January 14, 2008~Breaking News: Lawsuit accusing Michael Jackson of molestation is dismiss

Thank you for the news, HOWEVER,
regarding the article "Lawsuit accusing Michael Jackson of molestation is dismissed"
I question whether it is in any way helpful to have that article published on this site. Kapon's claims were ludicrous, but they were also sensational and disgusting. Perhaps it would be enough to make a brief statement about the case being closed with a link to the article rather than copying in here for all to read. Kapon's claims are so disgusting that I sure would not want my kids reading about his demented fantasies. Does Michael have to be subjected to more humiliation by having such horrible accusations, albeit ridiculous and justifiably dismissed, aired in a forum where we are trying to promote respect for him?

KAPON IS INSANE! We've all known that for a long time. Thank God that it is over, for Michael at least. Kapon needs psychiatric help.

This sounds no different than all of the other cases. The same way this case was dismissed, teh others should have been as well.

On a note I just found some news about why Michael wasn't at the BET Honors award show, if it hasn't been known, but an article stated that Michael pulled out from the show. I don't knwo what that means but thought I would let yall know if it hasn't bee told yet.

Lawsuit accusing Michael Jackson of molestation is dismissed

A lawsuit filed by a young man who alleged he was molested as a boy by Michael Jackson -- and who also claimed he fathered the singer's two oldest children and saw him dine with Fidel Castro -- was dismissed today by a judge.
Los Angeles Superior Court Judge Rolf M. Treu granted a motion by Jackson's lawyer, Thomas C. Mundell, to throw out the case after the 22-year- old plaintiff, Daniel Kapon, failed to show up for the scheduled start of today's trial.
"I think the judge realized how crazy the lawsuit was," Mundell said outside the courtroom.
Kapon never visited Jackson's Neverland Ranch in Santa Barbara County as he claimed, and the entertainer did not know him, the lawyer said.
Kapon's lawsuit alleged Jackson "repeatedly and forcefully sexually molested" him starting in 1987, when he was 2, and lasting until he was 14.
The case was originally filed in Orange County, but a judge transferred it to Los Angeles County in March 2006 at the request of Jackson's lawyers.
In court papers filed Dec. 17, Mundell said Kapon made a series of unusual statements during his Dec. 11 deposition that undermined the validity of his case.
Kapon claimed his mother married Jackson multiple times, and testified that the ceremonies were attended by Elizabeth Taylor, Celine Dion, Elton John, Paul McCartney, Beyonce Knowles and Diana Ross, according to Mundell's court papers.
He said Kapon testified that his mother "was in Michael Jackson's 'Thriller'
music video. She helped Michael with a lot of his material, his songs, his music videos. Michael Jackson was madly in love with my mom."
Kapon also claimed he fathered Jackson's two oldest children, Paris and Prince Michael, by masturbating into a jar so his semen could be used to impregnate Jackson's ex-wife Deborah Rowe, according to his deposition.
Jackson specifically wanted Kapon to be the father of the two children, Kapon testified.
"He was obsessed with geniuses and blood lines and he told me that he wanted to continue my blood line, which he believed to be related to the Rothschilds," Kapon testified.
Jackson wanted Kapon to have sexual intercourse with Rowe, but "it did not work out," he testified.
Kapon also testified that one of Jackson's other lawyers, Marshall L. Brubacher, was conspiring with disgraced private investigator Anthony Pellicano and "other associates of Michael Jackson" to "kidnap me and make my life a living hell."
According to additional Kapon deposition testimony, he said he saw Jackson dining with Castro in New York City, Mundell's court papers state.
"These are not good-faith deposition answers," Mundell wrote. "They are the ravings of an unbalanced celebrity stalker."
Treu granted a motion by Barry Fischer, Kapon's most recent attorney, to withdraw his representation Jan. 10 after his client stopped communicating with him in late November.
Kapon's mother stated he was homeless and living in a car, Fischer said in his court papers.
"I do not know if he is ill, dead or simply refusing to respond," Fischer wrote.
The lawyer filed a "missing persons report" with Los Angeles police on Jan. 3, a copy of which was attached to his motion.
In December 2006, Treu threw out Kapon's allegations of childhood sexual molestation, intentional infliction of emotional distress, plagiarism, conversion, breach of contract, accounting, fraud, negligence, civil conspiracy and unfair business practices.
However, Treu ruled then that case could to trial on allegations of battery, willful misconduct, assault and false imprisonment, along with a sexual battery cause of action that Brubacher did not move to dismiss.
Kapon's court papers alleged the false imprisonment occurred when Jackson confined him for "multiple periods" from 1987 to late 1991 at Neverland Ranch, as well as homes in Encino and Woodland Hills.
Kapon also claimed he was occasionally confined inside a car, against his will, by Jackson; that the singer stuck his tongue down Kapon's throat, masturbated him and anally penetrated him by force; and that Jackson gave him drugs and alcohol and subjected him to unnecessary cosmetic surgery, as well as burning, torturing and beating him.
Along with the abuse claims, Kapon alleged Jackson misappropriated his song ideas, lyrics and melodies during the time in which the pop star was recording"Bad," released in 1987, "Dangerous," released in 1991, "HIStory, released in 1995, and "Blood on the Dance Floor," released in 1997.
Treu previously dismissed Sony BMG Music Entertainment and Sony Music Holding Inc. as defendants. Kapon alleged they shared responsibility with Jackson for stealing his music ideas and for breaching a contract.
Jackson was acquitted in 2005 of child molestation charges brought by a teenage boy, and some years ago reached an undisclosed, but reportedly multimillion-dollar settlement with another boy who alleged he was molested by the pop star.

