Showdown between Howard Mann / Katherine Jackson and MJ Estate

It's a daily drama when it comes to this family. My god. For once it would be nice to have the Jackson name in the media for something good and not another scandal.
 
JWs are not against autopsies. (I know, I'm sorry to go off topic as well). Katherine might not of known about him, but I am just upset that her children are not protecting here from all of these no goods. It's just really, really sad.Mj had so much he was carrying on his shoulders. And now it seems a part of that is now on Katherine.


She is going through what Michael had to put up with. while Michael could cut them off and ban them from her life I don't think she would do that
 
I will never say a bad word about Mrs Jackson because to me the biggest problem is the fact that her children are sitting around letting it happen. Adam Streisand and the estate will make sure nothing goes to far but the Jacksons some of them to let this happen to there eighty year old grieving mother is just disgusting

Jackson Estate Ready to Pounce on Profiteer

The lawyer for the Michael Jackson estate thinks the businessman who partnered with Katherine Jackson is hurting Michael's children -- and is threatening legal action if the dude doesn't stop.

Howard Mann -- whose business ventures include online nude gambling -- got Katherine Jackson to agree to publish the book, "Never Can Say Goodbye," scheduled for release this week.

Mann also told TMZ he and Katherine will make record deals for 273 unreleased Michael Jackson songs -- part of an MJ treasure trove he acquired in a fire sale after Joe Jackson failed to pay a storage bill.

But estate lawyer Howard Weitzman is ticked, claiming Mann "may be using his relationship with Mrs. Jackson to infringe upon Michael Jackson's copyrights ... to the detriment of, among others, Michael's 3 kids."

Weitzman says Mann has no right "to exploit any estate assets" and he will take "whatever action is necessary to prevent him from unlawfully profiting." TMZ translation -- the estate will sue his ass if Mann goes forward.

We're told Katherine Jackson is happy with the job the executors have done -- namely filling the coffers with hundreds of millions of dollars -- but sources say family members are in her ear, getting her to sign off on ventures that end up hurting the estate, MJ's kids, and Katherine herself.

Howard Mann, the Toronto entrepreneur who bought a warehouse full of Jackson family paraphernalia, has a surprise for Michael Jackson fans and the singer’s estate.
He has the masters to 273 unreleased Jackson tracks. Some are Michael alone, some are duets with superstars like Tina Turner, and some are with the Jackson family.
A good chunk of them come from the 1975 CBS variety series featuring the whole family.
According to Mann, who seems to know his stuff, the Jacksons were between the end of their Motown contract that summer and the beginning of one with Epic Records.
“The recordings belonged to the Jacksons. I bought them with the contents of the warehouse,” Mann says.
Mann feels the recordings therefore do not belong to the Jackson estate, and he can release them any way he sees fit.
Meanwhile, Mann has gone into business–he tells me–with Katherine Jackson only, and not with Joseph Jackson. “My arrangements have nothing at all to do with Joe Jackson,” he says.
Mann also says he did not pay Katherine Jackson an advance for her book, “Never Can Say Goodbye.” Rather, they are business partners. It does seem that Mann has become The Man in the Jacksons’ life. But he also his largesse is not responsible for the Jackson brothers reportedly all driving new cars.
“You’ll have to look elsewhere for that answer.” he says.

I agree with those of you that have said about Katherine's 8 children. Why are they letting people take advantage of her and exploit her like this? I won't place any blame on her, I just won't. Because for a start she's 80 years old! And secondly she is grieving. I cannot believe not one of them is stepping in to stop this foolishness! The fact that it could be Joe behind this...smdh. What a sad sad situation. And once again it becomes clear the influence and foundations Michael held within that family.
 
The brothers are doing well financially because of all the Jackson and Jackson Fiver royalties that have come in during the past year. They also got proceeds from the reality show from A&M. Tito and Jermaine are getting paid for their performances and personal appearances.

Honestly, when I look at this "business" relationship and that with Marc Schifel(sp), I can't help but think some type of extortion may be behind it. No matter what, out of respect for Michael I will not be supporting these endeavors.

they get almost no royalties from their J5 years that's the way Motown worked. And whatever they get from CBS/Sony isn't much either.
 
It will work out as soon as the esate and Sony jump on this loser. What he is forgetting is the stuff does not belong to Mrs Jackson and she can't make any deals at all

Because, it seems MJ don't write the music or the lyrics. So, does it mean that his voice on records is considered Intellectual Property ?

I don't know if Michael wrote or composed any of those songs, but IF he didn't, then somebody else did. Meaning, in my opinion, that those songs belong to SOMEBODY and who ever that somebody may end up being, they will be the one who will lay claim to those songs.

A good example would be what happened with the "This Is It" song written by Michael and Paul Anka. You just can't find music in a box and lay claim to it. That ain't how it works. You need to FIRST find out who wrote the song and then take it from there.
 
Well if Mann is working with Katherine and has the Jacksons belongs, perhaps if the Jacksons can get the belongs back from him, its a win for the Jacksons for getting the stuff back. Then perhaps MJs stuff would then be back in control of the estate?

Intellectual property is the term that describes of the ownership of creation of the mind. Music as an artistic element falls under this category.

As far as I know when you talk about music the owner is the songwriter and the composer (and in some cases it can be the record company as well)..

so if michael wrote the lyrics or the music he's the owner. if somebody else did than they are owner. and you need their permission.

I'm not sure whether the intellectual property covers the performer but still they are required to get paid.

Plus Michael's name is trademarked.. Even if the estate cannot claim intellectual property infringement, they can always claim trademark infringements and unauthorized use of his image, name, and likeliness for monetary gain.

A DUET with Tina Turner. LOL! I'm sure Ms. Turner will have something to say about that.

And then there is Mann's claim that "a good chunk of them come from the 1975 CBS variety series." Which makes me ask: are the songs Jackson 5 songs, Michael Jackson songs, or songs performed by MJ and/or J5 but written by OTHER folks.

I mean, during the variety program, didn't the family sing all kinds of songs, not just Jackson 5 songs?

Yes, I do find that very odd. Especially in light of Randy and Jermaine's continuing comments regarding "family" and "family unity."

I, personally, feel as if Joe Jackson is behind all of Ms. Katherine's latest business ventures and that she most likely can't say no to Joe. But what about the siblings, are they ALSO afraid to say no to Joe?

I just think that all of this must be very stressful for Ms. Katherine and I'm surprised that her children are not stepping in to put Joe Jackson in check, once and for all.

You're right about that, but now that it seems as if Ms. Katherine's new business partner, appears to be using TMZ as his own personal platform for news. I have a feeling that we will be seeing a lot more TMZ around these parts, in the coming days, weeks and maybe months.
 
I am glad Branca and McClain have no issue telling Joe where to go. And Adam Streisand is no fan of him either. I hope he will sit Katherine down and talk to her. This guy wants to make a deal but it won't happen

You are so right on with this. You know Joe is behind all these business "scams". Katherine may be strong in other matters, but when it comes to Joe she is very weak. She just can't say "no" to him. The reason she was in court to protest the will was because of Joe, imo. Everything from the belt fiasco to this is all Joe. Ugghh! just make him go away pleeeeaaaase someone!!
 

Just because 273 songs were discovered, doesn't mean they are 273 songs that the studios don't know about. They are probably just copies of what CBS and Motown/UMG have in their vaults.

But for us, this is nice to hear that there is more out there since we don't have any exact numbers given to us by the studios.

Wishful thinking, but I would love it if they would just leak it all if they don't get the licensing to release it.
