Hearing set for Michael Jackson doctor Conrad Murray

From Alan Duke, CNN

July 20, 2011 -- Updated 0724 GMT (1524 HKT)

A judge is expected to decide on a request for a three-week delay
Los Angeles (CNN) -- A Los Angeles County judge is expected to consider Wednesday a request to delay the start of the involuntary manslaughter trial of Michael Jackson's doctor.

The trial has already been delayed twice since Dr. Conrad Murray invoked his right to a speedy trial after his arraignment in January.

A Los Angeles coroner ruled Jackson's death on June 25, 2009, was from an overdose of the surgical anesthetic propofol, combined with other drugs.

Authorities claim Murray, who was hired as Jackson's personal physician as Jackson prepared for comeback concerts in London, administered the fatal dose. The doctor's defense attorney, Ed Chernoff, contends Jackson was "a desperate man in many respects" and gave himself the fatal dose of surgical anesthesia while the doctor was not watching.

Jury selection was underway in May when the defense requested a delay so its expert witnesses could have more time to prepare for new experts hired by the prosecution. Los Angeles County Superior Court Judge Michael Pastor then dismissed hundreds of prospective jurors and rescheduled the trial to start on September 8.

Deputy District Attorney David Walgren said in June that the prosecution needed another three weeks to prepare because of "scheduling issues." Defense lawyers did not object to moving jury selection to the end of September.

Also in June, the judge approved a plan to allow defense lawyers and prosecutors to view dozens of hours of raw video shot of Jackson's last rehearsals. The video was bought by Sony Pictures for its film "This Is It."

On Wednesday, lawyers are expected to present to the judge how much of the video they want to use.

Michael Jackson's doctor wants jury sequestered, from Nancy Grace

A lawyer for Michael Jackson’s personal physician said Wednesday that in light of the uproar surrounding the verdict in the recent Casey Anthony case, jurors in the doctor's upcoming manslaughter trial should be sequestered round-the-clock, or at least “during the hours Nancy Grace is on TV.”

The attorney for Dr. Conrad Murray told a judge he was concerned that biased commentary of the televised proceedings, set to begin Sept. 8, would affect the panel’s ability to render a fair verdict in the Jackson's death.

“I just think there is an overwhelming likelihood of contamination of the court’s control of evidence,” J. Michael Flanagan told Los Angeles County Superior Court Judge Michael Pastor.

The judge said the defense was free to file a formal motion for sequestration, but that he did not feel it was necessary and that in any case, the financially strapped court system could not afford it.

Pastor, who said the O.J. Simpson case was the last time a county judge had sequestered a jury, said he would order jurors be kept away from the general public inside the courthouse but believed it “unhealthy” for panelists to be isolated for the entire trial, which is expected to last six weeks.

Murray is accused of causing the pop icon’s 2009 death from an overdose of the surgical anesthetic propofol. His defense contends Jackson gave himself a fatal overdose when the doctor was out of the room.

In another development, Pastor said he would travel to Sony Pictures studios in Culver City to evaluate more than a dozen hours of footage of Jackson’s final rehearsals.

The prosecution had identified 12 hours of outtakes from the documentary “This Is It” as relevant evidence. The defense claims only four hours should be shown to jurors.

Judge won't delay trial for Michael Jackson's doctor

Dr. Conrad Murray's trial is set to start September 8
Murray is charged with involuntary manslaughter in connection with Jackson's death

Los Angeles (CNN) -- A Los Angeles County judge Wednesday refused to delay the trial of Michael Jackson's doctor, who's charged with involuntary manslaughter in the pop star's death.
Superior Court Judge Michael Pastor rejected the prosecution's request to again put off the trial of Conrad Murray. It's already been delayed twice since Murray invoked his right to a speedy trial after his arraignment in January.
A Los Angeles coroner ruled Jackson's death on June 25, 2009, was from an overdose of the surgical anesthetic propofol, combined with other drugs.
Murray's defense team is considering asking that the jury be sequestered because of the expected intense publicity. Attorney Michael Flanagan cited the Casey Anthony trial, and complained that if jurors see certain TV personalities discussing the case, it would be like constant final arguments by the prosecution.
Meanwhile, the judge said he will personally review about 14 hours of rehearsal video for the concert Michael Jackson was planning at the time of his death, to decide which parts of the video may be admitted at the trial.
Authorities say Murray, who was hired as Jackson's personal physician as the singer prepared for comeback concerts in London, administered the fatal dose of medicine. Defense attorney Ed Chernoff contends Jackson was "a desperate man in many respects" and in trying to help himself sleep, the pop star gave himself the fatal dose of surgical anesthesia while the doctor was not watching.
Jury selection was under way in May when the defense requested a delay so its expert witnesses could have more time to prepare for new experts hired by the prosecution. Pastor then dismissed hundreds of prospective jurors and rescheduled the trial to start September 8.

Re: July 20, 2011 Hearing discussion

I must admit I predicted the worst when I heard the defence put in a delay. So glad it's been refused-it's been over two years now, enough's enough.

Re: July 20, 2011 Hearing discussion

The pros were the ones asking for the delay.