Michael Jackson, Akon Are 'Startin' Somethin' ' On Thriller 25 Track -- Listen To It Here!

Forthcoming commemorative set to feature reworkings of classic MJ tracks by Kanye West, Will.I.Am, Fergie.

By Chris Harris

The first single from Michael Jackson's forthcoming Thriller 25, a collection of tunes celebrating the 25th anniversary of the King of Pop's classic LP, will be a newly recorded rendition of "Wanna Be Startin' Somethin' " that features Akon, Will.I.Am and, of course, Jackson himself.
"He's incredible," Akon told MTV News about working with MJ. "He's a genius. Just to be in the same room [with him], I felt everything I wanted to accomplish in life has been achieved. That aura ... that's how incredible that aura is. We about to shake the world up, man. You know how you be with somebody and you can't even explain [the feeling]? I used to sit and think, 'How does somebody sell so many records and dominate a whole business genre to a point [where] nobody can't be a part of that without associating with you?' The way he thinks ... some artists think regional, some think national, I was thinking international. He thinks planets. It's on another level."
The track is a new take on the original, according to a press release, and was produced by Akon and Jackson. MJ mixed and mastered the new cut.
Thriller 25, which is due in stores February 12, will include the original version of the 1982 record, in addition to five tracks previously unreleased in any form, including a Kanye West-helmed remix of "Billie Jean"; Will.I.Am's reworkings of "The Girl Is Mine" and "P.Y.T."; Fergie's version of "Beat It"; and an outtake from the original Thriller sessions called "For All Time."
The set will also feature a DVD, including all the Thriller-inspired short films ("Thriller," "Beat It" and "Billie Jean"), in addition to Jackson's Emmy-nominated performance of "Billie Jean" during the "Motown 25: Yesterday, Today, Forever" TV special. The DVD reportedly will also boast an exclusive, Jackson-penned greeting to his fans.
Initial reports suggested Jackson had also worked with Pharrell, Ne-Yo, Neff-U, Jerkins, Chris Brown, Dallas Austin and Teddy Riley on the project, but it remains unclear whether those collaborations will materialize.

The cavernous main floor is a sea of lights and noise, as thousands of mesmerized patrons slap the blinking buttons on banks of glowing, gurgling video slot machines. Michael Jackson's "Billie Jean" thumps away above the dull roar of the machines. At the Lighthouse bar in the center of the room, customers in lamp-lit, sunken seating wait for an Aerosmith tribute band to start playing, while upstairs, in a richly furnished steakhouse, diners savor $48 aged steak and $8 potato wedges kissed with truffle oil.

While the Shah is trying to enforce his regime on a people already acclimated to freedom of humanity, Marji grows up and discovers Western culture with The Bee Gees, Iron Maiden and Michael Jackson. These licks of freedom steer her in a direction where she finds herself and fuels her passion for freedom.

Ecstasy: Also, remember at that time the only black artists that MTV were playing was Michael Jackson and Run-DMC. Run-DMC had the little crossover thing with "Walk This Way" with Aerosmith and that’s how they broke into the market. After that they weren’t really trying to break-in hip-hop music at that time—not like they doing it today. It was completely different.

I was surrounded by music at a very young age. My father plays drums in a church and my mother loved to sing. She taught me actually, and my dad allowed me to play an instrument in the church on occasions. In addition, I was big fan of f Michael Jackson and wanted to be just as talented and famous as him.

But Mike Faux, of private security firm Executive Group Holdings, who has worked with footballer David Beckham, the British royal family and singer Michael Jackson, told AFP it would cost "thousands and thousands" of pounds a month to guard him.

