THIS IS IT demand was outstanding, Randy Phillips had never seen anything like that in his career
 
Paul Congoware called Randy and asked him if he could call Dr Thome and see if MJ wants to do more shows?

Within 20 minutes Dr Thome said yes, he also talked to MJ and MJ also said yes

MJ had some demans, like a passport, a house with horses etc.
 
I hope people that thought Michael was irrelevant are listening to how much people wanted to see him.

His concert would have been unique in all manner, first person to have used a 3D screen at a concert...he would have been on top of the world again.
 
Asks if any production was going on in March Randy says no it started in April, says in MArch Michael and Paul would be meeting regarding people, says Michael told Paul, Kenny should be the director, says by April Kenny was part of the team.
Says in April Kenny had arranged for Michael Cotton to be employed, had brought in Travis Payne, had brought in numerous people. Chernoff asks if auditions took place in April, Randy says yes. Asks when the actual rehearsals started, Randy claims he doesn't know, says they may have started in May, but he isn't sure.
Chernoff wants to talk about early May asks if he recalls a conversation with MJ about a personal doctor, Randy says yeah it happened sometime in May. Says yes, he wasn't initially involved but he was approached in late May, says Frank Dielo, some guy named Philly and Paul Gongaware approached him says Michael wanted a personal physician, says they told him it was gonna be extremely expensive,
he tried to talk Michael out of it, says he called up Michael Amir and to talk to MJ, says he rang him up and said it was extremely expensive for an American doc to be in London, says MJ told him no he wanted his personal physician present 24/7 says Michael was very firm, that he wanted his doc not any random London based doc. Randy says he told Michael that he'd talk to Paul Gongaware.

Chernoff asks if rehearsals were ongoing at that time, Randy says, yes they had already left Burbank at that time, says Michael wasn't expected to be at those rehearsals, Chernoff aks if there were concerns that MJ was missing rehearsals, Randy says yes in the second week there were concerns from Kenny, as he wasn' coming, says there were no concerns about MJ not showing up in May cuz he wasn't expected to be present cuz the band was new etc.
Says Kenny started to get concerned that MJ wasn't as engaged as he should have been, says Kenny first went to Paul and Dileo with his concerns then approached him.
Chernoff asks when the production was supposed to move to London, Randy says at first it was supposed to happen around June 25. Chernoff asks if it was expected that rehearsals were attended, Randy says yes, says Kenny was concerned about Michael's focuse during that time, He says when Kenny approached him with his concerns, he talked to Murray first then to Michael Amir Williams, says he explained Michael Amir Williams, says he explained him why Michael should've been present.
Says he spoke to Michael Amir Williams cuz Williams told him MJ was resting. Chernoff asks if there were further missed rehearsals.in the week prior to MJ's deaht, Walgren objects, judge sustains, Chernoff asks if Kenny caleld him, Walgren objects judge sustains on the grounds of hearsay.
Chernoff asks if he is aware that the email Kenny sent him, was presented to the jury, Randy says he received it.
Says he'd never met Murray before having that particular conversation with Michael, says he met Murray at Michael's house (Carolwood) in early June. Isn't sure though, says it was the first week in June. Says he thinks it was during the week not at the weekend, says it took place late afternoon, probably before 5pm.
Says Gongaware and Dileo called the meeting, says Frank had concerns about Michael not eating and loosing wealth, meeting was to discuss Michael's health as he was loosing wait, says Gongaware, Dileo, Murray, Michael J. and he (Randy Phillips) were present during that meeting, says he doesn't recall if Kenny was present or not.
Says he doesn't recall having any conversations in May about Michael's health/condition. Chernoff asks if he recalls that meeting in June, Randy Phillips says he remembers vaguely, says Murray claimed he'd prepare protein shakes for Michael, says he'd take care of him. Says Murray told him Michael was in great health during that meeting. Chernoff asks if there were any other conversations with Murray regarding MJ's health, weight, etc Randy denies, says he felt good based on Michael and Murray's responses, Says Dielo was confident too. Says it was obvious that Michael trusted Murray greatly, says it appeared that Murray wanted to help MJ when asked by Chernoff.
Chernoff asks if he was directl involved hiring Murray for the tour Phillips says no.

It really bugs me that he sits there like he did nothing wrong and rolls his eyes. At times it looks like he isn't looking at the witness.
 
