Read the actual court filing, it's a public document. This filing has so many flaws and inconsistencies - it reads like Oxman got all his facts from the TMZ & hoax threads. Explains why his law license is on probation for 2 years per the California Supreme Court, again.... actually it explains a lot more than what meets the eye.
As MJ so succinctly said: "They really wanna fix me, hit me. But this time around I'm taking no shit - - 'cause you really can't control me"