Any news on rehearsal footage the defence want to use or have they gone quiet on it.strange how the article mentioned the pros but not defence

it does a little bit

The prosecution had identified 12 hours of outtakes from the documentary “This Is It” as relevant evidence. The defense claims only four hours should be shown to jurors.

so the prosecution wants 12 and defense wants 4. To me it shows there's a lot more footage that shows MJ in good health and alert etc then showing him "out of it".

then it says the judge will watch it (14 hours) and decide which parts to admit as evidence.

Re: July 20, 2011 Hearing discussion

The way its written to me says the pros want 12hrs of footage shown but the defence are objecting and say the pros should only be able to use 4hrs thats why i wondered why no mention of footage the defence wanna use seeing as they instigated it.. So the judge is gonna go look.personally i dont see the judge allowing hrs and hrs to be shown.divert away from the case and i cant imagine jurrors sitting through hours apon hours

Re: July 20, 2011 Hearing discussion

Or if the pros wants 12hrs and the judge will look at 14hrs then theres 2hrs of footage the defence want to use?

Re: July 20, 2011 Hearing discussion

Well... after two years, I'm not getting my hopes up too high, but I wish that it would really start now, without any other delays :/

Re: July 20, 2011 Hearing discussion

2 hours they want to use can overlap and equal to 14 hrs (10 hrs prosecution 2 hour overlap 2 hour defense = 14 hrs) . We'll understand it better as more stories are written.

however I also wonder if they mixed up defense and prosecution as defense was the one "fishing" for the footage and it seems interesting - if true- prosecution who would show 2 clips from TII is now wanting to show 12 hours. again if true that would show me that prosecution had found a lot of footage that shows Michael in a good light.

Murray Trial -- Jury Shouldn't Watch Nancy Grace
53 minutes ago by TMZ Staff

Lawyers for Conrad Murray told the trial judge they don't want Nancy Grace to pull a "Casey Anthony" on the jury -- so they asked the judge to prohibit jurors from watching her.

Attorney Michael Flanagan argued that it was impractical to tell jurors they can't watch TV - because they simply will. So Flanagan asked Judge Michael Pastor to sequester the jury, O.J. style. The judge told Flanagan to file a motion and he'd consider it, although the judge did say he thought sequestering was both unnecessary and too expensive.

Flanagan pressed his claim for outtakes from the "This Is It" rehearsals -- something Sony doesn't want to cough up. Sources tell us ... Flanagan wants the outtakes to show there were periods where Michael Jackson appeared to be on drugs.

In a telling comment, Judge Pastor said, "This case is going to focus on the charge, not personal lifestyle."

edited to add: this comment reminds me of Anna Nicole case and how the judge said that Anna Nicole wasn't legally an addict. It seems like the judge wouldn't allow an addict claim - even a recreational drug addict claim about Michael - and keep this limited to propofol.

Re: July 20, 2011 Hearing discussion

Well said Judge Pastor! And so it should.

Re: July 20, 2011 Hearing discussion

Flanagan is on tape saying Michael's decline in health not apparent in footage and all you see is Michael performing and how good he is even on his bad days. He says the footage is irrelevant to what happened that night and makes it out that the prosecution is the one that wanted the footage.

Jackson Doc's Defense Wants Jury Sequestered

By LINDA DEUTSCH AP Special Correspondent
LOS ANGELES July 20, 2011 (AP)

In a sign of legal fallout from the Casey Anthony murder trial, a lawyer for Michael Jackson's doctor said Wednesday his jury should be sequestered to avoid contamination by TV pundits — specifically Nancy Grace.

Attorney J. Michael Flanagan said the televised, involuntary manslaughter trial of Dr. Conrad Murray could be prejudiced by "final arguments" being delivered daily on TV by Grace and other commentators.

"How many final arguments will we have to hear in this case?" Flanagan asked.

At a pretrial hearing, the lawyer referred to "the recent case in Florida" and told the judge Murray's trial was expected to get even wider coverage. He said telling jurors not to watch TV would be insufficient.

When Los Angeles Superior Court Judge Michael Pastor asked if Flanagan would want jurors sequestered around the clock during the trial, the lawyer responded, "Every time Nancy Grace is on TV."

"We would like a decision made on the evidence that appears in this courtroom rather than commentary on the Nancy Grace show," he said.

Allison Rudnick, a spokeswoman for the "Nancy Grace Show," did have any immediate comment.

Pastor said the courts, with a severe budget crisis, can't afford to put up jurors at a hotel, and he thinks it's unnecessary. He also said it would be burdensome to jurors.

Pastor did say he would sequester the panel during the day, requiring them to eat meals together in the jury room rather than wander around the civic center.

The judge also said he would be instructing jurors not to pay attention to publicity about the trial.

Flanagan explained the difference between the two trials outside court.

"Casey Anthony was not a public figure before her case," he said, noting that Jackson's superstar status means TV stations have enormous amounts of footage of him to use during the trial — things that will not be admitted in evidence.

Murray has pleaded not guilty to causing Jackson's death on June 25, 2009, with an overdose of propofol and other sedatives.

The judge said the trial will begin on Sept. 8 with prospective jurors being given questionnaires. Opening statements are expected in late September