When Randy saw the e-mail Kenny sent him.... Frank Dileo also recieved the e-mail and Frank called him to set up a meeting...
 
at a production meeting (date?) MJ did not act like himself... he seemed not concentrated.. because he usually would look concentrated and was a perfectionist.. so Randy asked Michael Amir if everything was alright and Michael Amir told him MJ just got back from Arnie Klein
 
Frank Dileo called him on June 25th around 10:30 or 11am and told him MJ had a trouble breathing and paramedics were there, he arrived in 15 min and saw the ambulance leave for the hospital

Randy stayed at the hospital the whole day/evening

He saw dr murray there too... saw him at the lobby and outside the trauma room

Murray was in severe distress

Says he wasn't sure what Kenny ment with the 'tough love' part in the email, says there was concerned cuz they thought Michael wasn't taking it seriously, says there was never talk about pulling the plug. Says noone from AEG was thinking about pulling the plug, says the first time he heard that phrase was in Kenny's email.
Says the first time he got the email was when Dielo called him from Pittsburgh, says Dileo asked him to put together a meeting with Kenny, Murray, Paul and himself. Says Dileo demanded that meeting, says he either emailed or called up Murray to set up the meeting. Chernoff asks if Frank brought up drug use of MJ, Randy says no Frank never brought it up.
Chernoff asks if it was brought up by Murray, says he approached Murray around june 20 and asked him if he was aware that Michael was treated by Klein as well, says Michael wasn't focued on that meeting. Says after the meeting he asked Michael Amir Williams if everything was ok cuz MJ seemed off, and AMir replied that he just came out out of Klein's office (implying it had to do with Klein)
Says he thought Murray should be aware that MJ was seeing Klein cuz he was his principal doc, that's the reason he told him. Chernoff asks if he is aware that Michael had past problems with prescription drugs, Randy about to answer Walgren objects judge sustains.
Chernoff asks if that meeting was an emergency meeting. Says it wasn't but it was urgent due to Kenny's email, says Dileo wanted it as well due to Kenny's email.
Says at the meeting Murray, Michael, Kenny and he (randy phillips) were present, says he called up Murray and aksed him to set the meeting.
Chernoff asks if he told Murray what the meeting was for he says he may have read it or emailed Kenny's meeting to him, says they discussed Michael's lack of focus, says Kenny told him that they'd need Mcihael's engagement, told him they needed him focus, that they needed to build the production around MJ
Says Kenny was calm while talking about it, says MJ didn't respond immediately says Murray spoke for him, assuring Michael would be showing up. Michael then says that he knew the routines, says he'd worked with Travis at home says Michael said 'you build the house and I'll pave the door' says Kenny was satisfied with Michael's response, says Kenny didn't get why Michael wasn't that focused.
Chernoff assks if Kenny brought up drugs, or anyone else, Randy says no, (Chernoff **** off) aasks if there were ever concerned about MJs drug use prescription or otherwise, Randy denies it.
Says he was present at the 23rd and 24th meetings. Says he received a phonecall from Frank Dileo, telling him to go to the house, says it was around 10.30/11. am Frank was saying MJ was having problems breathing. Says he took around 15 mins to get to MJ's house. Says the ambulance were about to leave the residence at that time.
 
contract was signed in jan. through march was there any movement on the production of the tour? no there wasnt. was it a teaser/plan by AEG to tease a certain number of shows? initally there were 10 shows advertised. u never put all of them on sale at once. this was done march 6th day after the P.C

was there futher disccusion with mj about the art work for advertising. talk about the press confernce at the 02. randy was there. how was it set it? AEG staff in london arranged it used a press agent etc. stay in the same hotel with mj? objection substained trying to ask if mj was late for the P.C objection substained. judge tells him to move away from the press confernce talk after chernoff says should i just not talk about the P.C judge says yes lol

sales of the shows how were they. they were fabulous. . ppl pre registared at mj live the numbers were.. never seen that demand ever. 31 shows would sell out in the presale alone. gognaware called randy and said call thome and ask mj is he will do more shows. did mj agree? yes he agreed within 20 mins.there were some requests from mj for the shows. 50 was the max. mj wanted a house outside of london 16 acreas horses . mj said he didnt want to be trapped in a hotel suite. he wanted somewhere the kids could be out in the country. at the 50th show mj wanted the guiness book ppl there as no one would beat his record.

moving onto the production. any production going on in march? no it hadnt started then. in march mj and gongaware had meetings about the show with production ppl sorting out budgets. thats when mj told paul he wanted kenny.

in april what was happening. kenny was onboard then.kenny arranged for a production designer travis payne. personal were being hired. auditions were taking place. when did reharsals start? believes it was may but not 100%.

