Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

LOS ANGELES (AP) -- A judge hearing the Michael Jackson manslaughter case says prosecutors can show jurors two images from the singer's autopsy.

Superior Court Judge Michael Pastor ruled Thursday that prosecutors trying Dr. Conrad Murray can show what Pastor described as benign photos that are not graphic or gruesome.

Deputy District Attorney David Walgren says he intends to introduce photos during the upcoming trial that will be carefully displayed.

Murray has pleaded not guilty to involuntary manslaughter. Authorities have accused him of giving Jackson a lethal dose of the anesthetic propofol in the bedroom of his rented mansion in June 2009.

Murray's attorneys have suggested in recent months that the singer may have given himself the fatal dose.

Prosecutors can show limited clips of Michael Jackson's final rehearsals during the trial of the doctor charged in his death, a judge ruled Thursday.

The decision came after Deputy District Attorney David Walgren argued the footage from the film "This Is It" shows Jackson was highly engaged in preparing for his comeback tour and was not desperate to make it a success, as defense attorneys for Dr. Conrad Murray have claimed.

Prosecutors plan to show Jackson performing "The Way You Make Me Feel" and "Earth Song" while director and choreographer Kenny Ortega testifies about the pop star's demeanor before his death.

Murray has pleaded not guilty to involuntary manslaughter. Authorities contend he gave Jackson a lethal dose of the anesthetic propofol in the bedroom of his rented mansion. Defense attorneys are trying to build a case showing Jackson may have given himself the fatal dose.

Defense attorneys objected to showing the film footage, claiming it was edited to show Jackson in the best light. They noted that not all of the footage was shot in the two days before Jackson's June 25, 2009, death and should be excluded.

Superior Court Judge Michael Pastor ruled prosecutors can only show footage from Jackson's rehearsals on June 23 and June 24. He also said the footage must be edited to remove some of the special effects and visuals, particularly images of whales, polar bears, a "cute little girl" and other "flora and fauna."

Pastor said showing the footage wasn't meant to be entertainment, and it didn't matter if the entire songs were shown.

Defense attorney Ed Chernoff sought an opportunity to review raw footage of Jackson's rehearsals, but prosecutors said they do not have it. They suggested that Murray's attorneys subpoena it from Sony Pictures, which purchased rights to the footage after the singer's death.

The judge also was considering whether to allow images of Jackson's autopsy to be shown to jurors during trial. Pastor said he wants to review the images prosecutors propose to show before making a decision.

Walgren said he plans to show "a handful or less" of autopsy photos, which defense attorneys say is unnecessary.

guys the photos will not be made public...the only ones that will see these photos will be the jury and the judge...and of course pros and defense lawyers...nobody other than them will see them..they wont end up on the internet this is a high profile case..we really need to keep ourselves together here and NOT loose out minds. I dont like it either..but we have to keep our sanity..this is gonna be a long trial.

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

I don't think those pics will leak to the public. Probably will be shown in a private room and the press will not be allowed to see them.

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

Thank you, I hope you are right. I have no idea how these things are done.

The trial of Michael Jackson’s personal physician will include two haunting but starkly different depictions of the pop star’s last day -- a video of him dancing and singing on stage and photos taken hours later of his lifeless body on a coroner’s gurney, a judge ruled Thursday.
Superior Court Judge Michael Pastor cleared prosecutors to present the rehearsal footage and autopsy photos during a lengthy hearing that established evidentiary boundaries for next month’s involuntary manslaughter trial of Dr. Conrad Murray.
The judge barred both sides from delving far into the personal lives of both the physician and his famous patient, saying he wanted to focus the trial tightly on Murray’s medical care of Jackson in the months and days leading up to his 2009 death.
Jurors, Pastor said, will hear nothing about Murray’s extramarital affairs, out-of-wedlock children and penchant for strip clubs, all evidence prosecutors had hoped to present. Nor, he said, will they hear evidence that the defense had sought to introduce concerning Jackson’s crushing debt and mountain of pending lawsuits.

The ruling on Jackson’s money woes was a particularly difficult blow for Murray, whose lawyers had said their case hinged on linking the singer’s desperate financial straits to their contention that he administered himself a fatal dose of propofol. In comments in court, defense lawyer Ed Chernoff indicated that the defense planned to argue that Jackson took the drug for insomnia so he could be ready for rehearsals in a comeback concert series that would end his money problems.
But Pastor called Jackson’s debt irrelevant and said testimony from a financial analyst retained by the defense would make for “a battle of accountants” and “turn what should be a focused trial involving a charge of involuntary manslaughter into a salacious analysis of personal financial issues.”
“We simply are not going there,” he said.

