SANTA MARIA
Judge Rodney Melville dismisses Michael Jackson from a lawsuit which claimed he was, in part, to blame for the death of a Marian Medical Center patient. But this current lawsuit is still not over.
The hospital is still named as a defendant. According to court paperwork, the family of Manuela Ruiz is suing for elder abuse, and emotional and mental distress for what they called "preferential treatment."
It has been more than three years since Manuela Ruiz died, but her family says the pain hasn't gone away.
"She was the heart of the family, and we miss her," Marco Meraz said.
Meraz first brought his grandmother to the emergency room after she complained of shortness of breath on February 2005. She suffered a heart attack and was put on a breathing machine.
The following morning, Michael Jackson was admitted to Marian for flu-like symptoms. Meraz says his grandmother died on February 15, after hospital workers pushed her out of her room to make space for the King of Pop.
"She was in critical condition. They couldn't even move her to the ICU because they didn't want to move her around," Meraz said. "But yet, here comes somebody in, and they disconnect her and drag her along the other room when there's nothing, no machinery. [They had to] hand pump her."
Tuesday, the hospital's attorney, Hugh Spackman, called the allegations "outrageous."
A Marian spokeswoman says patient care is always a top priority.
"Today's ruling is [a] procedural step necessary to move forward with the final dismissal of the case. We have always been confident the care provided to Mrs. Ruiz was appropriate," said a written statement released by the hospital Tuesday morning.
Manuela Ruiz's family says that couldn't be further from the truth.
"If it was your guys' loved one, your grandma, your mother, I'm sure you'll be where I'm at. I don't think anybody should even go through this, period," Meraz said.
The family is not revealing how much they are asking for, but says, it's never been about money.
The defendants' attorneys did not want to speak on camera. Jackson's lawyer, Timothy Gorny, called what happened "unfortunate," but says his client was not at fault.
The family of Manuela Ruiz appeared Tuesday morning without an attorney, but hired a lawyer later in the day. The case will be back in court in about a month for a case management review.
No new trial date has been set.

I don't think the watch is disrespectful or an insult. It is and will always be an iconic MJ picture whether we like it or now. It's gotta be the most famous mugshot in the world right....! I'm sure he knew how big that mugshot would turn out to be and I'm also sure that he did that spooky face on purpose. (Spooky and weird are good!)

Since the mugshot is on a watch try to look at it as if Zandra is saying "Michael is a victim of his time".

Very good way to put it. I don't know why people are getting offended. It could very well be a positive statement. She's probably a fan. Why else would she be wearing the watch? People thinik! Maybe she's making a statement by wearing it. Btw, good to hear that Mike's name was dropped from that lawsuit.
 
It's about time. "They had to pump her heart by hand..." I can't see this. First of all, if she was in that great state of danger, they wouldn't have even moved her from emerge. Patients who are at high risk are usually left in the emerge to make emergency surgeries go easier.

Bless her soul however, and the family.
 
And this family showed up in court WITH NO LAWYER. What does that tell you? Why were they not able to get a lawyer until after today's hearing?
 
What happened to their mother is very, very sad. At the same time, it's not right to jump on the sue-Michael Jackson-bandwagon just because the opportunity appeared to be there.

He was a patient at the hospital. He's not in charge of it. Therefore, they can't place that type of blame on him.

The accusation against Michael was outrageous too, which make me feel less sympathy for them:huh:
 
Part of me wants to say that ole Melville didn't want to face Michael again or kick up any dust with the folks out there who critized that multi million waste of taxpayers' dollars.

But the other part of me wants to say that he knew that this family had no legally justifiable reason for pinning any liability on Michael.

Its probably both.

Regarding the watch - it is just a watch. A picture is just a picture. I know it was a horrible time in his life, but it is over. I personally would never wear a watch like that, but that is me. I think Lily Allen did it for support but who knows?

I am very happy that MJ has been dropped from the lawsuit. I am sad about the family's loss, but MJ had nothing to do with it. ]

It is great that T25 is still hanging in there in the charts.