any convos with mj about a personal dr in april or may? yes sometime in may. who started the convo? randy got involved at the forum where rehearsals were happening. gongaware frank was there. they said mj wanted to hire a dr but hes gonna be expensive we wanna get one from london. randy said he would talk to mj to try and talk him out of it cause of the expense. can we get someone from london instead. mj was firm and said no i need may own dr 24/7 and i have one. this was in late may. randy said ok ill get gongaware to talk money with murray. randy was not involved in that.

in may were there any concerns being given by kenny or others about mjs health.? no talk to amir? no

meet murray b4 that convo? no .mj never mentioned him. met murray at mjs house around early june for the first time. know what day it was? he thinks it was during a week day. gongaware and frank called the meeting. prelim meeting to discuss what murray was gonna do for mj frank and others were concerned about mj losing weight. during the meeting murray said mj would have a proper diet he was making protien shakes for him. was his health good randy asked murray. yes its great says murray. satisfied with the meeting about mjs health? yes . mj trusted murray obviously in the meeting. he thought murray and mj were close. it appeared murray cared and wanted to help..

where was production in early june? rehearsals were going on at the forum mj expected to be at the rehearsal? not all of them. any concern about mj mising rehearsals. yes in the second week in june only. b4 that did ortegas express concern? no not at the forum cause mj wasnt needed as there was a new band doing the music

kenny was concerned later on. did kenny come to you? first he went to gongaware and frank as they were there. when was everyone going to london.? around june 25th. once in june its important that rehearsals are done well? yes. more pressure on everyone? yes. did u see the pressue in ortega? yes. the main concern was mj? yes mj showing up and his focus.when kenny told you what did you do? thinks he talked to amir and murray. really needs mjs presence even though he knows all the dance moves cause ppl follow him on stage.take their que from mj. why call amir and not mj? he did ring mj but mj was resting so amir took the call. thinks he spoke to murray but not sure.

june 20th meeting.chernoff brings up the email. it was shown to philips. do u remember getting it? yes he got it the next day. did u understand the comments tough love? randy says he didnt understand the tough love comment. but he understood the concerns about mj not being focused. was there concern the show couldnt go on if mj didnt take it seriouisly? no think he said no. mentions of delays due to production issues. no one was ever planning on pulling the plug at AEGs end in reference to kennys comment in his email. frank wanted a meeting set up did frank mention concern about drug use by mj? no. convo with murray about drugs? there was one convo randy said to murray klien is treating mj are u aware of that. randy says i asked him cause there was a meeting at mjs house for production and mj wasnt sharp or distracted. whats that gotta do with klien? randy asked amir if everything was ok amir said hes just been at kliens. randy told murray cause he wasnt sure if he knew that mj was seeing klien

u knew mj had drug issues in the past? objection substained.

the meeting in late june was set up cause of kennys email and franks phonecall. frank asked randy to set up the meeting. he thought the meeting was about mjs tardiness. only knew about mj being ill from kennys email. at the meeting was murray mj kenny and randy. randy rung murray and asked him to set a meeting up. randy told murray about kennys concerns or he may have forwarded the email to murray. ortega opened the meeting that mj needed to focus they needed mj it had to be built around him for all the 3D stuff. kenny was calm during the meeting. how did mj repsond? murray spoke for mj said mj would connect. mj said he had been working with travis at home. he knew all the routines. mj said you build the house and ill put on the door and paint it he said that to kenny and kenny said great. murray and ortega then talked and murray said ill be incharge of his health u do the concert. any drug comments concerns by kenny? no not in the meeting. anyone at the meeting talk to murray about drugs? no. no one did.

randy went to rehearsals on june 23rd after that meeting he wanted to see if everything was ok

25th got a call from frank asked where are u? randy was nearer to the house than frank so frank said get round there.so randy went to carolwood. he saw medics and the ambulance leaving. and two car followed. randy followed the ambulance. he was at the hospital all day till early eveining. he saw murray there. and met up with frank and they sat and waited. saw murray later that day in the hospital lobby. saw him around the conference area later as they got everyone together

talked to murray once in the lobby murray say anything? no he was in severe distress.

Quite frankly, I don't see why they call Randy. He offered nothing new except for a little more detail on stuff we already knew. The only thing he confirmed was that AEG and Frank didn't want Murray from the start and were trying to convince Michael for some time to get rid of him. Even the meeting on the 20 of June was kind of low key.
 
let's judge after Walgren's cross. At this rate I doubt Faye is gonna testify today.

imsurprised chernoff didnt go down the whole was mj stressed route. i guess he couldnt cause philips didnt see mj that much.defence got nothing at all from that. philips even downplayed the earlier missed rehearsals as mj wasnt required to be there