The defense also lost a fight to prohibit the use of the autopsy photos and video clips of rehearsal that were taken from the posthumous Jackson documentary “This Is It.” Defense lawyer Nareg Gojourian said the clips were “sliced and diced” by moviemakers to give a false impression of Jackson’s abilities and health, but Deputy Dist. Atty. David Walgren said videos were “most probative as to Michael Jackson’s mental and physical wellbeing and optimism for the future.”
Murray, 58, faces a maximum of four years in prison. He has pleaded not guilty.

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

This is downright disrespectful to the honor and legacy of Michael Jackson. This is not kosher at all.

Re: Prosecutors Seek to Show Video of 'Active, Energetic' Pop Star Before His Death

easier said than done. interms of not seeing the pics. all over newapper front pages magazines websites.etc etc

I'm not too sure if that's legal, in terms of newspapers and magazines. But of course, anything can happen with the usage if the internet.

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

It's terrible bad news... I hope and pray that these photos not will be published in public!!!

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

by not letting any of Murrays personal business be part of this case THAT takes away the whole reason that Murray took the job in the first place. I know some will say that if they let that into evidence then they have to let Michael's financial situation into evidence that is NOT true. I also know that people will say well what does Murray's financial situation have to do with what happend in that room??..My answer is...EVERYTHING because if Murray would of not been in such a money crunch he never would of taken the job...and Mchael would of still been here...Murray is a huge ass FAIL

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

I look at it this way, I'm all for anything that will help the prosecutors and hurt the defense. If that's what these photos do, so be it as long as the only eyes seeing them are 13 pairs, the judge and 12 jurors.

Exactly. I didn't want to see JFK autopsy pictures but I did.

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

All I pray is that these photos dont leak on the net, I cannot bear to see those photos, I really cant.

Good!

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

I'm glad the judge won't let the financial aspects of Michael into the trial as I feel that murray's camp is on a fishing expedition here. If this info had been allowed, the next thing murray et al., could say would be that Michael intentionally killed himself because of the "huge debt..." or what ever.

But I do think that murray's extracurricular activities are very important here. It could be said they had an influence on the care he gave, after all they led to the phone calls which took him away from his patient, for heaven's sake! I mean who would be so important to murray that he would neglect his patient to talk with them? Certainly not a casual acquaintance! When the phone activities are gone over, much of that will come out anyway. I hope.
I don't understand the autopsy photos. Why is the prosecution wanting them? Without question, Michael is dead. So. What's the point?
And I worry that despite all the best intentions, somehow someone on the defense side will leak them. I do not trust murray. At all. And it's not like they've never leaked anything before.

I WILL try and think positively though. (I'm positive I'm not looking forward to this, I'm positive murray is a despicable liar, I'm positive he should rot in a very hot place...)

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

Once those photos get onto a disk drive to be brought to the court computer they'll leak somehow... I can't bare the thought of everyone seeing Michael like this.

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

I know. I cried all the way home from work after reading this i cant get the descriptions out of my head. I keep telling myself whatever it takes to get justice but this upsets me no end

What...NO!

Is that true? Because Reuters reported differently saying:

Pastor said he will also allow testimony from women with whom prosecutors say Murray, who was married at the time, had a "personal and social relationship." But the judge did not want jurors to hear about Murray meeting two of the women at strip clubs.

Which one is right?!

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

It seems the prosecutors are only going to focus on the substandard care.. that is the crux of the ivm charge imo and you don't need Murrays financial history to prove that. If you were looking for motive for a higher charge then yes its necessary

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

It seems hes allowing the testimony from the women.has to cause of the phoncalls but the pros wont be able to ask them about their affairs with him etc. And reuters are crap anway have a history of gettung court stuff wrong

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

this judge is out of his mind, Murray's disgusting character and extra marital affairs should be alloweD!

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

Well, I would say mostly all media sucks, when it comes to MJ! lol I can imagine how they will report when the trial starts...just as bad as 05? I hope not! I believe from reading another thread here that the judged limited talk about his affairs! But, those women will still testify!

Re: MJ Autopsy Photos ALLOWED In Dr. Murray Trial

Oh god NO!!! Why would these idiots allow this to be shown. Never trust the justice system. Now they're angering us.
