A Message from Barry Gibbs

Michael Jackson and I were the dearest of friends, thats simply what it was. We gravitated towards the same kind of music and we loved collaborating and he was the easiest person to write with. The more we got to know each other the more those ideas entwined and it all came to this song " All in Your Name".

"All in Your Name" is infact the message that Michael wanted to send out to all of his fans all over the World that he did it all for them and for the pure love of music. I hope and pray that we all get to hear it in its entirety. This experience i will treasure forever.

Recorded & Filmed at Middle Ear Studios in December 2002. All footage was shot by Ashley Gibb on a high 8 camera. There is over 2 hours of footage.

Sounds like the song exists in full. But it is not sure if he can release it. Because the estate doesn't want it or took it away from him?

Well if they ''took it away'' as you state it's cause they have the rights to, as it's Michael's song. Or in other words Barry is not allowed to release it without the Estate's permission, even if it is in his posession.

I hope this precious song will be released, what a total waste would that if otherwise. Michael's voice is so pure, sweet and sincere......

I love the Bee Gees... one of my favorite musical groups ever.. And Barry Gibb is another musical genius who also has a warm heart. I pray, like him, that this diamond will be released in its entirety. ......

I see this and I can't really describe the feeling that filled me.....I'm happy and sad all at the same time. This man was blessed with a precious gift and he shared it with us willingly and I for one will forever be truly greatful for this.

Michael will be forever in my heart, I love you Michael.

Btw.....thanks to Barry Gibb so much for this.

WOOOW! That brought tears to my eyes! MJs voice is so amazing, I really like the song! Can't wait to hear the whole thing and see more of this footage. MJ had a light goatee... OMG he looked so GOOD! :p

If they'd have rights, Barry wouldnt leak any of it. I thought if he give us this snippets so he has a rights to this song. Anyway, I cant understand what happens.

simple

as this is a collaboration that obviously has Michael's vocals , Estate automatically becomes the joint copyright owner. Plus as you know Michael's name , image and likeliness cannot be used without authorization of the Estate.

So simply it means that any official release would require an authorization / permission from MJ Estate.

again Barry would have joint rights, it's not like he's "leaking" a song that he has no rights to. Plus as Barry would have right over this collaboration the 30 second snippet could fall under "fair use".

ps: I do not think that this classifies as a "leak" as like I said Barry also has rights over the song and he has the song legitimately.

and legal tidbit
Determination of fair use:
- how much of the song used?
- is it detrimental to the potential market?
- is it defaming or damaging to the original material?
- is it part of a collection that's not meant to be separated, etc.?
- has the artist or copyright holder specifically asked not for their music to be republished?