Jackson dropped from Marian lawsuit

Pop star Michael Jackson is no longer named as a defendant in a lawsuit that alleged intentional infliction of emotional and mental distress by Jackson, Marian Medical Center and Catholic Healthcare West.

The suit was filed by the family of a Santa Maria woman who died at the hospital in February 2005.

Superior Court Judge Rodney Melville granted a demurrer today that was filed by Jackson’s attorney, Timothy Gorry, of Los Angeles.

Allegations remained against the hospital.

The lawsuit also alleges elder abuse against 73-year-old Manuela Gomez Ruiz on the part of the hospital, which according to the complaint moved Ruiz while she was being treated to make space for Jackson to be examined when he was brought to the hospital in 2005.

Ruiz died at Marian Medical Center shortly after she was reportedly moved to another hospital room to make room for Jackson.

The talented 19-year-old dance teacher from Sydney can sing, dance and act.
But her multiple talents were not enough to keep her in the running on Channel Ten’s So You Can Think You Can Dance program this week.
However her tearful elimination from the show will not deter her from her dream of becoming a Janet Jackson or Jennifer Lopez of the future.
“I’m just so grateful to have been a part of the show and making it into the top eight,” she said.
Rhiannon said her experience on the show was a huge step towards achieving her goal of securing a recording contract.
She started dancing when she was only two and hasn’t stopped performing since.
“I can’t actually believe I did dance classes at that age,” she said.
Rhiannon did most of her training at the Brent Street Talent Development High School and performed on several popular television programs as a dancer before appearing on So You Think You Can Dance.
She was even part of Michael Jackson’s HIStory tour in 1996 when she got to hand the megastar a rose as part of the act and he kissed her on the forehead.
Rhiannon said she would like to see either Kate Wormald or Graham Isaako go on and win the competition, which is down to its last five contestants.
“I just think they bring something different to the show,” she said.

I'm sorry, but as tragic as losing a member of your family can be, using Michael Jackson's name in your lawsuit as far as I am concerned was just for pure publcicity sake! If they were alledging that John Doe was the one who was moved into their mothers room, then we would'nt be hearing a darn thing about it!
 
Glad to hear that MJ was dropped from the lawsuit. He should have never been named in the lawsuit to begin with.

perhaps you are right.

and as for the lawsuit...it is a sad state of affairs..and i can't say that about every family....but, in this society, i have heard so many stories about people who bury their loved ones, only to fight over the estate, before the body is cold. and i hear of people wanting to sell James Brown artifacts before his body is allowed to get cold. so....sometimes i wonder..which is more important..a life..a loved one..or...money.

i think the lawsuit was unwarranted...and...they should spend time honoring their loved one....not trying to have room in their minds to reach out against MJ for money. and..hopefully...i think they have seen the light..and realize the importance of their loved one's memory, over anything else, including money. and that MJ cannot be blamed for a hasty judge's ruling...a physical breakdown...the impulse of a caring hospital, despite the fact that the judge in the MJ case knew that MJ would have to be transported at ninety miles per hour in dangerous traffic (aka princess diana), to keep from being thrown in jail.

SANTA MARIA, Calif. (AP) — A judge has dropped Michael Jackson from a lawsuit filed by the family of a woman who died at a hospital soon after she was moved to make room for the pop star.

Judge Rodney Melville on Tuesday dropped Jackson from the lawsuit against Marian Medical Center in response to a challenge from Jackson's attorney, Timothy Gorry. Melville rejected a similar motion by an attorney for the hospital.

The attorneys could not be reached for comment Wednesday, and a phone message left for a Jackson representative was not immediately returned.

The family of Manuela Gomez Ruiz had sued Jackson and Marian Medical Center for infliction of emotional and mental distress, claiming she was kept from critical care after she had a heart attack on the same day Jackson was brought in with flu-like symptoms during his 2005 child-molestation trial. Jackson was acquitted in the case.

The lawsuit said the 73-year-old Ruiz was on life-support after a massive heart attack and was moved from a two-bed room so Jackson could occupy it by himself. It complained of an "outrageous, circus-like atmosphere" in the last hours of Ruiz's life.