There are also some great androgynous tracks that everyone can enjoy, such as Europe's The Final Countdown, Madness' Our House and Blondie with Atomic. All songs featured (with the exception of Eye of the Tiger, strangely) have the full music videos (perfect for chuckling at awful '80s styles), and you can also sing along with a few medleys, pushing the song total up to 35. However, given this should be a definitive '80s sing-along anthems compilation, there has surely been a few questionable omissions - where, pray tell, is anything by Michael Jackson? How about some Prince?

Michael Jackson HIStory:

1989 - The NAACP 21st Image Awards were aired. Michael Jackson won Best Male Artist and Best Album Of The Year (for "Bad").
awwww that's really something

I blame the media for all these copycat lawsuits. Had they not promote these type of sensationalism and literally pay these people for their stories the problem wouldn't exist. Yhe media pay these people for their stories and to some extent encourages them to make these claims. The whole system sucks.

This sounds no different than all of the other cases. The same way this case was dismissed, teh others should have been as well.

I completely agree. People who are probably otherwise very intelligent seem to lose all common sense when it comes to Michael. And they come up with the most stupid reasons I've ever seen in my life to sue. If anybody was coming after the average Joe making jacked-up claims like that, they'd be laughed out of court with a quickness.

tell me about it. i remember how joe said once that a tabloid was willing to pay one of his friends millions of $ if he accused michael for molesting his kids
oh and some staff at neverland in 1993 (after the false allegations) were also approached by tabloid journalists who promised them millions of dollars if they said they had seen michael touching kids inappropriately

I see alot of fans wondering why Michael pulled out of the BET ceremony...maybe that lawsuit being dismissed had something to do with it?

The american justice system needs to be overhaualed or otherwise change its name to the criminal justice system, cause it seems like many hardcore criminals are now using the system to rob people of their hard earned cash. I watched a film on tv about a major lawsuit going on and one lawyer told another that the only reason why people sue the other is to get a settlement. The cases hardly ever get to court. It seems that these disgusting lawyers take on cases against MJ only because they hope for a settlement. Now MJ has learnt not to settle any more. He will fight it in court, so I think they will be fewer lawyers willing to take on such frivolous cases.

The Kapon case was always going to end like this, after Michael has spent god knows how much on lawyers.

Maybe he should sue Carol Leiberman for assisting Kapon with his regressedd memory, and didn't Dimond and Allred have a hand in sourcing yet another non-victim?

Bet you don't hear Murdoch's monkeys having too much to say about this!

It just shows the level these scumbags will go to mess up an innocent man's name just so they can be famous. I just wonder how they live with themselves.

Yes. There need to be serious consequences for those who file blatantly frivolous lawsuits as well as their lawyers. They shouldn't be allowed to just walk away from doing things like that so that they can cause trouble for people (celebrity or not) again and again.

Michael refusing to appear on BET awards is just classic move.

You can not imagine how much pain for management companies was scheduling promotion when Jackson so many times ignored or refused to appear here and there, being so much "PR-obsessed", of course (according to tabloids, tabloid biographies and fans of JRTaraborrelli).

they judge should've known damn well that this was bs...especially once allred told him to go overseas and sell his story and then du mped him. she never missed the opportunity to vent on mj on tv.

That aledged rape case with the Duke students is in the news again. Acording to the news the prosecutor is now $180 million dollars in the hole because of it. That just tee's me off. Sneddon and Gavin walked off scott free. Where is there justice? In my opinion the prosecutor in the Duke case was more likely to be trying to prosecute for honorable reasons than Sneddon. Money can sometimes buy justice but money and power can buy revenge it seems.

Only for some people is there protection against people who like to bring false suits.

the duke lacrosse players are innocent, nifong prosecuted them for personal reasons, there was nothing honorable with his prosecutorial methods. he played the race card, got civil rights leaders involved, had them proclaimed guilty on nancy grace, released their mug shots to newsweek mag. and there was nothing that connected those 3 men or any of the lacrosse team to that woman. she even asked that the case be dropped, but he still pursued them....now that's a psychopath! just like sneddon, that's prob. why he quickly retired after mike was acquitted...but one thing sneddon can't escape is karma...so i believe in 1 way he'll pay for what he did to mike.

well the victim was a black stripper and the accused were white ivy league rich boys....it doesn't take long to muster up some support for the accused.

and is'nt it a bit funny how its been a week since this case was dismissed and have anybody seen it reported on TV at all? I betcha if it was'nt dismissed, the first one to jump on it would've been the usual suspects, Grace, Allred, Allred's spawn and the rest of the crew!
